O distinc\u021bie esen\u021bial\u0103 pentru validitatea deciziilor de concediere"},"content":{"rendered":"<p>\u00cen practica rela\u021biilor de munc\u0103, una dintre cele mai frecvente gre\u0219eli care ajung s\u0103 coste scump angajatorii este <strong>calificarea juridic\u0103 gre\u0219it\u0103 a situa\u021biei salariatului.<\/strong> \u00cen special, confuzia dintre <strong>necorespundere profesional\u0103<\/strong> \u0219i <strong>abatere disciplinar\u0103<\/strong> conduce, de multe ori, la anularea \u00een instan\u021b\u0103 a deciziilor de concediere, indiferent c\u00e2t de problematic\u0103 a fost, \u00een fapt, conduita angajatului.<\/p>\n<p>De\u0219i, la prima vedere, cele dou\u0103 pot p\u0103rea apropiate, mai ales atunci c\u00e2nd rezultatele muncii sunt slabe, ele au<strong> fundamente juridice diferite<\/strong>, presupun<strong> proceduri distincte<\/strong> \u0219i produc <strong>efecte legale diferite.<\/strong><\/p>\n<h2>Natura problemei: lips\u0103 de competen\u021b\u0103 sau \u00eenc\u0103lcare a regulilor<\/h2>\n<p>Nucleul diferen\u021bei porne\u0219te de la natura comportamentului salariatului.<br \/>\n<strong>Necorespunderea profesional\u0103<\/strong> se refer\u0103 la incapacitatea obiectiv\u0103 sau subiectiv\u0103 a angajatului de a-\u0219i \u00eendeplini atribu\u021biile la nivelul cerut de post, chiar \u0219i atunci c\u00e2nd exist\u0103 bun\u0103-credin\u021b\u0103. Vorbim despre situa\u021bii \u00een care salariatul nu reu\u0219e\u0219te s\u0103 ating\u0103 standardele de performan\u021b\u0103, nu st\u0103p\u00e2ne\u0219te competen\u021bele necesare sau nu face fa\u021b\u0103 cerin\u021belor func\u021biei, \u00een ciuda eforturilor depuse.<\/p>\n<p>\u00cen schimb, <strong>abaterea disciplinar\u0103<\/strong> presupune o conduit\u0103 culpabil\u0103: \u00eenc\u0103lcarea deliberat\u0103 sau din neglijen\u021b\u0103 a obliga\u021biilor asumate prin contractul individual de munc\u0103, fi\u0219a postului, regulamentul intern ori instruc\u021biunile superiorilor ierarhici. Salariatul nu este sanc\u021bionat pentru c\u0103 a \u00eenc\u0103lcat o regul\u0103, ci pentru c\u0103 nu reu\u0219e\u0219te s\u0103 performeze la nivelul cerut. Este o constatare a unei inadecv\u0103ri profesionale, nu o repro\u0219are moral\u0103 sau disciplinar\u0103.<\/p>\n<p>Abaterea disciplinar\u0103, \u00een schimb, este imposibil de conceput f\u0103r\u0103 vinov\u0103\u021bie. Chiar \u0219i neglijen\u021ba constituie o form\u0103 de culp\u0103, iar aceasta trebuie analizat\u0103 \u0219i dovedit\u0103 de angajator \u00een cadrul procedurii disciplinare.<\/p>\n<p>Instan\u021bele sunt extrem de atente la acest aspect: dac\u0103 din probe reiese c\u0103 problema real\u0103 a fost comportamental\u0103, nu profesional\u0103, o concediere pentru necorespundere va fi anulat\u0103.<\/p>\n<h2>Procedura prealabil\u0103: evaluare versus cercetare<\/h2>\n<p>Diferen\u021bele nu se opresc la nivel conceptual, ci se reflect\u0103 direct \u00een<strong> procedura obligatorie.<\/strong><\/p>\n<p>\u00cen cazul necorespunderii profesionale, concedierea nu poate fi dispus\u0103 f\u0103r\u0103 o <strong>evaluare prealabil\u0103 a competen\u021belor salariatului<\/strong>, realizat\u0103 conform unei proceduri clare, cunoscute \u0219i aplicate anterior. Aceast\u0103 procedur\u0103 trebuie s\u0103 existe \u00een regulamentul intern sau \u00een contractul colectiv de munc\u0103 \u0219i nu poate fi improvizat\u0103 \u201edin mers\u201d.