Nu este doar o decizie economic\u0103, ci un proces reglementat pas cu pas, menit s\u0103 asigure <strong>predictibilitate, protec\u021bie social\u0103 \u0219i transparen\u021b\u0103<\/strong>.<\/p>\n<p><a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/128647\" target=\"_blank\" rel=\"noopener\">Codul muncii rom\u00e2n<\/a> \u0219i <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/RO\/ALL\/?uri=celex:31998L0059\" target=\"_blank\" rel=\"noopener\"><strong>Directiva european\u0103 98\/59\/CE<\/strong> <\/a>stabilesc clar: angajatorul nu poate decide liber c\u00e2nd \u0219i cum s\u0103 fac\u0103 disponibiliz\u0103ri masive. Exist\u0103 o <strong>succesiune obligatorie de etape<\/strong>, iar fiecare gre\u0219eal\u0103 procedural\u0103 poate invalida \u00eentreaga procedur\u0103.<\/p>\n<h2><strong>Notificarea autorit\u0103\u021bilor \u2013 o obliga\u021bie, nu o formalitate<\/strong><\/h2>\n<p>Unul dintre pa\u0219ii esen\u021biali ai concedierii colective este <strong>notificarea prealabil\u0103<\/strong> a autorit\u0103\u021bilor \u2013 mai exact, a <strong>Inspectoratului Teritorial de Munc\u0103 (ITM)<\/strong> \u0219i a <strong>Agen\u021biei Jude\u021bene pentru Ocuparea For\u021bei de Munc\u0103 (AJOFM)<\/strong>.<\/p>\n<p>Aceast\u0103 notificare trebuie transmis\u0103 <strong>\u00eenainte<\/strong> de emiterea deciziilor de concediere \u0219i <strong>dup\u0103<\/strong> finalizarea consult\u0103rilor cu sindicatul sau reprezentan\u021bii salaria\u021bilor. Abia dup\u0103 <strong>30 de zile de la notificare<\/strong> pot fi comunicate deciziile individuale.<\/p>\n<p>CJUE (Curtea de Justi\u021bie a Uniunii Europene) a confirmat recent, \u00eentr-o cauz\u0103 similar\u0103, c\u0103 ordinea acestor etape <strong>nu poate fi inversat\u0103 sau reparat\u0103 ulterior<\/strong>. Cu alte cuvinte, o notificare f\u0103cut\u0103 \u201edup\u0103\u201d deciziile de concediere nu salveaz\u0103 procedura \u2013 toate \u00eencet\u0103rile devin <strong>nule absolut<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>De ce nu pot fi \u201ereparate\u201d gre\u0219elile procedurale<\/strong><\/h2>\n<p>Legea nu permite repara\u021bii post-factum pentru c\u0103 notificarea are un <strong>rol social activ<\/strong>, nu doar birocratic.<br \/>\nCele 30 de zile dintre notificare \u0219i emiterea deciziilor nu sunt o perioad\u0103 de \u201ea\u0219teptare\u201d, ci un interval \u00een care autorit\u0103\u021bile trebuie s\u0103 caute solu\u021bii alternative:<\/p>\n<ul>\n<li>reangajare sau redistribuire a salaria\u021bilor afecta\u021bi,<\/li>\n<li>m\u0103suri de reconversie profesional\u0103,<\/li>\n<li>planuri de sprijin \u00een caz de \u0219omaj colectiv.<\/li>\n<\/ul>\n<p>Dac\u0103 notificarea lipse\u0219te, aceste interven\u021bii preventive devin imposibile, iar scopul legii este anulat.<\/p>\n<p>\u00cen esen\u021b\u0103, <strong>legea protejeaz\u0103 timpul<\/strong> \u2013 acel r\u0103gaz \u00een care statul poate interveni \u00eenainte ca salaria\u021bii s\u0103 r\u0103m\u00e2n\u0103 f\u0103r\u0103 loc de munc\u0103.<\/p>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/daca-esti-in-concediu-medical-poti-fi-concediat.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-9779 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/daca-esti-in-concediu-medical-poti-fi-concediat.jpg\" alt=\"daca esti in concediu medical poti fi concediat\" width=\"1000\" height=\"560\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/daca-esti-in-concediu-medical-poti-fi-concediat.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/daca-esti-in-concediu-medical-poti-fi-concediat-300x168.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/daca-esti-in-concediu-medical-poti-fi-concediat-768x430.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/560;\" \/><\/a><\/p>\n<h2><strong>Ce risc\u0103 angajatorii<\/strong><\/h2>\n<p><a href=\"https:\/\/www.codulmuncii.ro\/art_78_1.html\" target=\"_blank\" rel=\"noopener\">Art. 78 din Codul muncii<\/a> este explicit:<\/p>\n<p>\u201eConcedierea dispus\u0103 cu nerespectarea procedurii prev\u0103zute de lege este lovit\u0103 de nulitate absolut\u0103.