{"id":9891,"date":"2026-01-18T16:12:34","date_gmt":"2026-01-18T14:12:34","guid":{"rendered":"https:\/\/www.lugera.ro\/blog\/?p=9891"},"modified":"2026-02-02T17:31:41","modified_gmt":"2026-02-02T15:31:41","slug":"sanctionare-disciplinara-in-lipsa-angajatului-cand-este-posibil-si-cand-devine-riscant","status":"publish","type":"post","link":"https:\/\/www.lugera.ro\/blog\/sanctionare-disciplinara-in-lipsa-angajatului-cand-este-posibil-si-cand-devine-riscant\/","title":{"rendered":"Sanc\u021bionare disciplinar\u0103 \u00een lipsa angajatului: c\u00e2nd este posibil \u0219i c\u00e2nd devine riscant"},"content":{"rendered":"<p>Unul dintre cele mai sensibile momente dintr-o procedur\u0103 disciplinar\u0103 este<strong> absen\u021ba angajatului de la cercetare.<\/strong><br \/>\nDe\u0219i <a href=\"https:\/\/www.codulmuncii.ro\/titlul_11\/capitolul_2_1.html\" target=\"_blank\" rel=\"noopener\"><strong>Codul muncii<\/strong><\/a> nu condi\u021bioneaz\u0103 sanc\u021bionarea de prezen\u021ba efectiv\u0103 a salariatului, <strong>modul \u00een care angajatorul gestioneaz\u0103 aceast\u0103 absen\u021b\u0103 poate face diferen\u021ba dintre o decizie valid\u0103 \u0219i una anulat\u0103 \u00een instan\u021b\u0103.<\/strong><\/p>\n<p>Pe scurt: <strong>sanc\u021bionarea \u00een lips\u0103 este posibil\u0103, dar nu \u00een orice condi\u021bii.<\/strong><\/p>\n<h2>De la ce plec\u0103m: cercetarea disciplinar\u0103 nu este op\u021bional\u0103<\/h2>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/02\/cercetare-disciplinara-scaled.jpg\"><img decoding=\"async\" class=\"aligncenter wp-image-9893 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/02\/cercetare-disciplinara-scaled.jpg\" alt=\"cercetare disciplinara\" width=\"750\" height=\"500\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/02\/cercetare-disciplinara-scaled.jpg 2560w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/02\/cercetare-disciplinara-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/02\/cercetare-disciplinara-1024x683.jpg 1024w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/02\/cercetare-disciplinara-768x512.jpg 768w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/02\/cercetare-disciplinara-1536x1024.jpg 1536w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/02\/cercetare-disciplinara-2048x1365.jpg 2048w\" data-sizes=\"(max-width: 750px) 100vw, 750px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 750px; --smush-placeholder-aspect-ratio: 750\/500;\" \/><\/a><\/p>\n<p>\u00cenainte de orice sanc\u021biune disciplinar\u0103 (cu excep\u021bia avertismentului scris), angajatorul are obliga\u021bia de a efectua<strong> cercetarea disciplinar\u0103 prealabil\u0103<\/strong>.<\/p>\n<p>Aceasta presupune:<\/p>\n<ul>\n<li>convocarea angajatului;<\/li>\n<li>prezentarea faptei imputate;<\/li>\n<li>oferirea posibilit\u0103\u021bii reale de ap\u0103rare.<\/li>\n<\/ul>\n<p>Dac\u0103 angajatul nu se prezint\u0103, \u00eentrebarea nu este \u201emai putem sanc\u021biona?\u201d, ci \u201eam respectat toate garan\u021biile procedurale?\u201d.