{"id":9883,"date":"2026-01-15T15:24:16","date_gmt":"2026-01-15T13:24:16","guid":{"rendered":"https:\/\/www.lugera.ro\/blog\/?p=9883"},"modified":"2026-02-02T17:31:09","modified_gmt":"2026-02-02T15:31:09","slug":"ce-prevederi-minime-trebuie-sa-se-regaseasca-in-regulamentul-intern-in-2026","status":"publish","type":"post","link":"https:\/\/www.lugera.ro\/blog\/ce-prevederi-minime-trebuie-sa-se-regaseasca-in-regulamentul-intern-in-2026\/","title":{"rendered":"Ce prevederi minime trebuie s\u0103 se reg\u0103seasc\u0103 \u00een regulamentul intern \u00een 2026"},"content":{"rendered":"<p>Un regulament intern (RI) este cel mai important document din rela\u021bia de munc\u0103, de\u0219i, \u00een practic\u0103, este adesea tratat ca o simpl\u0103 formalitate.<br \/>\n\u00cen realitate, RI este <strong>documentul care stabile\u0219te regulile jocului<\/strong> la nivel intern: ce este permis, ce este interzis, cum se sanc\u021bioneaz\u0103 abaterile \u0219i cum sunt protejate drepturile salaria\u021bilor.<\/p>\n<p>\u00cen 2026, importan\u021ba regulamentului intern cre\u0219te, pe fondul:<\/p>\n<ul>\n<li>intensific\u0103rii controalelor ITM;<\/li>\n<li>extinderii muncii la distan\u021b\u0103;<\/li>\n<li>cre\u0219terii litigiilor de munc\u0103 bazate pe lipsa unor reguli clare.<\/li>\n<\/ul>\n<h2>Cine \u00eentocme\u0219te un regulament intern \u0219i c\u00e2nd<\/h2>\n<p>&nbsp;<\/p>\n<p>Regulamentul intern este elaborat<strong> exclusiv de angajator<\/strong>, cu respectarea unei etape obligatorii de consultare:<\/p>\n<ul>\n<li>cu sindicatul reprezentativ sau<\/li>\n<li>cu reprezentan\u021bii salaria\u021bilor, dac\u0103 nu exist\u0103 sindicat.<\/li>\n<\/ul>\n<p>Termenul legal pentru \u00eentocmire este de<strong> maximum 60 de zile de la \u00eenmatricularea angajatorului<\/strong> la Registrul Comer\u021bului.<br \/>\nDe\u0219i consultarea este obligatorie, decizia final\u0103 apar\u021bine angajatorului. Securitate \u0219i s\u0103n\u0103tate \u00een munc\u0103<\/strong><\/p>\n<p>RI trebuie s\u0103 con\u021bin\u0103 reguli clare privind:<\/p>\n<ul>\n<li>protec\u021bia salaria\u021bilor;<\/li>\n<li>igiena muncii;<\/li>\n<li>securitatea \u0219i prevenirea riscurilor profesionale.<\/li>\n<\/ul>\n<p><strong>2. Nediscriminare \u0219i respectarea demnit\u0103\u021bii<\/strong><\/p>\n<p>Este obligatorie includerea unor reguli explicite privind:<\/p>\n<ul>\n<li>respectarea principiului nediscrimin\u0103rii;<\/li>\n<li>prevenirea \u0219i sanc\u021bionarea h\u0103r\u021buirii;<\/li>\n<li>protejarea demnit\u0103\u021bii la locul de munc\u0103.<\/li>\n<\/ul>\n<p><strong>3. Drepturile \u0219i obliga\u021biile p\u0103r\u021bilor<\/strong><\/p>\n<p>RI trebuie s\u0103 detalieze:<\/p>\n<ul>\n<li>obliga\u021biile angajatorului;<\/li>\n<li>obliga\u021biile salaria\u021bilor;<\/li>\n<li>limitele exercit\u0103rii drepturilor de ambele p\u0103r\u021bi.<\/li>\n<\/ul>\n<p><strong>4. Procedura de solu\u021bionare amiabil\u0103 a conflictelor<\/strong><\/p>\n<p>Regulamentul trebuie s\u0103 prevad\u0103:<\/p>\n<ul>\n<li>pa\u0219ii pentru formularea sesiz\u0103rilor;<\/li>\n<li>modul de solu\u021bionare a reclama\u021biilor individuale;<\/li>\n<li>mecanismele interne de dialog \u00eenainte de escaladarea conflictului.<\/li>\n<\/ul>\n<p><strong>5. Disciplina muncii<\/strong><\/p>\n<p>Este una dintre cele mai importante sec\u021biuni \u0219i trebuie s\u0103 includ\u0103:<\/p>\n<ul>\n<li>reguli concrete de conduit\u0103;<\/li>\n<li>a\u0219tept\u0103rile angajatorului privind comportamentul profesional.<\/li>\n<\/ul>\n<p><strong>6. Abateri disciplinare \u0219i sanc\u021biuni<\/strong><\/p>\n<p>RI trebuie s\u0103 defineasc\u0103:<\/p>\n<ul>\n<li>ce constituie abatere disciplinar\u0103;<\/li>\n<li>ce sanc\u021biuni pot fi aplicate;<\/li>\n<li>propor\u021bionalitatea acestora.