Urgen\u021bele medico-chirurgicale beneficiaz\u0103 de indemniza\u021bie integral\u0103, iar \u00een cazul anumitor accidente grave \u2013 cum sunt arsurile severe, \u00een condi\u021biile prev\u0103zute de lege \u2013 procentul de 100% se acord\u0103 pe \u00eentreaga perioad\u0103 de tratament \u0219i recuperare.<\/p>\n<p>Prin compara\u021bie, pentru bolile obi\u0219nuite, procentele sunt mai reduse \u0219i pot varia \u00een func\u021bie de durata concediului medical. Diferen\u021ba de tratament juridic este justificat\u0103 de natura profesional\u0103 a riscului.<\/p>\n<h2>Baza de calcul \u0219i stagiul de cotizare<\/h2>\n<p>Un alt element distinctiv \u00een cazul <strong>Concediului medical accidente de munc\u0103<\/strong> este lipsa condi\u021biei privind stagiul minim de cotizare.<\/p>\n<p>Salariatul este asigurat pentru accidente de munc\u0103 din prima zi a raportului de munc\u0103, deoarece aceast\u0103 asigurare este \u00een sarcina angajatorului. Dac\u0103 persoana accidentat\u0103 are o vechime mai mic\u0103 de \u0219ase luni la angajator, indemniza\u021bia se calculeaz\u0103 pe baza veniturilor realizate de la data angaj\u0103rii p\u00e2n\u0103 \u00een luna anterioar\u0103 producerii evenimentului.<\/p>\n<p>Nu este necesar\u0103 completarea stagiului cu perioade lucrate la al\u021bi angajatori. Aceast\u0103 regul\u0103 diferen\u021biaz\u0103 clar acest tip de concediu medical de cel pentru boli obi\u0219nuite, unde existen\u021ba unui stagiu minim este obligatorie.<\/p>\n<h2>Cine pl\u0103te\u0219te \u0219i cum se recupereaz\u0103 sumele<\/h2>\n<p>\u00cen primele trei zile de incapacitate temporar\u0103 de munc\u0103, indemniza\u021bia este suportat\u0103 de angajator. \u00cencep\u00e2nd cu ziua a patra, costul este acoperit din bugetul asigur\u0103rilor sociale de stat, prin sistemul de asigurare pentru accidente de munc\u0103 \u0219i boli profesionale.<\/p>\n<p>\u00cen practic\u0103, angajatorul calculeaz\u0103 \u0219i achit\u0103 indemniza\u021bia c\u0103tre salariat, urm\u00e2nd s\u0103 recupereze sumele de la casa teritorial\u0103 de pensii competent\u0103, pe baza documentelor justificative. Recuperarea este posibil\u0103 dup\u0103 confirmarea oficial\u0103 a caracterului profesional al accidentului sau al bolii.<\/p>\n<p>Certificatul medical trebuie vizat obligatoriu, prin grija angajatorului, de direc\u021bia de s\u0103n\u0103tate public\u0103 \u0219i de casa teritorial\u0103 de pensii. Codurile specifice utilizate \u00een astfel de situa\u021bii reflect\u0103 natura profesional\u0103 a evenimentului.<\/p>\n<p>Exist\u0103 \u0219i situa\u021bii speciale \u2013 cum ar fi falimentul angajatorului sau \u00eencetarea raportului de munc\u0103 \u2013 \u00een care casa teritorial\u0103 de pensii preia plata indemniza\u021biei.<\/p>\n<h2>Problema confirm\u0103rii accidentului de munc\u0103<\/h2>\n<p>\u00cen practic\u0103, dificult\u0103\u021bile apar frecvent \u00een etapa de stabilire a caracterului profesional al evenimentului.<\/p>\n<p>Medicul care elibereaz\u0103 certificatul nu stabile\u0219te natura juridic\u0103 a accidentului. Ini\u021bial, situa\u021bia poate fi tratat\u0103 ca o incapacitate temporar\u0103 obi\u0219nuit\u0103, iar ulterior, dup\u0103 cercetarea evenimentului, s\u0103 fie confirmat accidentul de munc\u0103. \u00cen aceste cazuri, se procedeaz\u0103 la regularizarea sumelor.<\/p>\n<p>Aceast\u0103 etap\u0103 tranzitorie poate genera diferen\u021be temporare \u00een cuantumul indemniza\u021biei. \u00cen plus, dac\u0103 angajatorul nu \u00ee\u0219i \u00eendepline\u0219te obliga\u021bia de cercetare \u0219i declarare a accidentului, salariatul poate fi prejudiciat prin \u00eencasarea unei indemniza\u021bii mai mici dec\u00e2t cea legal datorat\u0103.<\/p>\n<h2>Durata concediului medical<\/h2>\n<p>Durata maxim\u0103 a concediului pentru incapacitate temporar\u0103 de munc\u0103 determinat\u0103 de accident de munc\u0103 sau boal\u0103 profesional\u0103 este, \u00een principiu, de 183 de zile \u00eentr-un interval de un an. \u00cen anumite situa\u021bii justificate medical, perioada poate fi prelungit\u0103 cu p\u00e2n\u0103 la 90 de zile, \u00een condi\u021biile prev\u0103zute de lege.<\/p>\n<h2>De ce este important\u0103 diferen\u021bierea corect\u0103<\/h2>\n<p>Concediul medical accidente de munc\u0103 presupune un regim juridic distinct \u0219i mai favorabil dec\u00e2t concediul medical pentru afec\u021biuni f\u0103r\u0103 leg\u0103tur\u0103 cu munca.
