Practica este frecvent\u0103 mai ales \u00een perioada dintre Cr\u0103ciun \u0219i Anul Nou. \u00cens\u0103 <strong>este legal ca angajatorul s\u0103 impun\u0103 concediu de odihn\u0103 f\u0103r\u0103 acordul salariatului<\/strong>?<\/p>\n<p>R\u0103spunsul, potrivit Codului muncii, este <strong>nu, dac\u0103 nu exist\u0103 o consultare real\u0103 cu reprezentan\u021bii angaja\u021bilor<\/strong>. Dreptul la concediu de odihn\u0103 este un <strong>drept fundamental<\/strong>, protejat prin lege \u0219i nu poate fi folosit ca instrument de optimizare a costurilor sau eficien\u021bei.<\/p>\n<p><strong>De re\u021binut, pe scurt:<\/strong><\/p>\n<ul>\n<li><strong>Impunerea concediului de odihn\u0103 f\u0103r\u0103 consultare prealabil\u0103<\/strong> este ilegal\u0103 \u0219i poate atrage sanc\u021biuni;<\/li>\n<li>Salariatul <strong>nu poate fi obligat s\u0103 intre \u00een concediu f\u0103r\u0103 plat\u0103<\/strong>, dec\u00e2t dac\u0103 solicit\u0103 el acest lucru;<\/li>\n<li>Angajatorul <strong>nu poate sc\u0103dea zile de concediu din anul urm\u0103tor<\/strong> f\u0103r\u0103 acordul expres al salariatului;<\/li>\n<\/ul>\n<h2><strong>Concediul de odihn\u0103: un drept, nu o favoare<\/strong><\/h2>\n<p>Codul muncii (art. 146 \u0219i 148) recunoa\u0219te <strong>dreptul la concediu de odihn\u0103 anual pl\u0103tit<\/strong> ca un drept fundamental, cu un rol esen\u021bial \u00een protejarea s\u0103n\u0103t\u0103\u021bii fizice \u0219i psihice a lucr\u0103torului.<\/p>\n<p>Acesta <strong>nu poate fi for\u021bat<\/strong>, folosit \u201epe datorie\u201d sau impus unilateral pentru a acoperi perioade \u00een care activitatea companiei este redus\u0103.<\/p>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/concediul-de-odihna-un-drept-nu-o-favoare.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-9808 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/concediul-de-odihna-un-drept-nu-o-favoare.jpg\" alt=\"Concediul de odihn\u0103 un drept, nu o favoare\" width=\"1000\" height=\"535\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/concediul-de-odihna-un-drept-nu-o-favoare.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/concediul-de-odihna-un-drept-nu-o-favoare-300x161.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/concediul-de-odihna-un-drept-nu-o-favoare-768x411.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/535;\" \/><\/a><\/p>\n<h2><strong>Ce spune Codul muncii despre programarea concediului?<\/strong><\/h2>\n<p><strong>&#x1f539;<\/strong><strong> Art. 148 alin. (2): Programare colectiv\u0103<\/strong><\/p>\n<p>Angajatorul poate stabili perioade colective de concediu (ex. s\u0103rb\u0103tori legale, mentenan\u021b\u0103, pauze de produc\u021bie) <strong>numai dup\u0103 consultarea sindicatului sau a reprezentan\u021bilor salaria\u021bilor<\/strong>.<\/p>\n<p><strong>&#x1f539;<\/strong><strong> Art. 148 alin. (3): Programare individual\u0103<\/strong><\/p>\n<p>\u00cen afara program\u0103rilor colective, concediul se stabile\u0219te individual, de comun acord \u00eentre angajator \u0219i salariat.<\/p>\n<p>&#x1f517; <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/102397\">Codul muncii \u2013 Legea 53\/2003 actualizat\u0103<\/a><\/p>\n<h2><strong>Ce NU are voie angajatorul s\u0103 fac\u0103<\/strong><\/h2>\n<ol>\n<li><strong> S\u0103 impun\u0103 concediu f\u0103r\u0103 plat\u0103<\/strong><\/li>\n<\/ol>\n<p>Conform <strong>art. 153<\/strong>, concediul f\u0103r\u0103 plat\u0103 se acord\u0103 <strong>doar la cererea scris\u0103 a salariatului<\/strong>. Nu poate fi impus de angajator.<\/p>\n<ol start=\"2\">\n<li><strong> S\u0103 retrag\u0103 zile din anul urm\u0103tor<\/strong><\/li>\n<\/ol>\n<p>Folosirea \u201e\u00een avans\u201d a concediului de odihn\u0103 din anul urm\u0103tor, f\u0103r\u0103 acordul angajatului, \u00eencalc\u0103 <strong>principiul anualit\u0103\u021bii<\/strong> reglementat de <strong>art. 146<\/strong>.<\/p>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol start=\"3\">\n<li><strong> S\u0103 penalizeze salariatul pentru lipsa zilelor disponibile<\/strong><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<h2><strong>Riscurile ignor\u0103rii prevederilor legale<\/strong><\/h2>\n<p>Angajatorii care impun concedii f\u0103r\u0103 consultare real\u0103 se expun:<\/p>\n<ul>\n<li><strong>sanc\u021biunilor de la Inspec\u021bia Muncii<\/strong>;<\/li>\n<li><strong>litigiilor individuale de munc\u0103<\/strong>;<\/li>\n<li><strong>demotiv\u0103rii \u0219i pierderii \u00eencrederii angaja\u021bilor<\/strong>, ceea ce afecteaz\u0103 performan\u021ba \u0219i reten\u021bia.<\/li>\n<\/ul>\n<h2><strong>&#x1f4cc;<\/strong><strong> Ce solu\u021bii legale are angajatorul?<\/strong><\/h2>\n<p>&#x2714;&#xfe0f; <strong>Consultare autentic\u0103 cu salaria\u021bii<\/strong>, prin sindicat sau reprezentan\u021bi;<br \/>\n&#x2714;&#xfe0f; <strong>Programare anual\u0103 a concediilor<\/strong>, lu\u00e2nd \u00een calcul perioadele sensibile (ex. decembrie);<br \/>\n&#x2714;&#xfe0f; <strong>Dialog deschis<\/strong> pentru identificarea cazurilor speciale (angaja\u021bi nou-angaja\u021bi sau cu zile epuizate);<\/p>\n<h2><strong>Concluzie<\/strong><\/h2>\n<p>Prerogativa angajatorului de a-\u0219i organiza activitatea trebuie armonizat\u0103 cu <strong>dreptul legal al salariatului la concediu de odihn\u0103<\/strong>.
