--smush-placeholder-aspect-ratio: 750\/500;\" \/><\/a><\/p>\n<p>P\u00e2n\u0103 recent, mul\u021bi angajatori care nu \u00eendeplineau cota legal\u0103 de 4% persoane cu dizabilit\u0103\u021bi optau direct pentru plata contribu\u021biei la fondul de handicap.<br \/>\nDin 2025, aceast\u0103 abordare<strong> nu mai este suficient\u0103.<\/strong><\/p>\n<p><a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/293935\" target=\"_blank\" rel=\"noopener\"><strong>Legisla\u021bia<\/strong> <\/a>impune acum:<\/p>\n<ul>\n<li>dovada unor <strong>demersuri reale de recrutare;<\/strong><\/li>\n<li>raport\u0103ri anuale c\u0103tre autorit\u0103\u021bi;<\/li>\n<li>documentarea contact\u0103rii unor ONG-uri specializate.<\/li>\n<\/ul>\n<p>Cu alte cuvinte,<strong> plata contribu\u021biei nu mai poate fi o scurt\u0103tur\u0103<\/strong> f\u0103r\u0103 \u00eencerc\u0103ri concrete de angajare.<\/p>\n<h2>Cine are obliga\u021bia de raportare<\/h2>\n<p>Obliga\u021bia revine:<\/p>\n<ul>\n<li>tuturor autorit\u0103\u021bilor \u0219i institu\u021biilor publice;<\/li>\n<li>tuturor persoanelor juridice, publice sau private;<\/li>\n<li>care au <strong>minimum 50 de salaria\u021bi.<\/strong><\/li>\n<\/ul>\n<p>Ace\u0219tia sunt angajatorii c\u0103rora legea le impune:<\/p>\n<ul>\n<li>fie angajare persoane cu handicap \u00een propor\u021bie de cel pu\u021bin 4%;<\/li>\n<li>fie, \u00een lipsa \u00eendeplinirii cotei, respectarea procedurii alternative prev\u0103zute de lege.<\/li>\n<\/ul>\n<h2>Ce trebuie raportat p\u00e2n\u0103 la 31 ianuarie<\/h2>\n<p>Raportarea este <strong>anual\u0103<\/strong> \u0219i vizeaz\u0103 \u00eentotdeauna <strong>anul calendaristic anterior.<\/strong><br \/>\nEa se transmite c\u0103tre <strong>Autoritatea Na\u021bional\u0103 pentru Protec\u021bia Drepturilor Persoanelor cu Dizabilit\u0103\u021bi<\/strong> \u0219i <strong>Agen\u021bia Na\u021bional\u0103 pentru Ocuparea For\u021bei de Munc\u0103<\/strong>, folosind modelul oficial prev\u0103zut de ordinul comun aplicabil.<\/p>\n<p>Raportarea trebuie s\u0103 includ\u0103 <strong>dou\u0103 elemente esen\u021biale:<\/strong><\/p>\n<ol>\n<li><strong>Situa\u021bia centralizat\u0103 a func\u021biilor ocupate<\/strong> de persoanele cu dizabilit\u0103\u021bi angajate;<\/li>\n<li><strong>Inventarul competen\u021belor solicitate<\/strong> la angajare pentru aceste func\u021bii.<\/li>\n<\/ol>\n<p>&#x26a0;&#xfe0f; Important:<br \/>\n<strong>Raportarea este obligatorie chiar \u0219i dac\u0103 angajatorul NU are persoane cu handicap angajate.<\/strong><\/p>\n<h2>Ce se \u00eent\u00e2mpl\u0103 dac\u0103 nu este atins\u0103 cota de 4%<\/h2>\n<p>Dac\u0103, \u00een urma analizei interne, angajatorul constat\u0103 c\u0103 nu \u00eendepline\u0219te cota legal\u0103 de 4%, intervine o obliga\u021bie suplimentar\u0103.