Prin <a href=\"https:\/\/legislatie.just.ro\/public\/DetaliiDocument\/307523\" target=\"_blank\" rel=\"noopener\"><strong>OUG nr. 6\/2026<\/strong><\/a>, Guvernul a modificat cadrul legal privind <strong>Fondul de garantare a crean\u021belor salariale<\/strong>, introduc\u00e2nd dou\u0103 schimb\u0103ri majore: cre\u0219terea plafonului de plat\u0103 pentru companiile desemnate ca fiind de interes strategic \u0219i extinderea mecanismului de garantare la firmele care au deschis procedura de concordat preventiv.<\/p>\n<p>Aceste modific\u0103ri au impact direct asupra modului \u00een care este protejat <strong>fondul de salarii<\/strong> al angaja\u021bilor \u00een situa\u021bii de dificultate financiar\u0103 a angajatorului.<\/p>\n<h2>Extinderea protec\u021biei: nu doar insolven\u021b\u0103, ci \u0219i concordat preventiv<\/h2>\n<p>P\u00e2n\u0103 recent, mecanismul de garantare se activa, \u00een esen\u021b\u0103, \u00een cazul deschiderii procedurii insolven\u021bei. Noua reglementare include expres \u0219i angajatorii pentru care exist\u0103 o hot\u0103r\u00e2re judec\u0103toreasc\u0103 definitiv\u0103 de deschidere a procedurii de concordat preventiv.<\/p>\n<p>Concordatul preventiv este o procedur\u0103 de redresare, nu de lichidare. Extinderea mecanismului de protec\u021bie la aceast\u0103 etap\u0103 reflect\u0103 o abordare preventiv\u0103: statul intervine mai devreme pentru a asigura plata salariilor restante \u0219i pentru a reduce impactul social al dificult\u0103\u021bilor financiare.<\/p>\n<p>Pentru angaja\u021bi, aceasta \u00eenseamn\u0103 acces la mecanismul de garantare chiar \u00eenainte de intrarea \u00een insolven\u021b\u0103 propriu-zis\u0103.<\/p>\n<h2>Noi limite pentru companiile de interes strategic<\/h2>\n<p>O alt\u0103 modificare esen\u021bial\u0103 vizeaz\u0103 angajatorii desemna\u021bi ca operatori economici de interes strategic. Pentru ace\u0219tia, plafonul maxim de plat\u0103 din Fondul de garantare cre\u0219te de la cinci la cel mult dou\u0103sprezece salarii medii brute pe economie pentru fiecare salariat.<\/p>\n<p>Salariul mediu brut luat \u00een calcul este cel comunicat de Institutul Na\u021bional de Statistic\u0103 \u00een luna deschiderii procedurii.<\/p>\n<p>Pentru firmele strategice aflate \u00een insolven\u021b\u0103, plata poate acoperi drepturi aferente unei perioade de p\u00e2n\u0103 la 12 luni consecutive. \u00cen cazul concordatului preventiv, perioada este limitat\u0103 la cel mult \u0219ase luni consecutive.<\/p>\n<p>Aceast\u0103 diferen\u021biere reflect\u0103 importan\u021ba economic\u0103 \u0219i social\u0103 a acestor angajatori, \u00een special \u00een domenii precum infrastructura critic\u0103, energia, industria de ap\u0103rare sau lan\u021burile esen\u021biale de aprovizionare.<\/p>\n<h2>Ce tipuri de drepturi salariale sunt garantate<\/h2>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/03\/fond-de-salarii-scaled.jpg\"><img decoding=\"async\" class=\"aligncenter wp-image-9928 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/03\/fond-de-salarii-scaled.jpg\" alt=\"fond de salarii\" width=\"750\" height=\"500\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/03\/fond-de-salarii-scaled.jpg 2560w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/03\/fond-de-salarii-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/03\/fond-de-salarii-1024x683.jpg 1024w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/03\/fond-de-salarii-768x512.jpg 768w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/03\/fond-de-salarii-1536x1024.jpg 1536w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/03\/fond-de-salarii-2048x1365.jpg 