Aceast\u0103 practic\u0103, de\u0219i comun\u0103, ridic\u0103 provoc\u0103ri de ordin legal \u0219i opera\u021bional, mai ales \u00een ceea ce prive\u0219te \u00eencadrarea corect\u0103 a rela\u021biei de munc\u0103 \u0219i modul de raportare \u00een Reges.<\/p>\n<p>Pentru speciali\u0219tii \u00een resurse umane \u0219i payroll, este esen\u021bial s\u0103 identifice corect tipul rela\u021biei de munc\u0103 \u0219i s\u0103 documenteze \u00een mod adecvat contractul individual de munc\u0103 (CIM), evit\u00e2nd astfel riscuri de conformitate \u0219i interpret\u0103ri gre\u0219ite.<\/p>\n<h2><strong>Trei scenarii posibile pentru locul muncii la sediul clientului<\/strong><\/h2>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/09\/delegare.jpg\"><img decoding=\"async\" class=\"aligncenter wp-image-9710 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/09\/delegare.jpg\" alt=\"delegare\" width=\"750\" height=\"499\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/09\/delegare.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/09\/delegare-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/09\/delegare-768x511.jpg 768w\" data-sizes=\"(max-width: 750px) 100vw, 750px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 750px; --smush-placeholder-aspect-ratio: 750\/499;\" \/><\/a><\/p>\n<ol>\n<li><strong> Activitate desf\u0103\u0219urat\u0103 permanent la client \u2013 loc de munc\u0103 principal<\/strong><\/li>\n<\/ol>\n<p>Dac\u0103 salariatul lucreaz\u0103 \u00een mod constant, pe termen lung, la sediul clientului, acest spa\u021biu devine <strong>locul principal de munc\u0103<\/strong>. Nu este vorba despre o delegare sau munc\u0103 temporar\u0103, ci despre o localizare permanent\u0103, care trebuie reflectat\u0103 corect \u00een documentele de angajare.<\/p>\n<ul>\n<li><strong>CIM-ul trebuie s\u0103 specifice adresa exact\u0103<\/strong> a loca\u021biei unde salariatul \u00ee\u0219i va desf\u0103\u0219ura activitatea.<\/li>\n<li>Informa\u021biile vor fi \u00eenregistrate \u0219i \u00een <strong>Reges<\/strong>, cu aceea\u0219i adres\u0103.<\/li>\n<li>Orice modificare a acestui loc presupune <strong>act adi\u021bional \u0219i acordul p\u0103r\u021bilor<\/strong>.<\/li>\n<\/ul>\n<p>Aceast\u0103 abordare respect\u0103 prevederile art. 17 din Codul muncii, care impune claritatea locului muncii \u00eenc\u0103 din faza precontractual\u0103.<\/p>\n<ol start=\"2\">\n<li><strong> Activitate ocazional\u0103 la client \u2013 delegare temporar\u0103<\/strong><\/li>\n<\/ol>\n<p>Dac\u0103 salariatul este trimis s\u0103 presteze activitate la client doar pentru perioade limitate \u0219i ocazionale, vorbim despre <strong>delegare<\/strong>.<\/p>\n<ul>\n<li>Aceasta este reglementat\u0103 de Codul muncii, cu o durat\u0103 maxim\u0103 de <strong>60 de zile calendaristice \u00eentr-un an<\/strong>, cu posibilitatea de prelungire cu acordul salariatului.<\/li>\n<li><strong>Contractul de munc\u0103 nu se modific\u0103<\/strong>, iar Reges nu se actualizeaz\u0103 cu noua loca\u021bie.<\/li>\n<li>Angajatorul trebuie s\u0103 emit\u0103 <strong>decizie de delegare<\/strong>, \u00eenso\u021bit\u0103 de eventualele drepturi aferente (diurn\u0103, transport, cazare).<\/li>\n<\/ul>\n<p>Important: utilizarea deleg\u0103rilor repetate pentru a acoperi o prezen\u021b\u0103 de fapt permanent\u0103 la client poate fi considerat\u0103 o eludare a legii.