<\/p>\n<p>Evaluarea trebuie s\u0103 vizeze strict aptitudinile profesionale \u0219i s\u0103 fie una real\u0103, nu formal\u0103.<\/p>\n<p>\u00cen cazul abaterii disciplinare, evaluarea nu este relevant\u0103. <a href=\"https:\/\/www.codulmuncii.ro\/art_61_1.html\" target=\"_blank\" rel=\"noopener\"><strong>Legea<\/strong><\/a> impune <strong>cercetarea disciplinar\u0103 prealabil\u0103<\/strong>, axat\u0103 pe fapta concret\u0103, pe \u00eemprejur\u0103rile s\u0103v\u00e2r\u0219irii acesteia \u0219i pe ap\u0103rarea salariatului.<\/p>\n<p>Aplicarea procedurii gre\u0219ite este una dintre cele mai frecvente cauze de anulare a deciziilor de concediere.<\/p>\n<h2>Obliga\u021bia de a oferi alternative salariatului<\/h2>\n<p>Un alt element care diferen\u021biaz\u0103 clar cele dou\u0103 situa\u021bii este <strong>obliga\u021bia angajatorului de a c\u0103uta solu\u021bii alternative.<\/strong><\/p>\n<p>Atunci c\u00e2nd se constat\u0103 necorespunderea profesional\u0103, angajatorul este obligat s\u0103 analizeze dac\u0103 exist\u0103 alte posturi vacante compatibile cu preg\u0103tirea salariatului \u0219i s\u0103 i le propun\u0103. \u00cen lipsa acestora, trebuie solicitat sprijinul agen\u021biei teritoriale de ocupare a for\u021bei de munc\u0103.<\/p>\n<p>Aceast\u0103 obliga\u021bie nu exist\u0103 \u00een cazul abaterii disciplinare. Dac\u0103 fapta este dovedit\u0103 \u0219i suficient de grav\u0103, concedierea poate fi dispus\u0103 direct, f\u0103r\u0103 a se c\u0103uta solu\u021bii de re\u00eencadrare.<\/p>\n<h2>Preavizul \u0219i efectele concedierii<\/h2>\n<p>Diferen\u021ba de tratament se vede \u0219i \u00een efectele finale ale m\u0103surii.<br \/>\nConcedierea pentru necorespundere profesional\u0103 presupune acordarea unui <strong>preaviz de<\/strong> <strong>minimum 20 de zile lucr\u0103toare<\/strong>, tocmai pentru c\u0103 nu este vorba despre o sanc\u021biune disciplinar\u0103.<\/p>\n<p>\u00cen cazul concedierii disciplinare, preavizul nu se acord\u0103. M\u0103sura produce efecte imediat, ceea ce reflect\u0103 gravitatea conduitei imputate salariatului.<\/p>\n<h2>C\u00e2nd rezultatele slabe ascund, de fapt, o abatere<\/h2>\n<p>\u00cen practic\u0103, cele mai delicate situa\u021bii sunt cele \u00een care angajatul <strong>\u0219tie s\u0103 \u00ee\u0219i fac\u0103 munca<\/strong>, dar nu o face conform cerin\u021belor. Dac\u0103, \u00een urma evalu\u0103rii, rezult\u0103 c\u0103 salariatul de\u021bine competen\u021bele necesare, dar refuz\u0103 s\u0103 le foloseasc\u0103, \u00eent\u00e2rzie nejustificat, ignor\u0103 procedurile sau trateaz\u0103 superficial sarcinile, nu mai vorbim despre necorespundere profesional\u0103, ci despre abatere disciplinar\u0103.<\/p>\n<p>Instan\u021bele privesc cu mult scepticism \u00eencerc\u0103rile de a \u201emasca\u201d problemele de disciplin\u0103 sub forma unei lipse de performan\u021b\u0103.<\/p>\n<h2>Concluzie<\/h2>\n<p><strong>Necorespunderea profesional\u0103<\/strong> \u0219i <strong>abaterea disciplinar\u0103<\/strong> nu sunt interschimbabile, iar linia dintre ele, de\u0219i uneori fin\u0103, este extrem de important\u0103 din punct de vedere juridic.
