{"id":9772,"date":"2025-11-05T13:45:09","date_gmt":"2025-11-05T11:45:09","guid":{"rendered":"https:\/\/www.lugera.ro\/blog\/?p=9772"},"modified":"2025-12-13T13:51:54","modified_gmt":"2025-12-13T11:51:54","slug":"concedierea-in-timpul-concediului-medical-ce-spune-codul-muncii-si-cum-interpreteaza-iccj","status":"publish","type":"post","link":"https:\/\/www.lugera.ro\/blog\/concedierea-in-timpul-concediului-medical-ce-spune-codul-muncii-si-cum-interpreteaza-iccj\/","title":{"rendered":"Concedierea \u00een timpul concediului medical: Ce spune Codul muncii \u0219i cum interpreteaz\u0103 ICCJ?"},"content":{"rendered":"<p><strong>Concedierea \u00een timpul concediului medical este interzis\u0103 prin lege, iar recenta <a href=\"https:\/\/www.iccj.ro\/2025\/10\/21\/decizia-nr-18-din-29-septembrie-2025-2\/\" target=\"_blank\" rel=\"noopener\">Decizie nr. 18\/2025 a \u00cenaltei Cur\u021bi de Casa\u021bie \u0219i Justi\u021bie (ICCJ)<\/a><\/strong> clarific\u0103 momentul exact la care aceast\u0103 interdic\u021bie se aplic\u0103: <strong>momentul emiterii deciziei de concediere<\/strong>, nu cel al comunic\u0103rii sau al producerii efectelor.<\/p>\n<p>Aceast\u0103 interpretare, publicat\u0103 oficial \u00een Monitorul Oficial, devine obligatorie pentru toate instan\u021bele de judecat\u0103 \u0219i are implica\u021bii directe pentru angajatori, speciali\u0219ti HR \u0219i consilieri juridici implica\u021bi \u00een proceduri de concediere.<\/p>\n<h2><strong>Concedierea \u00een timpul concediului medical: Ce prevede Codul muncii?<\/strong><\/h2>\n<p>Potrivit <strong>art. 60 alin. (1) lit. a) din <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/128647\" target=\"_blank\" rel=\"noopener\">Codul muncii<\/a> (Legea nr. 53\/2003)<\/strong>, angajatorii <strong>nu pot dispune concedierea salaria\u021bilor pe durata incapacit\u0103\u021bii temporare de munc\u0103<\/strong>, stabilit\u0103 prin certificat medical.<\/p>\n<p>Totodat\u0103, \u00een baza <strong>art. 50 lit. b)<\/strong>, <strong>contractul individual de munc\u0103 se suspend\u0103 de drept<\/strong> pe perioada concediului medical, ceea ce \u00eenseamn\u0103 c\u0103 niciun act de \u00eencetare a CIM nu poate fi emis \u00een acest interval.<\/p>\n<h2><strong>Ce a decis ICCJ \u00een 2025?<\/strong><\/h2>\n<p>Prin <strong>Decizia nr. 18 din 29 septembrie 2025<\/strong>, publicat\u0103 recent \u00een Monitorul Oficial, <strong>ICCJ a admis recursul \u00een interesul legii<\/strong> \u0219i a stabilit urm\u0103toarele:<\/p>\n<p><strong>Interdic\u021bia de concediere prev\u0103zut\u0103 de art. 60 alin. (1) lit. a) vizeaz\u0103 momentul \u00een care decizia este emis\u0103, nu data comunic\u0103rii acesteia sau data de la care produce efecte.<\/strong><\/p>\n<p>\u00cen motivare, instan\u021ba suprem\u0103 a explicat c\u0103 termenul <em>\u201enu poate fi dispus\u0103 concedierea\u201d<\/em> se refer\u0103 la <strong>decizia angajatorului<\/strong>, iar legalitatea deciziei se analizeaz\u0103 <strong>la momentul emiterii actului<\/strong>, conform principiului <em>tempus regit actum<\/em> (actele juridice se judec\u0103 dup\u0103 legea \u0219i situa\u021bia din momentul \u00een care au fost \u00eencheiate).