2048w\" data-sizes=\"(max-width: 750px) 100vw, 750px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 750px; --smush-placeholder-aspect-ratio: 750\/500;\" \/><\/a><\/p>\n<p>Fondul de garantare acoper\u0103 o gam\u0103 larg\u0103 de crean\u021be legate de fondul de salarii, inclusiv:<br \/>\nsalariile restante;<\/p>\n<ul>\n<li>compensa\u021biile pentru concediul de odihn\u0103 neefectuat (\u00een limita unui an);<\/li>\n<li>pl\u0103\u021bile compensatorii stabilite prin contractele de munc\u0103;<\/li>\n<li>indemniza\u021biile datorate pentru accidente de munc\u0103 sau boli profesionale;<\/li>\n<li>indemniza\u021biile aferente reducerii sau \u00eentreruperii temporare a activit\u0103\u021bii.<\/li>\n<\/ul>\n<p>Sumele sunt pl\u0103tite \u00een cuantum net c\u0103tre salaria\u021bi, iar obliga\u021biile fiscale aferente sunt declarate de angajator \u0219i virate efectiv de agen\u021biile teritoriale competente, care ac\u021bioneaz\u0103 ca pl\u0103titor la surs\u0103.<\/p>\n<h2>Mecanismul de plat\u0103 \u0219i recuperare<\/h2>\n<p>Chiar dac\u0103 Fondul suport\u0103 efectiv sumele, procedura presupune depunerea unei cereri la agen\u021bia teritorial\u0103 pentru ocuparea for\u021bei de munc\u0103. Plata drepturilor este condi\u021bionat\u0103 de deschiderea oficial\u0103 a procedurii \u0219i de \u00eendeplinirea cerin\u021belor legale.<\/p>\n<p>Un element important \u00een practic\u0103 este momentul deschiderii procedurii \u0219i al depunerii cererii, deoarece perioada pentru care pot fi solicitate sumele este raportat\u0103 la aceste date.<\/p>\n<p>Pentru cererile depuse anterior intr\u0103rii \u00een vigoare a ordonan\u021bei, se aplic\u0103 regulile \u00een vigoare la data depunerii.<\/p>\n<h2>Cine este considerat operator economic de interes strategic<\/h2>\n<p>Ordonan\u021ba introduce o defini\u021bie explicit\u0103 a operatorului economic de interes strategic. Este vorba despre acele companii a c\u0103ror activitate este esen\u021bial\u0103 pentru ap\u0103rarea na\u021bional\u0103, securitatea economic\u0103, energetic\u0103 sau alimentar\u0103, pentru infrastructurile critice ori pentru capacit\u0103\u021bile industriale de ap\u0103rare.<\/p>\n<p>Desemnarea se face prin hot\u0103r\u00e2re a Guvernului, pe baza unor criterii obiective stabilite la propunerea ministerelor de resort, cu avizul Ministerului Muncii.<\/p>\n<p>Impactul asupra pie\u021bei muncii \u0219i asupra comunit\u0103\u021bilor locale este unul dintre elementele avute \u00een vedere la stabilirea acestei categorii.<\/p>\n<h2>Ce \u00eenseamn\u0103 aceste schimb\u0103ri pentru angaja\u021bi \u0219i angajatori<\/h2>\n<p>Pentru salaria\u021bi, modific\u0103rile ofer\u0103 o protec\u021bie extins\u0103 a fondului de salarii \u00een situa\u021bii de instabilitate financiar\u0103 a angajatorului, inclusiv \u00eentr-o faz\u0103 pre-insolven\u021b\u0103.<\/p>\n<p>Pentru angajatori, \u00een special pentru cei din sectoare strategice, noul plafon poate contribui la men\u021binerea stabilit\u0103\u021bii sociale \u0219i la reducerea tensiunilor generate de neplata salariilor \u00een perioade critice.<\/p>\n<p>\u00cen acela\u0219i timp, obliga\u021biile administrative r\u0103m\u00e2n semnificative, iar coordonarea cu autorit\u0103\u021bile teritoriale este esen\u021bial\u0103 pentru aplicarea corect\u0103 a mecanismului.<\/p>\n<h2>Concluzie<\/h2>\n<p>Prin <a href=\"https:\/\/legislatie.just.ro\/public\/DetaliiDocument\/307523\" target=\"_blank\" rel=\"noopener\"><strong>OUG nr. 6\/2026<\/strong><\/a>, protec\u021bia fondului de salarii devine mai larg\u0103 \u0219i mai nuan\u021bat\u0103.
