Asta \u00eenseamn\u0103 c\u0103 perioada de prob\u0103 continu\u0103 s\u0103 curg\u0103, iar angajatorul poate trimite notificarea de \u00eencetare.<\/span><\/p>\n<h2><b>Este \u00eentotdeauna legal\u0103 denun\u021barea unilateral\u0103?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">\u00cen principiu, da. \u00cens\u0103 orice drept trebuie exercitat <\/span><b>cu bun\u0103-credin\u021b\u0103<\/b><span style=\"font-weight: 400;\">, conform art. 8 din Codul muncii.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#x27a1;&#xfe0f;<\/span><span style=\"font-weight: 400;\"> Exemple de situa\u021bii care pot ridica suspiciuni de <\/span><b>abuz de drept<\/b><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00eencetarea contractului ca represalii pentru o ac\u021biune legal\u0103 a angajatului (ex. solicitare de drepturi salariale);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00eencetarea bazat\u0103 pe criterii discriminatorii (sex, v\u00e2rst\u0103, stare de s\u0103n\u0103tate);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00eencetarea \u00eentr-un context \u00een care scopul real al legii este deturnat.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Dac\u0103 exist\u0103 indicii c\u0103 notificarea nu a fost emis\u0103 cu bun\u0103-credin\u021b\u0103, salariatul poate contesta actul \u00een instan\u021b\u0103.<\/span><\/p>\n<h2><b>Ce obliga\u021bii are angajatorul la \u00eencetarea contractului \u00een perioada de prob\u0103?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Chiar dac\u0103 notificarea este valabil\u0103 \u0219i contractul se \u00eencheie imediat, angajatorul trebuie s\u0103 pl\u0103teasc\u0103:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">salariul pentru zilele lucrate p\u00e2n\u0103 la \u00eencetare;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">sporurile \u0219i alte drepturi prev\u0103zute \u00een contract.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">&#x1f4cc;<\/span><span style=\"font-weight: 400;\"> Neplata integral\u0103 a acestor drepturi poate duce la litigii costisitoare: sumele se actualizeaz\u0103 cu rata infla\u021biei \u0219i se adaug\u0103 dob\u00e2nda legal\u0103 penalizatoare.<\/span><\/p>\n<h2><b>\u00centreb\u0103ri frecvente despre denun\u021barea unilateral\u0103<\/b><\/h2>\n<ol>\n<li><b> Trebuie s\u0103 existe o justificare \u00een notificare?<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Nu.