\u201d<\/p>\n<p>Asta \u00eenseamn\u0103 c\u0103:<\/p>\n<ul>\n<li>orice decizie emis\u0103 \u00eenainte de notificare este <strong>invalid\u0103<\/strong>,<\/li>\n<li>salaria\u021bii pot cere <strong>anularea concedierii \u0219i reintegrarea<\/strong> \u00een post,<\/li>\n<li>angajatorul poate fi obligat la <strong>plata tuturor drepturilor salariale<\/strong> pe perioada cuprins\u0103 \u00eentre concediere \u0219i reintegrare,<\/li>\n<li>reputa\u021bia companiei are de suferit, iar restructurarea devine mai costisitoare dec\u00e2t men\u021binerea temporar\u0103 a posturilor.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>Rolul autorit\u0103\u021bilor \u0219i al partenerilor sociali<\/strong><\/h2>\n<p>Decizia <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/RO\/TXT\/?uri=CELEX:62024CJ0134\" target=\"_blank\" rel=\"noopener\">CJUE<\/a> a reamintit un aspect adesea ignorat: <strong>rolul activ al AJOFM \u0219i ITM<\/strong>.<br \/>\nAgen\u021biile nu trebuie s\u0103 se limiteze la \u00eenregistrarea notific\u0103rilor, ci au obliga\u021bia de a participa la proces, propun\u00e2nd m\u0103suri concrete pentru limitarea impactului social al concedierii colective.<\/p>\n<p>De asemenea, consultarea partenerilor de dialog social (sindicate, reprezentan\u021bi ai salaria\u021bilor) este o condi\u021bie prealabil\u0103, nu op\u021bional\u0103. Orice procedur\u0103 \u00eenceput\u0103 f\u0103r\u0103 aceste consult\u0103ri este incomplet\u0103.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>Pentru salaria\u021bi \u2013 dreptul de a verifica \u0219i contesta<\/strong><\/h2>\n<p>Decizia CJUE \u0219i practica instan\u021belor na\u021bionale confirm\u0103 c\u0103 lucr\u0103torii au dreptul s\u0103 verifice dac\u0103 angajatorul a respectat procedura complet\u0103.<\/p>\n<p>Salaria\u021bii pot solicita, prin reprezentan\u021bii lor sau direct, dovezi privind:<\/p>\n<ul>\n<li>data \u0219i con\u021binutul notific\u0103rii c\u0103tre autorit\u0103\u021bi,<\/li>\n<li>durata consult\u0103rilor cu sindicatul,<\/li>\n<li>respectarea termenului legal de 30 de zile.<\/li>\n<\/ul>\n<p>Dac\u0103 unul dintre ace\u0219ti pa\u0219i lipse\u0219te, concedierea poate fi declarat\u0103 <strong>nul\u0103<\/strong>, iar salariatul are dreptul s\u0103 cear\u0103 <strong>reintegrarea \u0219i plata salariilor<\/strong> restante.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>Concluzie<\/strong><\/h2>\n<p>Concedierea colectiv\u0103 este o procedur\u0103 strict reglementat\u0103, g\u00e2ndit\u0103 s\u0103 echilibreze interesele economice ale angajatorului cu protec\u021bia social\u0103 a salaria\u021bilor. Notificarea c\u0103tre autorit\u0103\u021bi nu este o etap\u0103 formal\u0103, ci o garan\u021bie c\u0103 statul \u0219i partenerii sociali pot interveni \u00eenainte ca pierderea locurilor de munc\u0103 s\u0103 devin\u0103 ireversibil\u0103.<\/p>\n<p>Orice abatere de la ordinea legal\u0103 \u2013 mai ales lipsa notific\u0103rii prealabile \u2013 atrage <strong>nulitatea absolut\u0103 a concedierii<\/strong>, f\u0103r\u0103 posibilitatea de \u201erepara\u021bie\u201d.<\/p>\n<p>Pentru angajatori, lec\u021bia este clar\u0103: o restructurare legal\u0103 \u0219i bine documentat\u0103 nu \u00eenseamn\u0103 doar respectarea termenelor, ci \u0219i \u00een\u021belegerea sensului lor.<br \/>\nPentru salaria\u021bi, mesajul este la fel de important: <strong>verifica\u021bi dac\u0103 procedura a fost urmat\u0103 pas cu pas<\/strong> \u2013 legea v\u0103 protejeaz\u0103 atunci c\u00e2nd mecanismele de prevenire au fost ignorate.<\/p>\n<p>Sursa foto Shutterstock<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Concedierea colectiv\u0103 \u2013 un proces cu reguli stricte Concedierea colectiv\u0103 este una dintre cele mai sensibile \u0219i complexe proceduri din rela\u021biile de munc\u0103.
