--smush-placeholder-aspect-ratio: 750\/501;\" \/><\/a><\/p>\n<p><a href=\"https:\/\/www.codulmuncii.ro\/titlul_3\/capitolul_3\/sectiunea_1\/art_152.2_1.html\" target=\"_blank\" rel=\"noopener\"><strong>Codul muncii<\/strong><\/a> prevede c\u0103 salaria\u021bii pot absenta <strong>p\u00e2n\u0103 la 10 zile lucr\u0103toare pe an<\/strong> pentru:<\/p>\n<ul>\n<li>situa\u021bii de urgen\u021b\u0103 familial\u0103;<\/li>\n<li>cauzate de boal\u0103 sau accident;<\/li>\n<li>care fac indispensabil\u0103 prezen\u021ba imediat\u0103 a salariatului.<\/li>\n<\/ul>\n<p>Aceste zile:<\/p>\n<ul>\n<li>sunt <strong>pl\u0103tite<\/strong>;<\/li>\n<li>nu duc la suspendarea CIM;<\/li>\n<li>nu reprezint\u0103 concediu de odihn\u0103;<\/li>\n<li>trebuie<strong> recuperate ulterior.<\/strong><\/li>\n<\/ul>\n<h2>Absen\u021bele sunt pl\u0103tite, dar nu sunt \u201elibere definitive\u201d<\/h2>\n<p>Un aspect esen\u021bial, adesea trecut cu vederea, este c\u0103 <strong>plata acestor zile nu \u00eenseamn\u0103 c\u0103 ele sunt \u201ecadou\u201d.<\/strong><\/p>\n<p>Concret:<\/p>\n<ul>\n<li>zilele de absen\u021b\u0103 sunt remunerate similar concediului de odihn\u0103;<\/li>\n<li>\u00eens\u0103 salariatul are obliga\u021bia de a recupera timpul nelucrat;<\/li>\n<li>recuperarea se face<strong> f\u0103r\u0103 plat\u0103 suplimentar\u0103.<\/strong><\/li>\n<\/ul>\n<p>Motivul este simplu: salariatul a fost deja pl\u0103tit pentru acea perioad\u0103.<\/p>\n<h2>Cum se recupereaz\u0103 zilele de absen\u021b\u0103<\/h2>\n<p>Recuperarea se face:<\/p>\n<ul>\n<li>pe baza<strong> acordului dintre salariat \u0219i angajator;<\/strong><\/li>\n<li>\u00eentr-o lun\u0103 ulterioar\u0103 celei \u00een care a avut loc absen\u021ba;<\/li>\n<li>prin prestarea de ore de munc\u0103 suplimentare <strong>care nu sunt considerate ore suplimentare \u00een sens legal.<\/strong><\/li>\n<\/ul>\n<p>&#x26a0;&#xfe0f; Important:<br \/>\nRecuperarea acestor absen\u021be<strong> nu intr\u0103 sub regimul muncii suplimentare<\/strong> \u0219i nu atrage spor sau timp liber compensatoriu.<\/p>\n<h2>Absen\u021bele nu suspend\u0103 contractul de munc\u0103<\/h2>\n<p>Un alt element-cheie:<br \/>\n<strong>contractul individual de munc\u0103 NU se suspend\u0103 pe durata acestor absen\u021be.<\/strong><\/p>\n<p>Consecin\u021bele sunt importante:<\/p>\n<ul>\n<li>vechimea \u00een munc\u0103 nu este afectat\u0103;<\/li>\n<li>drepturile salariale se acord\u0103 normal;<\/li>\n<li>pontajul trebuie s\u0103 reflecte clar tipul absen\u021bei.<\/li>\n<\/ul>\n<h2>Obliga\u021biile salariatului<\/h2>\n<p>Pentru a beneficia de aceste absen\u021be, salariatul are c\u00e2teva obliga\u021bii minime:<\/p>\n<ul>\n<li>s\u0103 informeze angajatorul,<strong> de preferin\u021b\u0103 \u00een scris;<\/strong><\/li>\n<li>informarea trebuie f\u0103cut\u0103, pe c\u00e2t posibil, anterior absen\u021bei;<\/li>\n<li>s\u0103 respecte ulterior modalitatea de recuperare stabilit\u0103.