<\/p>\n<h2>Primul pas critic: dovada convoc\u0103rii<\/h2>\n<p>\u00cenainte de a analiza absen\u021ba, angajatorul trebuie s\u0103 se asigure c\u0103<strong> exist\u0103 dovada cert\u0103 a convoc\u0103rii.<\/strong><\/p>\n<p>Convocarea trebuie:<\/p>\n<ul>\n<li>s\u0103 ajung\u0103 efectiv la angajat;<\/li>\n<li>s\u0103 con\u021bin\u0103 data, ora, locul \u0219i obiectul cercet\u0103rii;<\/li>\n<li>s\u0103 lase un termen rezonabil pentru preg\u0103tirea ap\u0103r\u0103rii.<\/li>\n<\/ul>\n<p>Dovezile solide includ:<\/p>\n<ul>\n<li>semn\u0103tur\u0103 de primire;<\/li>\n<li>confirmare de e-mail;<\/li>\n<li>proces-verbal de comunicare (inclusiv prin executor judec\u0103toresc).<\/li>\n<\/ul>\n<p>&#x1f449; F\u0103r\u0103 dovada comunic\u0103rii, procedura este vulnerabil\u0103, indiferent de motivul absen\u021bei.<\/p>\n<h2>Absen\u021ba justificat\u0103: c\u00e2nd cercetarea trebuie am\u00e2nat\u0103<\/h2>\n<p>Nu orice neprezentare permite continuarea procedurii. Exist\u0103 situa\u021bii \u00een care <strong>am\u00e2narea este obligatorie sau, cel pu\u021bin, prudent\u0103.<\/strong><\/p>\n<p><strong>1. Motive obiective, independente de voin\u021ba angajatului<\/strong><\/p>\n<p>De exemplu:<\/p>\n<ul>\n<li>probleme medicale;<\/li>\n<li>urgen\u021be familiale grave;<\/li>\n<li>condi\u021bii meteo extreme;<\/li>\n<li>alte situa\u021bii imprevizibile.<\/li>\n<\/ul>\n<p>\u00cen aceste cazuri, continuarea procedurii f\u0103r\u0103 reprogramare poate fi considerat\u0103<strong> lips\u0103 de bun\u0103-credin\u021b\u0103.<\/strong><\/p>\n<p><strong>2. Exercitarea dreptului la ap\u0103rare<\/strong><\/p>\n<p>Dac\u0103 angajatul solicit\u0103 am\u00e2narea pentru:<\/p>\n<ul>\n<li>a-\u0219i angaja un avocat;<\/li>\n<li>a consulta un expert;<\/li>\n<li>a-\u0219i preg\u0103ti ap\u0103rarea,<\/li>\n<\/ul>\n<p>iar termenul ini\u021bial de convocare a fost foarte scurt,<strong> refuzul angajatorului este riscant.<\/strong><\/p>\n<p>Instan\u021bele privesc dreptul la ap\u0103rare ca pe un element esen\u021bial al cercet\u0103rii disciplinare, chiar dac\u0103 legea nu impune un termen minim expres.<\/p>\n<p><strong>3. Concediul medical<\/strong><\/p>\n<p>Aici regula este clar\u0103:<\/p>\n<ul>\n<li>contractul individual de munc\u0103 este suspendat de drept;<\/li>\n<li>cercetarea disciplinar\u0103 se suspend\u0103;<\/li>\n<li>se suspend\u0103 inclusiv termenul \u00een care poate fi aplicat\u0103 sanc\u021biunea.<\/li>\n<\/ul>\n<p>&#x1f449; Orice continuare a procedurii \u00een aceast\u0103 perioad\u0103 este, \u00een practic\u0103, nelegal\u0103.<\/p>\n<h2>Absen\u021ba nejustificat\u0103: c\u00e2nd sanc\u021bionarea \u00een lips\u0103 este posibil\u0103<\/h2>\n<p>Dac\u0103 angajatul:<\/p>\n<ul>\n<li>a fost convocat legal;<\/li>\n<li>nu se prezint\u0103;<\/li>\n<li>nu comunic\u0103 niciun motiv obiectiv;<\/li>\n<\/ul>\n<p>angajatorul<strong> poate continua procedura.<\/strong><\/p>\n<p>\u00cen acest caz, pa\u0219ii corec\u021bi sunt esen\u021biali.