400;\">O interpretare recent\u0103 a normelor europene privind organizarea timpului de munc\u0103 aduce o clarificare esen\u021bial\u0103 pentru companiile care au angaja\u021bi mobili, f\u0103r\u0103 un punct fix de lucru: <\/span><b>deplas\u0103rile impuse de angajator \u00eentre o \u201ebaz\u0103\u201d \u0219i locurile de interven\u021bie sunt considerate integral timp de lucru<\/b><span style=\"font-weight: 400;\">, indiferent dac\u0103 vorbim de traseul dus sau \u00eentors.<\/span><\/p>\n<h2><b>Ce \u00eenseamn\u0103, concret, aceast\u0103 decizie?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Pentru lucr\u0103torii care nu au un loc de munc\u0103 stabil, cum sunt, de exemplu, echipele de interven\u021bie, personalul tehnic pe teren, agen\u021bii de mentenan\u021b\u0103 sau construc\u021bii, <\/span><b>drumul colectiv organizat de angajator face parte din activitatea profesional\u0103<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aceasta \u00eenseamn\u0103 c\u0103:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Timpul petrecut \u00eentre baza stabilit\u0103 de angajator \u0219i \u0219antier<\/b><span style=\"font-weight: 400;\"> trebuie \u00eenregistrat ca timp de lucru;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Acela\u0219i lucru se aplic\u0103 \u0219i <\/span><b>pentru traseul de \u00eentoarcere<\/b><span style=\"font-weight: 400;\">, dac\u0103 acesta este impus \u00een acelea\u0219i condi\u021bii (ora plec\u0103rii, traseu, vehicul furnizat de angajator);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Nu are relevan\u021b\u0103 faptul c\u0103 salariatul nu execut\u0103 propriu-zis munca tehnic\u0103 \u00een timpul deplas\u0103rii, <\/span><b>prezen\u021ba, ora \u0219i mijlocul sunt controlate de angajator<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/11\/timpul-de-deplasare-este-timp-de-lucru.jpg\"><img decoding=\"async\" class=\"aligncenter style=\"font-weight: 400;\">Pentru a \u00eencadra o perioad\u0103 ca <\/span><b>timp de lucru<\/b><span style=\"font-weight: 400;\"> \u00een sensul <\/span><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/RO\/TXT\/?uri=celex:32003L0088\"><span style=\"font-weight: 400;\">Directivei 2003\/88\/CE<\/span><\/a><span style=\"font-weight: 400;\">, trebuie \u00eendeplinite <\/span><b>3 condi\u021bii cumulative<\/b><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Salariatul \u00ee\u0219i exercit\u0103 activitatea<\/b><span style=\"font-weight: 400;\">, chiar indirect, printr-o deplasare necesar\u0103 presta\u021biei;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Este la dispozi\u021bia angajatorului<\/b><span style=\"font-weight: 400;\">, nu are libertatea de a-\u0219i folosi timpul \u00een interes personal;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Se afl\u0103 la locul de munc\u0103<\/b><span style=\"font-weight: 400;\">, care, \u00een cazul salaria\u021bilor mobili, poate include \u0219i vehiculul pus la dispozi\u021bie de angajator.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Dac\u0103 toate aceste criterii sunt \u00eendeplinite, intervalul de timp respectiv trebuie tratat juridic drept <\/span><b>timp de munc\u0103<\/b><span style=\"font-weight: 400;\">, inclusiv \u00een eviden\u021bele de pontaj, raport\u0103ri \u0219i calculul repausurilor zilnice \u0219i s\u0103pt\u0103m\u00e2nale.<\/span><\/p>\n<p><b>Deplasare impus\u0103 = activitate profesional\u0103<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Aceast\u0103 concluzie este valabil\u0103 <\/span><b>doar dac\u0103<\/b><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Angajatorul decide punctul de \u00eent\u00e2lnire (ex. \u201ebaza\u201d);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ora plec\u0103rii este fix\u0103 \u0219i impus\u0103;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Vehiculul este pus la dispozi\u021bie de angajator;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Salaria\u021bii nu pot alege traseul, ora sau mijlocul de transport.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u00cen astfel de cazuri, salariatul <\/span><b>nu este liber s\u0103 dispun\u0103 de timpul s\u0103u<\/b><span style=\"font-weight: 400;\"> \u0219i se afl\u0103 sub controlul direct sau indirect al angajatorului, elemente esen\u021biale ale no\u021biunii de timp de lucru \u00een sensul reglement\u0103rilor europene.<\/span><\/p>\n<h2><b>E \u0219i platit acest timp de lucru?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Aten\u021bie: <\/span><b>statutul juridic de \u201etimp de lucru\u201d nu impune automat o anumit\u0103 form\u0103 de remunerare<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#x27a1;&#xfe0f;<\/span> <b>Directiva 2003\/88\/CE<\/b><span style=\"font-weight: 400;\"> reglementeaz\u0103 timpul de lucru \u0219i perioadele de repaus ca standarde <\/span><b>minime pentru s\u0103n\u0103tatea \u0219i securitatea \u00een munc\u0103<\/b><span style=\"font-weight: 400;\">, dar <\/span><b>nu stabile\u0219te dreptul la salariu<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#x1f4ac;<\/span><span style=\"font-weight: 400;\"> Cu alte cuvinte, <\/span><b>dac\u0103 perioada respectiv\u0103 este considerat\u0103 timp de munc\u0103, aceasta intr\u0103 \u00een calculul orelor de lucru zilnice \u0219i s\u0103pt\u0103m\u00e2nale<\/b><span style=\"font-weight: 400;\">, influen\u021b\u00e2nd dreptul la pauze, repaus zilnic \u0219i concedii, dar <\/span><b>modalitatea de plat\u0103 este reglementat\u0103 la nivel na\u021bional<\/b><span style=\"font-weight: 400;\"> sau prin contracte colective.<\/span><\/p>\n<h2><b>Concluzii pentru angajatori<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Dac\u0103 ai salaria\u021bi mobili (tehnicieni, \u0219oferi, agen\u021bi de teren etc.) care:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">nu lucreaz\u0103 la un punct fix;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">pleac\u0103 zilnic dintr-o \u201ebaz\u0103\u201d stabilit\u0103 de angajator;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">se deplaseaz\u0103 cu vehiculul angajatorului;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">au traseu \u0219i or\u0103 impuse,<\/span><\/li>\n<\/ul>\n<p><b>trebuie s\u0103 incluzi \u00eentregul interval de deplasare (dus-\u00eentors) \u00een timpul de lucru.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Nerespectarea acestui principiu poate atrage riscuri legale, mai ales \u00een cazuri de litigii individuale sau inspec\u021bii privind timpul de munc\u0103 efectiv.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Recomandare: Revizuie\u0219te procedurile interne privind eviden\u021ba timpului de lucru, mai ales pentru personalul mobil,