<\/li>\n<\/ul>\n<p>Spre deosebire de alte tipuri de concedii, <strong>nu este necesar\u0103 prezentarea unor documente justificative.<\/strong><\/p>\n<h2>Ce NU sunt aceste absen\u021be<\/h2>\n<p>Este important ca angajatorii s\u0103 nu confunde aceste zile cu alte drepturi:<br \/>\n&#x274c;<strong> nu sunt<\/strong> concedii pentru evenimente familiale deosebite (c\u0103s\u0103torie, deces etc.);<br \/>\n&#x274c;<strong> nu sunt<\/strong> concedii f\u0103r\u0103 plat\u0103;<br \/>\n&#x274c; <strong>nu sunt<\/strong> concedii medicale;<br \/>\n&#x274c;<strong> nu sunt<\/strong> concedii de \u00eengrijitor.<\/p>\n<p>Fiecare dintre aceste situa\u021bii are un regim juridic distinct.<\/p>\n<h2>Pontajul \u0219i eviden\u021ba corect\u0103 a absen\u021belor<\/h2>\n<p>\u00cen practic\u0103, una dintre cele mai mari probleme apare la nivel de pontaj.<\/p>\n<p>Pentru a evita riscuri:<\/p>\n<ul>\n<li>absen\u021bele trebuie eviden\u021biate distinct;<\/li>\n<li>motivul absen\u021bei trebuie men\u021bionat clar;<\/li>\n<li>recuperarea trebuie urm\u0103rit\u0103 separat de orele suplimentare.<\/li>\n<\/ul>\n<p>Recomandarea este ca angajatorii s\u0103 stabileasc\u0103, prin:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.lugera.ro\/blog\/regulament-intern-munca\/\" target=\"_blank\" rel=\"noopener\"><strong>regulament intern<\/strong><\/a> sau<\/li>\n<li>procedur\u0103 intern\u0103,<\/li>\n<\/ul>\n<p>reguli clare privind:<\/p>\n<ul>\n<li>solicitarea absen\u021belor;<\/li>\n<li>eviden\u021ba lor;<\/li>\n<li>recuperarea timpului nelucrat;<\/li>\n<li>prevenirea abuzurilor.<\/li>\n<\/ul>\n<h2>Plata salariului: c\u00e2nd se face<\/h2>\n<p>Un aspect clarificat inclusiv de autorit\u0103\u021bi este urm\u0103torul:<\/p>\n<ul>\n<li>salariul aferent zilelor de absen\u021b\u0103 se pl\u0103te\u0219te \u00een<strong> luna \u00een care absen\u021bele au fost efectuate;<\/strong><\/li>\n<li>nu se am\u00e2n\u0103 plata p\u00e2n\u0103 la luna recuper\u0103rii.<\/li>\n<\/ul>\n<p>Recuperarea este o obliga\u021bie de timp, nu una financiar\u0103.<\/p>\n<h2>Absen\u021bele \u0219i orele suplimentare: dou\u0103 lucruri diferite<\/h2>\n<p>Este esen\u021bial de re\u021binut:<\/p>\n<ul>\n<li>recuperarea absen\u021belor \u2260 compensarea muncii suplimentare;<\/li>\n<li>orele suplimentare se compenseaz\u0103 cu timp liber sau spor;<\/li>\n<li>absen\u021bele pl\u0103tite se recupereaz\u0103 f\u0103r\u0103 niciuna dintre aceste compensa\u021bii.<\/li>\n<\/ul>\n<p>Amestecarea celor dou\u0103 regimuri poate genera erori de salarizare \u0219i conflicte de munc\u0103.<\/p>\n<h2>Concluzie<\/h2>\n<p>\u00cen 2026, <strong>absen\u021bele pentru situa\u021bii neprev\u0103zute<\/strong> r\u0103m\u00e2n un instrument legal important de echilibru \u00eentre via\u021ba profesional\u0103 \u0219i cea personal\u0103.<\/p>\n<p>Ele ofer\u0103 flexibilitate angaja\u021bilor, dar presupun o responsabilitate clar\u0103 de recuperare.<br \/>\n&#x1f449;