<\/p>\n<h2>Cum se procedeaz\u0103 corect la sanc\u021bionarea \u00een lips\u0103<\/h2>\n<p><strong>1. Consemnarea absen\u021bei<\/strong><\/p>\n<p>Comisia de cercetare trebuie s\u0103 \u00eentocmeasc\u0103 un proces-verbal din care s\u0103 rezulte clar c\u0103:<\/p>\n<ul>\n<li>angajatul a fost convocat legal;<\/li>\n<li>nu s-a prezentat;<\/li>\n<li>nu a transmis nicio justificare.<\/li>\n<\/ul>\n<p><strong>2. Analiza pe baza probelor existente<\/strong><\/p>\n<p>Cercetarea se va face:<\/p>\n<ul>\n<li>exclusiv pe baza documentelor;<\/li>\n<li>a declara\u021biilor;<\/li>\n<li>a probelor aflate la dispozi\u021bia angajatorului.<\/li>\n<\/ul>\n<p><strong>3. Efectul neprezent\u0103rii<\/strong><\/p>\n<p>Prin absen\u021ba nejustificat\u0103, angajatul:<\/p>\n<ul>\n<li>renun\u021b\u0103 implicit la dreptul de a-\u0219i sus\u021bine punctul de vedere;<\/li>\n<li>nu va putea invoca ulterior, \u00een instan\u021b\u0103, c\u0103 \u201enu a fost ascultat\u201d.<\/li>\n<\/ul>\n<p>Instan\u021bele consider\u0103 c\u0103 <strong>dreptul la ap\u0103rare a fost oferit<\/strong>, chiar dac\u0103 nu a fost exercitat.<\/p>\n<h2>Gre\u0219eala frecvent\u0103 a angajatorilor<\/h2>\n<p>Cea mai mare eroare nu este sanc\u021bionarea \u00een lips\u0103, ci:<\/p>\n<ul>\n<li>ignorarea motivelor invocate de angajat;<\/li>\n<li>respingerea automat\u0103 a cererilor de am\u00e2nare;<\/li>\n<li>graba de a \u201e\u00eenchide\u201d procedura.<\/li>\n<\/ul>\n<p>\u00cen practic\u0103,<strong> o am\u00e2nare de c\u00e2teva zile este mult mai sigur\u0103 dec\u00e2t un proces pierdut.<\/strong><\/p>\n<h2>Ce ar trebui s\u0103 re\u021bin\u0103 angajatorii<\/h2>\n<p>\u00cen<strong> sanc\u021bionarea disciplinar\u0103<\/strong>, forma conteaz\u0103 la fel de mult ca fondul.<\/p>\n<p>&#x2714; Po\u021bi sanc\u021biona \u00een lipsa angajatului<br \/>\n&#x2716; Dar numai dac\u0103 absen\u021ba este nejustificat\u0103<br \/>\n&#x2716; \u0218i doar dac\u0103 dreptul la ap\u0103rare a fost real, nu formal<\/p>\n<p>Orice abatere de la aceste principii poate duce la:<\/p>\n<ul>\n<li>anularea sanc\u021biunii;<\/li>\n<li>plata de desp\u0103gubiri;<\/li>\n<li>reintegrarea salariatului.<\/li>\n<\/ul>\n<h2>Concluzie<\/h2>\n<p><strong>Sanc\u021bionarea disciplinar\u0103 \u00een lipsa angajatului este permis\u0103<\/strong>, dar nu este o solu\u021bie \u201eautomat\u0103\u201d.<\/p>\n<p>Totul depinde de:<\/p>\n<ul>\n<li>motivul absen\u021bei;<\/li>\n<li>corectitudinea convoc\u0103rii;<\/li>\n<li>respectarea dreptului la ap\u0103rare.<\/li>\n<\/ul>\n<p>&#x1f449; Pentru angajatori, cheia este documentarea \u0219i r\u0103bdarea procedural\u0103.<br \/>\n&#x1f449; Pentru HR \u0219i <a href=\"https:\/\/www.lugera.ro\/servicii\/payroll-si-administrare-personal\/\" target=\"_blank\" rel=\"noopener\"><strong>payroll<\/strong><\/a>, o procedur\u0103 disciplinar\u0103 bine gestionat\u0103 \u00eenseamn\u0103 mai pu\u021bine litigii \u0219i mai mult\u0103 predictibilitate.<\/p>\n<p>&nbsp;<\/p>\n<p>Sursa foto: shutterstock.com<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Unul dintre cele mai sensibile momente dintr-o procedur\u0103 disciplinar\u0103 este absen\u021ba angajatului de la cercetare.
