Ea define\u0219te concret \u201efelul muncii\u201d, element esen\u021bial al raportului de munc\u0103.<\/p>\n<p>\u00cen trecut, au existat tentative legislative de relaxare a obliga\u021biei pentru anumite categorii de angajatori, \u00eens\u0103 experien\u021ba practic\u0103 a demonstrat rapid c\u0103 eliminarea fi\u0219ei postului genereaz\u0103 insecuritate juridic\u0103 \u0219i litigii. Modelele generice, preluate f\u0103r\u0103 adaptare, pot crea mai multe probleme dec\u00e2t rezolv\u0103.<\/p>\n<h2>Atribu\u021biile trebuie s\u0103 respecte calificarea \u0219i codul COR<\/h2>\n<p>Un principiu de baz\u0103 \u00een redactarea fi\u0219ei postului este corelarea atribu\u021biilor cu codul COR al func\u021biei \u0219i cu preg\u0103tirea profesional\u0103 a salariatului.<\/p>\n<p>Conceptul de \u201eangajat bun la toate\u201d nu are sus\u021binere juridic\u0103. Atribu\u021biile trebuie s\u0103 fie compatibile cu ocupa\u021bia pentru care a fost \u00eencheiat contractul. Extinderea lor c\u0103tre domenii care presupun alte calific\u0103ri poate conduce la nulitatea clauzelor respective sau la constatarea modific\u0103rii unilaterale a felului muncii.<\/p>\n<p>De asemenea, trebuie f\u0103cut\u0103 o distinc\u021bie clar\u0103 \u00eentre atribu\u021biile concrete \u0219i obiectivele de performan\u021b\u0103. Fi\u0219a postului stabile\u0219te ce trebuie s\u0103 fac\u0103 salariatul; obiectivele stabilesc nivelul la care trebuie realizate acele sarcini. Confuzia dintre cele dou\u0103 poate transforma neatingerea unui target \u00eentr-o pretins\u0103 abatere disciplinar\u0103, f\u0103r\u0103 fundament legal.<\/p>\n<h2>Fi\u0219a postului ca instrument de evaluare \u0219i disciplin\u0103<\/h2>\n<p>\u00cen lipsa unor atribu\u021bii clar definite, evaluarea profesional\u0103 devine vulnerabil\u0103. Pentru a recupera un prejudiciu, angajatorul trebuie s\u0103 dovedeasc\u0103 faptul c\u0103 salariatul a \u00eenc\u0103lcat o obliga\u021bie concret\u0103, prev\u0103zut\u0103 expres. Instan\u021bele resping frecvent ac\u021biuni \u00een desp\u0103gubire atunci c\u00e2nd atribu\u021biile nu sunt descrise clar sau sunt formulate vag.<\/p>\n<p>Formul\u0103ri precum \u201e\u00eendepline\u0219te orice alte sarcini dispuse de superior\u201d nu pot substitui descrierea concret\u0103 a responsabilit\u0103\u021bilor.<\/p>\n<h2>Modificarea fi\u0219ei postului: limitele puterii unilaterale<\/h2>\n<p>Activitatea unei companii evolueaz\u0103, iar sarcinile pot suferi ajust\u0103ri. Totu\u0219i, modificarea fi\u0219ei postului nu este un act discre\u021bionar.<\/p>\n<p>Ajust\u0103rile minore, care nu schimb\u0103 natura postului, pot fi realizate \u00een limite rezonabile. \u00cens\u0103 atunci c\u00e2nd modific\u0103rile afecteaz\u0103 esen\u021ba activit\u0103\u021bii sau presupun atribu\u021bii substan\u021bial diferite, este necesar acordul salariatului, materializat prin act adi\u021bional.<\/p>\n<p>Modificarea unilateral\u0103 a felului muncii poate conduce la nulitatea m\u0103surii \u0219i la litigii privind \u00eenc\u0103lcarea contractului.<\/p>\n<p>Un alt risc major este suprasolicitarea. Ad\u0103ugarea constant\u0103 de atribu\u021bii f\u0103r\u0103 adaptarea normei de munc\u0103 poate conduce la situa\u021bii de munc\u0103 suplimentar\u0103 mascat\u0103 sau chiar la acuza\u021bii de h\u0103r\u021buire profesional\u0103.
