style=\"font-weight: 400;\"> \u2013 postul trebuie s\u0103 fie eliminat complet din organigram\u0103 \u0219i statul de func\u021bii;<\/span><\/li>\n<li style=\"font-weight: 400;\" dac\u0103 exist\u0103 un motiv real, independent de persoana angajatului concediat.<\/span><\/p>\n<h2><b>Ce se \u00eent\u00e2mpl\u0103 cu atribu\u021biile postului desfiin\u021bat?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Redistribuirea sarcinilor c\u0103tre al\u021bi angaja\u021bi este permis\u0103 dac\u0103:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">nu se creeaz\u0103 o \u00eenc\u0103rcare excesiv\u0103 a muncii;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">modific\u0103rile sunt justificate \u0219i documentate;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">nu exist\u0103 indicii c\u0103 postul continu\u0103, sub o alt\u0103 denumire, pentru acelea\u0219i activit\u0103\u021bi.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Dac\u0103 \u00een urma reorganiz\u0103rii un angajat ajunge s\u0103 aib\u0103 un volum de lucru nerezonabil, aceasta poate fi o dovad\u0103 c\u0103 desfiin\u021barea a fost doar formal\u0103, ceea ce expune compania la litigii.<\/span><\/p>\n<h2><b>Pa\u0219ii esen\u021biali pentru o concediere corect\u0103<\/b><\/h2>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Analiza \u0219i documentarea reorganiz\u0103rii<\/b><span style=\"font-weight: 400;\"> \u2013 de exemplu, rapoarte interne privind restructurarea activit\u0103\u021bii.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Actualizarea organigramei \u0219i statului de func\u021bii<\/b><span style=\"font-weight: 400;\"> \u2013 postul desfiin\u021bat trebuie s\u0103 dispar\u0103