<\/p>\n<p>A\u0219adar, o decizie emis\u0103 \u00een perioada concediului medical este <strong>lovit\u0103 de nulitate absolut\u0103<\/strong>, chiar dac\u0103 este comunicat\u0103 dup\u0103 revenirea salariatului la munc\u0103.<\/p>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/ce-a-decis-iccj-in-2025.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-9774 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/ce-a-decis-iccj-in-2025.jpg\" alt=\"Ce a decis ICCJ \u00een 2025\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/ce-a-decis-iccj-in-2025.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/ce-a-decis-iccj-in-2025-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/12\/ce-a-decis-iccj-in-2025-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/p>\n<h2><strong>Dou\u0103 interpret\u0103ri \u00een practic\u0103 \u2013 ICCJ a tran\u0219at definitiv<\/strong><\/h2>\n<p>\u00cen lipsa unei clarific\u0103ri explicite, \u00een practic\u0103 s-au conturat dou\u0103 interpret\u0103ri:<\/p>\n<ol>\n<li><strong>Interdic\u021bia prive\u0219te momentul emiterii deciziei<\/strong> (interpretare confirmat\u0103 de ICCJ);<\/li>\n<li>Interdic\u021bia s-ar aplica <strong>doar dac\u0103 decizia este comunicat\u0103 sau produce efecte \u00een timpul concediului medical<\/strong> \u2013 interpretare respins\u0103 de instan\u021ba suprem\u0103.<\/li>\n<\/ol>\n<p>Decizia ICCJ uniformizeaz\u0103 aceste practici \u0219i ofer\u0103 angajatorilor un cadru clar de ac\u021biune.<\/p>\n<h2><strong>Ce trebuie s\u0103 \u0219tie angajatorii?<\/strong><\/h2>\n<p>&#x25b6;&#xfe0f; Verifica\u021bi \u00eentotdeauna dac\u0103 salariatul se afl\u0103 \u00een concediu medical <strong>\u00een ziua \u00een care redacta\u021bi \u0219i semna\u021bi decizia de concediere<\/strong>;<br \/>\n&#x25b6;&#xfe0f; Nu emite\u021bi decizii de \u00eencetare a CIM \u00een perioada \u00een care contractul este suspendat \u00een baza unui certificat de concediu medical;<br \/>\n&#x25b6;&#xfe0f; Re\u021bine\u021bi c\u0103 <strong>nu conteaz\u0103 data comunic\u0103rii<\/strong>, ci <strong>strict data emiterii<\/strong>;<\/p>\n<h2><strong>Implica\u021bii juridice \u0219i riscuri<\/strong><\/h2>\n<p>Emiterea unei decizii de concediere \u00een perioada concediului medical poate duce la:<\/p>\n<ul>\n<li><strong>Anularea deciziei de concediere<\/strong> prin hot\u0103r\u00e2re judec\u0103toreasc\u0103;<\/li>\n<li><strong>Reintegrarea salariatului \u00een func\u021bie<\/strong> \u0219i plata salariilor restante;<\/li>\n<li><strong>Amenzi contraven\u021bionale<\/strong> aplicate de Inspec\u021bia Muncii;<\/li>\n<li>Risc reputa\u021bional \u0219i litigii prelungite \u00een instan\u021b\u0103.<\/li>\n<\/ul>\n<h2><strong>Pe scurt: Ce trebuie re\u021binut?<\/strong><\/h2>\n<p>&#x2705; <strong>Interdic\u021bia de concediere \u00een concediul medical vizeaz\u0103 momentul emiterii deciziei<\/strong> (nu comunicarea);<\/p>\n<p>&#x2705; Decizia emis\u0103 \u00een aceast\u0103 perioad\u0103 este <strong>nul\u0103 absolut<\/strong>;<\/p>\n<p>&#x2705;
