Cazurile \u00een care salaria\u021bii sunt concedia\u021bi nelegal \u0219i apoi reintegra\u021bi \u00een func\u021bie ridic\u0103 \u00eentreb\u0103ri esen\u021biale despre perioada pentru care se acord\u0103 concediul de odihn\u0103.<\/p>\n<h2><strong>Dreptul la concediu subzist\u0103 \u0219i f\u0103r\u0103 munc\u0103 efectiv\u0103, dac\u0103 vina apar\u021bine angajatorului<\/strong><\/h2>\n<p>Conform deciziei CJUE \u00een <a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf;jsessionid=4E53F9599B2B88D849C4B48C00A8DDFD?text=&amp;docid=278514&amp;pageIndex=0&amp;doclang=RO&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=839188\">cauza C-57\/22<\/a>, perioada cuprins\u0103 \u00eentre data unei concedieri nelegale \u0219i momentul reintegr\u0103rii salariatului trebuie tratat\u0103 ca o perioad\u0103 de activitate \u00een scopul acumul\u0103rii de zile de concediu de odihn\u0103. A\u0219adar, dac\u0103 angajatorul este responsabil pentru \u00eentreruperea raporturilor de munc\u0103, salariatul are \u00een continuare dreptul la concediu, chiar dac\u0103 nu a prestat efectiv activitate.<\/p>\n<p>Pentru departamentele de <a href=\"https:\/\/www.lugera.ro\/servicii\/payroll-si-administrare-personal\/\">payroll \u0219i HR<\/a>, aceast\u0103 interpretare presupune recalcularea drepturilor salariale \u0219i a soldului de concediu inclusiv pentru perioada de absen\u021b\u0103 nejustificat\u0103 din vina angajatorului. Rolul s\u0103u este dublu:<\/p>\n<ol>\n<li><strong>Recuperarea fizic\u0103 \u0219i psihic\u0103 a salariatului<\/strong>;<\/li>\n<li><strong>Asigurarea unui echilibru \u00eentre via\u021ba profesional\u0103 \u0219i cea personal\u0103<\/strong>.<\/li>\n<\/ol>\n<p>Aceast\u0103 viziune sus\u021bine ideea c\u0103 salariatul nu poate fi privat de concediu doar pentru c\u0103, dintr-o eroare a angajatorului, nu a putut munci efectiv o perioad\u0103. Este o obliga\u021bie legal\u0103, iar \u00eenc\u0103lcarea acestuia poate atrage litigii costisitoare \u0219i pierderi de imagine.
