Lipsa experien\u0163ei, maturitatea fizic\u0103 \u015fi psihologic\u0103 \u00een curs de dezvoltare \u015fi gradul redus de con\u0219tientizare a riscurilor fac din aceast\u0103 categorie una ce necesit\u0103 protec\u0163ie special\u0103.<\/span><\/p>\n<h2><b>&#x2705;<\/b><b> Elemente-cheie pentru speciali\u015ftii HR<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tinerii sub 18<\/span><span style=\"font-weight: 400;\">\u202f<\/span><span style=\"font-weight: 400;\">ani au statut de lucr\u0103tori vulnerabili \u015fi trebuie \u00eencadrati \u00een munc\u0103 doar \u00een condi\u0163ii adaptate v\u00e2rstei, aptitudinilor \u015fi situa\u0163iei lor educa\u0163ionale.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">V\u00e2rsta minim\u0103 general\u0103 pentru angajare este 16<\/span><span style=\"font-weight: 400;\">\u202f<\/span><span style=\"font-weight: 400;\">ani; \u00een anumite situa\u0163ii (cu acordul p\u0103rin\u0163ilor) pot fi \u00eencadrati \u015fi cei de 15<\/span><span style=\"font-weight: 400;\">\u202f<\/span><span style=\"font-weight: 400;\">ani.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pentru lucr\u0103torii sub 18<\/span><span style=\"font-weight: 400;\">\u202f<\/span><span style=\"font-weight: 400;\">ani, limita legal\u0103 de timp de lucru este de <\/span><b>maxim 6 ore pe zi<\/b><span style=\"font-weight: 400;\"> \u015fi <\/span><b>30 de ore pe s\u0103pt\u0103m\u00e2n\u0103<\/b><span style=\"font-weight: 400;\">. Munca suplimentar\u0103, munca de noapte sau activit\u0103\u0163ile care le dep\u0103\u015fesc capacit\u0103\u0163ile sunt interzise.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Exist\u0103 o list\u0103 clar\u0103 de activit\u0103\u0163i ce sunt interzise pentru tineri, cele care solicit\u0103 excesiv din punct de vedere fizic ori psihic, cele ce implic\u0103 expunere la agen\u0163i toxici, radia\u0163ii, vibra\u0163ii, zgomot puternic, temperaturi extreme sau riscuri la care t\u00e2n\u0103rul nu are capacitate s\u0103 le identifice sau s\u0103 le gestioneze.<\/span><\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/11\/angajarea-tinerilor.jpg\"><img decoding=\"async\" class=\"aligncenter wp-image-9733 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/11\/angajarea-tinerilor.jpg\" alt=\"angajarea tinerilor\" width=\"750\" height=\"500\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/11\/angajarea-tinerilor.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/11\/angajarea-tinerilor-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/11\/angajarea-tinerilor-768x512.jpg 768w\" data-sizes=\"(max-width: 750px) 100vw, 750px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 750px; --smush-placeholder-aspect-ratio: 750\/500;\" \/><\/a><\/p>\n<h2><b>&#x1f4da;<\/b><b> Cadrul legal pentru protec\u0163ia tinerilor<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Protec\u0163ia tinerilor la locul de munc\u0103 este sus\u0163inut\u0103 at\u00e2t la nivel interna\u0163ional, c\u00e2t \u015fi na\u021bional:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La nivel global, conven\u0163ii precum cea pentru v\u00e2rsta minim\u0103 a muncii \u015fi cea pentru cele mai grave forme de munc\u0103 ale copiilor stabilec standarde de referin\u0163\u0103.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00cen legisla\u0163ia rom\u00e2n\u0103, Codul muncii \u015fi actele sale de aplicare stabilesc principiile generale: libertatea de munc\u0103, dar \u015fi protec\u0163ia celor afla\u0163i \u00een formare.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Un act normativ esen\u0163ial: <\/span><a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/83571\"><span style=\"font-weight: 400;\">Hot\u0103r\u00e2rea Guvernului nr. 600\/2007<\/span><\/a><span style=\"font-weight: 400;\"> privind protec\u021bia tinerilor la locul de munc\u0103, transpune directiva european\u0103 \u00een domeniu.&nbsp;<\/span><\/li>\n<\/ul>\n<h2><b>&#x1f6e0;<\/b><b> Ce obliga\u0163ii are angajatorul c\u00e2nd \u00eencadreaz\u0103 tineri?