<\/li>\n<\/ul>\n<p><strong>7. Procedura disciplinar\u0103<\/strong><\/p>\n<p>F\u0103r\u0103 o procedur\u0103 disciplinar\u0103 clar descris\u0103 \u00een RI:<\/p>\n<ul>\n<li>sanc\u021biunile pot fi anulate;<\/li>\n<li>deciziile angajatorului pot fi contestate cu succes \u00een instan\u021b\u0103.<\/li>\n<\/ul>\n<p><strong>8. Alte dispozi\u021bii legale sau contractuale aplicabile<\/strong><\/p>\n<p>Aici pot fi incluse:<\/p>\n<ul>\n<li>reguli specifice activit\u0103\u021bii;<\/li>\n<li>particularit\u0103\u021bi opera\u021bionale;<\/li>\n<li>obliga\u021bii suplimentare impuse de lege sau contracte.<\/li>\n<\/ul>\n<p><strong>9. Evaluarea profesional\u0103<\/strong><\/p>\n<p>Regulamentul intern trebuie s\u0103 prevad\u0103:<\/p>\n<ul>\n<li>criteriile de evaluare;<\/li>\n<li>procedura de evaluare;<\/li>\n<li>periodicitatea acesteia.<\/li>\n<\/ul>\n<p><strong>10. Reguli privind preavizul<\/strong><\/p>\n<p>RI trebuie s\u0103 precizeze:<\/p>\n<ul>\n<li>durata preavizului;<\/li>\n<li>situa\u021biile \u00een care se acord\u0103;<\/li>\n<li>modul de calcul.<\/li>\n<\/ul>\n<p><strong>11. Politica de formare profesional\u0103<\/strong><\/p>\n<p>Dac\u0103 exist\u0103 o politic\u0103 de formare, aceasta trebuie men\u021bionat\u0103:<\/p>\n<ul>\n<li>obiectivele;<\/li>\n<li>categoriile de salaria\u021bi vizate;<\/li>\n<li>formele de preg\u0103tire.<\/li>\n<\/ul>\n<h2>Prevederi suplimentare frecvent omise, dar esen\u021biale<\/h2>\n<p>\u00cen lipsa unui contract colectiv de munc\u0103, regulamentul intern devine documentul-cheie pentru stabilirea unor aspecte practice precum:<\/p>\n<ul>\n<li>programul de lucru inegal;<\/li>\n<li>programul de lucru comprimat;<\/li>\n<li>regulile de acordare a repausului s\u0103pt\u0103m\u00e2nal.<\/li>\n<\/ul>\n<p>Pentru <a href=\"https:\/\/www.lugera.ro\/blog\/ce-este-si-ce-nu-este-telemunca\/\" target=\"_blank\" rel=\"noopener\"><strong>telesalaria\u021bi<\/strong><\/a>, RI trebuie s\u0103 includ\u0103 explicit:<\/p>\n<ul>\n<li>drepturi \u0219i obliga\u021bii specifice;<\/li>\n<li>reguli de SSM adaptate muncii la distan\u021b\u0103;<\/li>\n<li>evaluarea performan\u021bei;<\/li>\n<li>confiden\u021bialitatea \u0219i protec\u021bia datelor.<\/li>\n<\/ul>\n<p>De asemenea, RI trebuie s\u0103 con\u021bin\u0103 informa\u021bii despre:<\/p>\n<ul>\n<li>zilele libere pentru evenimente familiale;<\/li>\n<li>durata concediului f\u0103r\u0103 plat\u0103;<\/li>\n<li>valoarea tichetelor de mas\u0103 \u0219i a beneficiilor extrasalariale;<\/li>\n<li>data pl\u0103\u021bii salariului.<\/li>\n<\/ul>\n<h2>Ce se \u00eent\u00e2mpl\u0103 c\u00e2nd regulamentul intern se modific\u0103<\/h2>\n<p>Orice modificare a RI presupune:<\/p>\n<ul>\n<li>reluarea procedurii de consultare;<\/li>\n<li>informarea salaria\u021bilor;<\/li>\n<li>dovada comunic\u0103rii noilor prevederi.<\/li>\n<\/ul>\n<p>Acordul salaria\u021bilor<strong> nu este necesar<\/strong>, dar lipsa consult\u0103rii poate duce la:<\/p>\n<ul>\n<li>sanc\u021biuni contraven\u021bionale;<\/li>\n<li>anularea aplic\u0103rii unor reguli.<\/li>\n<\/ul>\n<h2>Concluzie<\/h2>\n<p>\u00cen 2026, regulamentul intern nu mai este doar un document \u201ede sertar\u201d, ci o <strong>pies\u0103 central\u0103 de conformare legal\u0103 \u0219i preven\u021bie a litigiilor.<\/strong><br \/>\nUn RI incomplet, neactualizat sau necomunicat corect poate deveni rapid o vulnerabilitate major\u0103 pentru angajator.<br \/>\n&#x1f449; Pentru angajatori, revizuirea periodic\u0103 a regulamentului intern este o investi\u021bie \u00een stabilitate.<br \/>\n&#x1f449;
