INFORMATION NOTICE
regarding the processing of data of partners’ representatives
Identity and Contact Details of the Controller
Lugera is a group of companies mainly operating in the field of human resources (recruitment, temporary work, outsourced services, personnel administration, payroll, etc.), as well as in financial intermediation services, with human capital being the main resource we provide.
The terms “Lugera” or “we” refer to any of the following companies: Lugera & Makler S.R.L., Lugera & Makler Romania S.R.L., Lugera & Makler Payroll S.R.L., Lugera Recruitment Services S.R.L., Lugera Outsourcing S.R.L., Lugera Executive Search S.R.L., Lugera Servicii Profesionale S.R.L., Credit Card Broker S.R.L., Lugera Active Recruitment S.R.L., as well as any affiliated company registered in Romania.
In expressly provided cases, Lugera may also refer to any affiliated company registered inside or outside the European Economic Area.
Purposes and Legal Basis of the Processing
Lugera processes your personal data in accordance with the provisions of the GDPR, in its capacity as data controller, for the following purposes:
- To negotiate, conclude, and perform contracts with partners, in order to contact you regarding the specific collaboration between Lugera and the contractual partner (client, supplier, collaborator, etc.) you represent – for example, regarding service provision, delivery of goods, contractual terms, invoices, notifications, complaints, or any other professional communication based on or related to the contract or collaboration, or any communication customary between professionals;
- To keep the necessary records regarding the existence and execution of the contract;
- To comply with applicable laws (e.g., tax and accounting regulations) and respond to requests from relevant authorities.
Legal Grounds for Data Processing
- 6, para. 1, letter f) GDPR (“legitimate interest”), if you are a representative/employee of the partner;
- 6, para. 1, letter c) GDPR (“legal obligation”).
Types of Personal Data We Process
Lugera’s data protection and security policy is to collect only the personal data necessary for the purposes mentioned and to request from the data subjects only the data strictly necessary to fulfill these purposes.
The categories of personal data are:
- Full name;
- Professional email address;
- Business phone number;
- Job title;
Source of the Personal Data
The personal data Lugera processes about you is collected from your employer or the company you represent (the partner), or, where applicable, from an affiliate of the Lugera company.
Categories of Personal Data Recipients
Your personal data is intended for use by the controller and may be disclosed, if applicable, to:
- Lugera affiliates, for internal administrative purposes;
- Central and local public authorities/institutions, as required by applicable laws;
- Courts of law for the purpose of initiating legal proceedings and representation.
Retention Period of Personal Data
We retain your personal data for as long as necessary to fulfill the above-mentioned purposes and, in any case, for the duration of the contract/collaboration, plus an additional period equal to the statutory archiving period for supporting documents related to contractual relationships, service delivery, and accounting records.
Your Rights and How to Exercise Them
Under applicable legal provisions, you have the right of access, right to rectification, right to erasure, right to restriction of processing, right to data portability, right to object, and right not to be subject to automated individual decision-making.
These rights may be exercised by submitting a written request to Lugera & Makler S.R.L., either in physical form to the address in Bucharest, Sector 3, Str. Vulturilor no. 98, 1st floor, with the mention “Data Protection,” or electronically via email at dataprotection@lugera.ro, with the mention “Data Protection.”
We will respond to your request as soon as possible, but no later than one (1) month from receipt of the request.
You also have the right to file a complaint with the National Supervisory Authority for Personal Data Processing in Romania.