<\/p>\n<ol start=\"3\">\n<li><strong> Munc\u0103 temporar\u0103 prin agent \u2013 misiune la utilizator<\/strong><\/li>\n<\/ol>\n<p>\u00cen cazul \u00een care angajatorul este <a href=\"https:\/\/www.lugera.ro\/servicii\/munca-temporara\/\"><strong>agent de munc\u0103 temporar\u0103<\/strong><\/a>, iar salariatul desf\u0103\u0219oar\u0103 activitatea la o companie-client (utilizator), avem o rela\u021bie specific\u0103, reglementat\u0103 distinct de <a href=\"https:\/\/www.codulmuncii.ro\/titlul_2\/capitolul_7\/art_88_1.html\">Codul muncii (art. 88-102)<\/a>.<\/p>\n<ul>\n<li>Salariatul are un <strong>contract de munc\u0103 temporar\u0103<\/strong> \u00eencheiat cu agentul.<\/li>\n<li>Activitatea se desf\u0103\u0219oar\u0103 exclusiv la sediul utilizatorului.<\/li>\n<li>\u00cen <strong>Reges<\/strong>, se selecteaz\u0103 tipul special de contract aferent muncii temporare, iar datele despre utilizator sunt raportate corespunz\u0103tor.<\/li>\n<\/ul>\n<p>Acest tip de colaborare implic\u0103 o rela\u021bie triunghiular\u0103 \u00eentre agent, salariat \u0219i utilizator, fiecare av\u00e2nd responsabilit\u0103\u021bi clar definite.<\/p>\n<h2><strong>De ce conteaz\u0103 corecta \u00eencadrare a locului muncii?<\/strong><\/h2>\n<p>Locul muncii nu este o simpl\u0103 informa\u021bie tehnic\u0103. El influen\u021beaz\u0103 major aspecte precum:<\/p>\n<ul>\n<li><strong>Timpul de deplasare \u0219i costurile asociate<\/strong><\/li>\n<li><strong>Programul de lucru<\/strong> \u0219i compatibilitatea cu via\u021ba personal\u0103<\/li>\n<li><strong>Accesul la facilit\u0103\u021bi, beneficii, spa\u021bii de relaxare sau protec\u021bie colectiv\u0103<\/strong><\/li>\n<li><strong>Evaluarea riscurilor de munc\u0103<\/strong> \u0219i asigurarea echipamentului adecvat<\/li>\n<\/ul>\n<p>Respectarea dreptului salariatului de a \u0219ti cu precizie unde va lucra este un element de bun\u0103 practic\u0103 \u00een recrutare \u0219i managementul for\u021bei de munc\u0103, dar \u0219i o obliga\u021bie legal\u0103, conform <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/RO\/ALL\/?uri=CELEX:32019L1152\"><strong>Directivei (UE) 2019\/1152<\/strong><\/a><strong> privind transparen\u021ba condi\u021biilor de munc\u0103<\/strong>.<\/p>\n<h2><strong>Concluzii pentru angajatori \u0219i profesioni\u0219ti \u00een HR<\/strong><\/h2>\n<p>Pentru a respecta legisla\u021bia muncii \u0219i a evita recalific\u0103ri sau sanc\u021biuni:<\/p>\n<ul>\n<li>Specifica\u021bi <strong>clar \u0219i precis<\/strong> \u00een CIM locul de munc\u0103, atunci c\u00e2nd activitatea se desf\u0103\u0219oar\u0103 la client.<\/li>\n<li>Utiliza\u021bi <strong>institu\u021bia deleg\u0103rii<\/strong> doar \u00een cazul prezen\u021bei ocazionale, cu documenta\u021bie adecvat\u0103.<\/li>\n<li>Aplica\u021bi <strong>regulile muncii temporare<\/strong> atunci c\u00e2nd desf\u0103\u0219ura\u021bi activitate ca agent de munc\u0103 temporar\u0103.<\/li>\n<\/ul>\n<p>O abordare riguroas\u0103 a acestor situa\u021bii sprijin\u0103 nu doar conformitatea juridic\u0103, ci \u0219i \u00eencrederea angaja\u021bilor, care au dreptul la transparen\u021b\u0103 \u0219i previzibilitate privind locul \u00een care \u00ee\u0219i desf\u0103\u0219oar\u0103 activitatea.<\/p>\n<p>&nbsp;<\/p>\n<p>Surs\u0103 foto: shutterstock.com<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00cen contextul unui mediu economic tot mai colaborativ, devine tot mai frecvent ca salaria\u021bii s\u0103 \u00ee\u0219i desf\u0103\u0219oare activitatea la sediul unui partener contractual al angajatorului.