<\/p>\n<p>\u00cen termen de<strong> 10 zile lucr\u0103toare,<\/strong> compania trebuie s\u0103:<\/p>\n<ul>\n<li>contacteze<strong> cel pu\u021bin trei ONG-uri specializate;<\/strong><\/li>\n<li>solicite sprijin pentru identificarea unor candida\u021bi potrivi\u021bi.<\/li>\n<\/ul>\n<p><strong>Condi\u021bii pentru ONG-urile contactate<\/strong><\/p>\n<p>ONG-urile trebuie:<\/p>\n<ul>\n<li>s\u0103 fie \u00eenregistrate \u00een Registrul Na\u021bional ONG;<\/li>\n<li>s\u0103 fie active (neradiate);<\/li>\n<li>s\u0103 aib\u0103 ca obiect de activitate servicii pentru persoane cu dizabilit\u0103\u021bi;<\/li>\n<li>s\u0103 aib\u0103 sediul sau activitatea \u00een zona angajatorului.<\/li>\n<\/ul>\n<p>Angajatorul trebuie s\u0103 p\u0103streze \u0219i s\u0103 transmit\u0103:<\/p>\n<ul>\n<li>cererile scrise adresate ONG-urilor;<\/li>\n<li>dovada transmiterii acestora.<\/li>\n<\/ul>\n<h2>De ce a introdus legea aceast\u0103 obliga\u021bie<\/h2>\n<p>Ra\u021biunea noilor reguli este clar\u0103:<br \/>\nstatul dore\u0219te s\u0103 se asigure c\u0103<strong> angajarea persoanelor cu handicap este tratat\u0103 ca un obiectiv real<\/strong>, nu doar ca o obliga\u021bie financiar\u0103.<\/p>\n<p>Prin aceste m\u0103suri:<\/p>\n<ul>\n<li>angajatorii sunt for\u021ba\u021bi s\u0103 \u00ee\u0219i analizeze organigrama \u0219i competen\u021bele cerute;<\/li>\n<li>ONG-urile devin intermediari institu\u021bionali;<\/li>\n<li>autorit\u0103\u021bile pot evalua, \u00een timp, eficien\u021ba politicilor de incluziune.<\/li>\n<\/ul>\n<p>\u00cen practic\u0103, \u00eens\u0103, exist\u0103 \u0219i critici, mai ales din partea ONG-urilor mici, care reclam\u0103:<\/p>\n<ul>\n<li>cre\u0219terea volumului de solicit\u0103ri administrative;<\/li>\n<li>lipsa resurselor pentru a r\u0103spunde tuturor cererilor venite simultan.<\/li>\n<\/ul>\n<h2>Ce ar trebui s\u0103 fac\u0103 angajatorii, concret<\/h2>\n<p>Pentru a evita riscuri \u0219i blocaje administrative, angajatorii viza\u021bi ar trebui s\u0103:<\/p>\n<ul>\n<li>verifice anual \u00eendeplinirea cotei de 4%;<\/li>\n<li>preg\u0103teasc\u0103 din timp raportarea pentru 31 ianuarie;<\/li>\n<li>identifice ONG-uri eligibile din aria lor teritorial\u0103;<\/li>\n<li>documenteze toate demersurile f\u0103cute;<\/li>\n<li>trateze angajarea persoanelor cu handicap ca parte a strategiei de HR, nu ca o obliga\u021bie formal\u0103.<\/li>\n<\/ul>\n<h2>Concluzie<\/h2>\n<p><strong>Angajarea persoanelor cu handicap<\/strong> intr\u0103, din 2025, \u00eentr-o nou\u0103 etap\u0103: una a responsabilit\u0103\u021bii demonstrate, nu doar declarate.<br \/>\nTermenul de<strong> 31 ianuarie<\/strong> nu este doar o formalitate birocratic\u0103, ci un test anual al modului \u00een care angajatorii \u00een\u021beleg incluziunea pe pia\u021ba muncii.<br \/>\n&#x1f449;
