Conform unei <strong>decizii recente a \u00cenaltei Cur\u021bi de Casa\u021bie \u0219i Justi\u021bie (ICCJ)<\/strong>, publicat\u0103 \u00een <em>Monitorul Oficial<\/em> pe 28 noiembrie 2025, <strong>angajatorul are obliga\u021bia de a-l informa \u00een mod clar pe angajat cu privire la reactivarea contractului individual de munc\u0103 (CIM) \u0219i la data relu\u0103rii efective a activit\u0103\u021bii<\/strong>.<\/p>\n<p>Aceast\u0103 decizie vizeaz\u0103 aplicarea unitar\u0103 a prevederilor <strong>art. 80 alin. (2)<\/strong> \u0219i <strong>art. 274 din Codul muncii<\/strong>, \u00een corelare cu <strong>obliga\u021bia legal\u0103 de informare<\/strong> prev\u0103zut\u0103 la art. 17 \u0219i cu dreptul angajatorului de a dispune m\u0103suri organizatorice (art. 40 din Codul muncii).<\/p>\n<h2><strong>Ce \u00eenseamn\u0103 reintegrarea \u00een munc\u0103, din perspectiv\u0103 juridic\u0103?<\/strong><\/h2>\n<p>Reintegrarea este <strong>efectul anularii unei concedieri considerate nelegale<\/strong> \u0219i are ca scop readucerea salariatului \u00een pozi\u021bia avut\u0103 anterior desfacerii contractului.<\/p>\n<p>Dar, potrivit ICCJ:<\/p>\n<p>\u201eSimpla pronun\u021bare a sentin\u021bei de reintegrare, nepus\u0103 \u00een executare, nu echivaleaz\u0103 cu reactivarea automat\u0103 a contractului individual de munc\u0103.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p><strong>De<\/strong><strong> re\u021binut, pe scurt:<\/strong><\/p>\n<ul>\n<li>Reintegrarea se produce <strong>doar prin executarea hot\u0103r\u00e2rii judec\u0103tore\u0219ti<\/strong> de c\u0103tre angajator, nu prin simpla existen\u021b\u0103 a acesteia.<\/li>\n<li><strong>Angajatorul nu este obligat s\u0103 emit\u0103 o decizie formal\u0103<\/strong>, dar <strong>trebuie s\u0103 comunice salariatului clar reactivarea CIM \u0219i data relu\u0103rii muncii.<\/strong><\/li>\n<li>Salariatul <strong>nu are obliga\u021bia<\/strong> de a reveni la munc\u0103 <strong>p\u00e2n\u0103 c\u00e2nd nu este informat oficial<\/strong> de angajator cu privire la reactivare.<\/li>\n<li>Dac\u0103 angajatorul nu respect\u0103 aceast\u0103 obliga\u021bie, <strong>reintegrarea nu produce efecte<\/strong>, iar salariatul poate recurge la <strong>executor judec\u0103toresc<\/strong> (conform art. 287 lit. d) \u0219i e) din Codul penal).<\/li>\n<li>Decizia ICCJ are <strong>caracter obligatoriu pentru toate instan\u021bele de judecat\u0103<\/strong>.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/ce-inseamna-reintegrarea-in-munca-din-perspectiva-juridica.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-9803 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/ce-inseamna-reintegrarea-in-munca-din-perspectiva-juridica.jpg\" alt=\"Ce \u00eenseamn\u0103 reintegrarea \u00een munc\u0103, din perspectiv\u0103 juridic\u0103\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/ce-inseamna-reintegrarea-in-munca-din-perspectiva-juridica.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/ce-inseamna-reintegrarea-in-munca-din-perspectiva-juridica-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/ce-inseamna-reintegrarea-in-munca-din-perspectiva-juridica-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/p>\n<h2><strong>Care sunt temeiurile legale pentru aceast\u0103 obliga\u021bie?<\/strong><\/h2>\n<ul>\n<li><strong>Art. 80 alin. (2)<\/strong>: instan\u021ba poate dispune repunerea p\u0103r\u021bilor \u00een situa\u021bia anterioar\u0103 concedierii.<\/li>\n<li><strong>Art. 17 alin. (3) lit. g)<\/strong>: oblig\u0103 angajatorul s\u0103 informeze salariatul cu privire la data \u00eenceperii activit\u0103\u021bii.<\/li>\n<li><strong>Art. 274 din Codul muncii<\/strong>: reglementeaz\u0103 cererile privind executarea hot\u0103r\u00e2rilor.<\/li>\n<li><strong>Art. 8 Codul muncii<\/strong>: consacr\u0103 principiul bunei-credin\u021be.<\/li>\n<li><strong>Art. 50 lit. b)<\/strong>: prevede c\u0103 pe durata concediului medical, CIM este suspendat de drept.<\/li>\n<\/ul>\n<p>Po\u021bi consulta <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/102397\">Codul muncii actualizat \u2013 Legea 53\/2003<\/a> pentru detalii legislative complete.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>Ce trebuie s\u0103 fac\u0103 angajatorul?<\/strong><\/h2>\n<p>&#x2714; Comunic\u0103 salariatului <strong>\u00een scris<\/strong> reactivarea CIM.<br \/>\n&#x2714; Precizeaz\u0103 data efectiv\u0103 de <strong>reluare a raportului de munc\u0103<\/strong>.<br \/>\n&#x2714; Pune \u00een aplicare decizia instan\u021bei f\u0103r\u0103 a a\u0219tepta definitivarea hot\u0103r\u00e2rii, dac\u0103 aceasta este executorie de drept.<br \/>\n&#x2714; Respect\u0103 toate condi\u021biile anterioare concedierii: func\u021bie, loc de munc\u0103, program etc.<\/p>\n<p>Neemiterea unei decizii nu \u00eenseamn\u0103 automat lips\u0103 de executare, <strong>dar lipsa notific\u0103rii salariatului \u00een mod clar constituie o problem\u0103 grav\u0103<\/strong> \u00een ceea ce prive\u0219te legalitatea relu\u0103rii raportului de munc\u0103.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>C\u00e2nd poate angajatul refuza \u00eentoarcerea la munc\u0103?<\/strong><\/h2>\n<p>Salariatul nu poate fi acuzat de absen\u021b\u0103 nemotivat\u0103 dac\u0103 <strong>nu a fost informat<\/strong> cu privire la data la care trebuie s\u0103 revin\u0103. Astfel:<\/p>\n<ul>\n<li>Nu are obliga\u021bia de a se \u00eentoarce la munc\u0103 <strong>din proprie ini\u021biativ\u0103<\/strong>, doar pentru c\u0103 instan\u021ba a dispus reintegrarea.<\/li>\n<li>Nu trebuie s\u0103 ini\u021bieze executarea silit\u0103, ci poate <strong>a\u0219tepta punerea \u00een aplicare de c\u0103tre angajator<\/strong>.<\/li>\n<\/ul>\n<h2><strong>Concluzie<\/strong><\/h2>\n<p>\u00cen lumina noii decizii a ICCJ, <strong>punerea efectiv\u0103 \u00een executare a unei hot\u0103r\u00e2ri de reintegrare este esen\u021bial\u0103<\/strong>.