<\/b><\/h2>\n<p><b>\u29bf<\/b><b> V\u00e2rst\u0103 minim\u0103 \u0219i activit\u0103\u0163i permise<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Angajatorul trebuie s\u0103 verifice dac\u0103 t\u00e2n\u0103rul are <\/span><a href=\"https:\/\/reges.inspectiamuncii.ro\/informatii-utile\/noutati\/protectia-tinerilor-la-locul-de-munca\"><span style=\"font-weight: 400;\">v\u00e2rsta legal\u0103 cerut\u0103<\/span><\/a><span style=\"font-weight: 400;\"> (\u00een principiu 16<\/span><span style=\"font-weight: 400;\">\u202f<\/span><span style=\"font-weight: 400;\">ani, cu excep\u0163ii de la 15<\/span><span style=\"font-weight: 400;\">\u202f<\/span><span style=\"font-weight: 400;\">ani cu acordul p\u0103rin\u0163ilor). Activitatea trebuie s\u0103 fie compatibil\u0103 cu capacit\u0103\u0163ile lui \u015fi s\u0103 nu \u00eei pericliteze s\u0103n\u0103tatea, formarea educa\u0163ional\u0103 sau dezvoltarea personal\u0103.&nbsp;<\/span><\/p>\n<p><b>\u29bf<\/b><b> Limitele timpului de lucru<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Pentru tineri sub 18<\/span><span style=\"font-weight: 400;\">\u202f<\/span><span style=\"font-weight: 400;\">ani: <\/span><a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/83571\"><span style=\"font-weight: 400;\">maximum 6 ore pe zi, maximum 30 de ore pe s\u0103pt\u0103m\u00e2n\u0103<\/span><\/a><span style=\"font-weight: 400;\">. Niciun angajator nu poate introduce munca suplimentar\u0103 sau munca de noapte pentru ace\u015fti lucr\u0103tori.&nbsp;<\/span><\/p>\n<p><b>\u29bf<\/b><b> Interdic\u0163ii \u00een privin\u0163a tipurilor de munc\u0103<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Activit\u0103\u0163ile interzise includ: <\/span><a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/83571\"><span style=\"font-weight: 400;\">cele care solicit\u0103 intens fizic sau psihic<\/span><\/a><span style=\"font-weight: 400;\">, cele cu expunere la agen\u0163i nocivi (chimici, fizici, biologici), munca de noapte, munca \u00een condi\u0163ii extreme.&nbsp;<\/span><\/p>\n<p><b>\u29bf<\/b><b> Obliga\u0163ii de SSM, instruire \u015fi supraveghere<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Angajatorul trebuie s\u0103 realizeze evaluarea riscurilor adaptat\u0103 tinerilor, s\u0103 asigure <\/span><a href=\"https:\/\/reges.inspectiamuncii.ro\/informatii-utile\/noutati\/protectia-tinerilor-la-locul-de-munca\"><span style=\"font-weight: 400;\">supraveghere<\/span><\/a><span style=\"font-weight: 400;\"> medical\u0103 adecvat\u0103 \u015fi s\u0103 ofere informare \u015fi formare specific\u0103 v\u00e2rstei \u015fi sarcinilor. Suplimentar, p\u0103rin\u0163ii sau tutorii trebuie informa\u0163i asupra riscurilor \u0219i a condi\u021biilor de munc\u0103.&nbsp;<\/span><\/p>\n<h2><b>&#x1f50d;<\/b><b> Relevan\u0163\u0103 practic\u0103 pentru HR \u0219i consilieri juridici<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Pentru departamentele de HR, \u00eencadrarea tinerilor cu v\u00e2rsta mai mic\u0103 de 18<\/span><span style=\"font-weight: 400;\">\u202f<\/span><span style=\"font-weight: 400;\">ani poate p\u0103rea o opera\u0163iune simpl\u0103, contract de munc\u0103, program redus etc., \u00eens\u0103 realitatea este mai complex\u0103:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Neasigurarea unei evalu\u0103ri a riscurilor adaptate v\u00e2rstei t\u00e2n\u0103rului poate conduce la responsabilit\u0103\u0163i suplimentare sau sanc\u0163iuni.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ne\u00eenregistrarea limitelor de program sau efectuarea de ore suplimentare poate duce la recalcul\u0103ri, pl\u0103\u0163i retroactive sau riscuri legale.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Activitatea trebuie documentat\u0103 \u00een a\u015fa fel \u00eenc\u00e2t s\u0103 se demonstreze conformitatea cu prevederile legale, at\u00e2t pentru protec\u0163ie, c\u00e2t \u015fi pentru audit intern sau controlul inspectoratului.<\/span><\/li>\n<\/ul>\n<h2><b>&#x1f9fe;<\/b><b> Concluzie<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Angajarea tinerilor aduce beneficii reale pentru organiza\u021bii, dar \u0219i un set clar de obliga\u021bii legale care nu trebuie ignorate. Adaptarea programului de lucru, evaluarea riscurilor, supravegherea medical\u0103 \u0219i informarea p\u0103rin\u021bilor nu sunt detalii birocratice, ci pa\u0219i esen\u021biali pentru un demers corect \u0219i sustenabil.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pentru echipele de HR \u0219i speciali\u0219tii \u00een <\/span><a href=\"https:\/\/www.lugera.ro\/servicii\/payroll-si-administrare-personal\/\"><span style=\"font-weight: 400;\">payroll<\/span><\/a><span style=\"font-weight: 400;\">, \u00eencadrarea corect\u0103 a tinerilor \u00een munc\u0103 nu \u021bine doar de conformitate, ci \u0219i de responsabilitate fa\u021b\u0103 de viitorii profesioni\u0219ti din pia\u021ba muncii.
