Contractul de munc\u0103 con\u021binea o clauz\u0103 expres\u0103 de alegere a legii aplicabile \u2013 legea luxemburghez\u0103.<br \/>\n\u00cen practic\u0103 \u00eens\u0103, situa\u021bia a evoluat diferit:<\/p>\n<ul>\n<li>activitatea presupunea deplas\u0103ri \u00een mai multe state membre;<\/li>\n<li>\u00een timp, munca a \u00eenceput s\u0103 fie prestat\u0103 preponderent \u00een Fran\u021ba;<\/li>\n<li>\u00een ultimele 18 luni \u00eenainte de concediere, activitatea s-a desf\u0103\u0219urat aproape exclusiv \u0219i stabil pe teritoriul Fran\u021bei;<\/li>\n<li>inclusiv angajatorul a considerat c\u0103 salariatul trebuie afiliat la sistemul francez de securitate social\u0103.<\/li>\n<\/ul>\n<h2>Conflictul de munc\u0103 \u0219i traseul procesual<\/h2>\n<p>Rela\u021bia de munc\u0103 s-a tensionat dup\u0103 ce:<\/p>\n<ul>\n<li>angajatorul a propus reducerea timpului de lucru;<\/li>\n<li>salariatul a refuzat modificarea;<\/li>\n<li>contractul de munc\u0103 a fost \u00eencetat unilateral.<\/li>\n<\/ul>\n<p>Salariatul a contestat concedierea \u00een fa\u021ba instan\u021belor franceze, sus\u021bin\u00e2nd c\u0103:<\/p>\n<ul>\n<li>dreptul francez al muncii este aplicabil;<\/li>\n<li>locul obi\u0219nuit \u0219i efectiv al muncii devenise Fran\u021ba.<\/li>\n<\/ul>\n<p>Instan\u021bele na\u021bionale au avut opinii diferite:<\/p>\n<ul>\n<li>prima instan\u021b\u0103 a aplicat legea luxemburghez\u0103;<\/li>\n<li>instan\u021ba de apel a apreciat c\u0103 legea francez\u0103 este aplicabil\u0103, \u00eentruc\u00e2t centrul activit\u0103\u021bii se mutase \u00een Fran\u021ba.<\/li>\n<\/ul>\n<h2>\u00centrebarea adresat\u0103 CJUE<\/h2>\n<p>\u00cen recurs, Curtea de Casa\u021bie din Fran\u021ba a cerut CJUE s\u0103 clarifice un punct-cheie:<\/p>\n<p><strong>Legea aplicabil\u0103 raportului de munc\u0103 trebuie analizat\u0103 raportat la \u00eentreaga durat\u0103 a contractului sau la perioada recent\u0103, \u00een care activitatea s-a desf\u0103\u0219urat stabil \u00eentr-un anumit stat?<\/strong><\/p>\n<p>Aceast\u0103 \u00eentrebare este esen\u021bial\u0103 pentru situa\u021biile \u00een care lucr\u0103torii mobili ajung, \u00een fapt, s\u0103 \u00ee\u0219i concentreze activitatea \u00eentr-un alt stat dec\u00e2t cel prev\u0103zut ini\u021bial \u00een contract.<\/p>\n<h2>R\u0103spunsul CJUE: conteaz\u0103 locul real \u0219i actual al muncii<\/h2>\n<p>CJUE a stabilit un principiu clar:<\/p>\n<ul>\n<li>dac\u0103 locul obi\u0219nuit al muncii se modific\u0103 \u00een fapt;<\/li>\n<li>iar salariatul ajunge s\u0103 \u00ee\u0219i desf\u0103\u0219oare activitatea constant \u0219i stabil \u00eentr-un alt stat;<\/li>\n<li>atunci instan\u021ba trebuie s\u0103 \u021bin\u0103 cont de acest nou loc, la momentul solu\u021bion\u0103rii litigiului privind \u00eencetarea contractului de munc\u0103.<\/li>\n<\/ul>\n<p>Cu alte cuvinte, legea aplicabil\u0103 nu r\u0103m\u00e2ne \u201e\u00eenghe\u021bat\u0103\u201d la momentul semn\u0103rii contractului, dac\u0103 realitatea raportului de munc\u0103 s-a schimbat semnificativ.<\/p>\n<h2>Criteriul \u201eleg\u0103turilor mai str\u00e2nse\u201d \u2013 esen\u021bial \u00een analiza CJUE<\/h2>\n<p>CJUE a reamintit regulile europene aplicabile:<\/p>\n<ul>\n<li>\u00een lipsa unui loc obi\u0219nuit unic al muncii, se poate lua \u00een considerare sediul angajatorului;<\/li>\n<li>\u00eens\u0103 acest criteriu nu este automat;<\/li>\n<li>instan\u021ba trebuie s\u0103 analizeze dac\u0103 raportul de munc\u0103 are leg\u0103turi mai str\u00e2nse cu un francez de securitate social\u0103;<\/li>\n<li>pot indica o leg\u0103tur\u0103 mai puternic\u0103 cu Fran\u021ba dec\u00e2t cu Luxemburg.<\/li>\n<\/ul>\n<h2>Ce NU a decis CJUE<\/h2>\n<p>Este important CJUE a decis direct ce lege se aplic\u0103 \u00een cauz\u0103?<\/strong><br \/>\nNu.<br \/>\nCJUE nu stabile\u0219te legea aplicabil\u0103 \u00een mod concret, ci ofer\u0103 instan\u021belor na\u021bionale criteriile de analiz\u0103.
