Se face din ini\u021biativa angajatorului \u0219i presupune mutarea temporar\u0103 a salariatului \u00eentr-un alt loc de munc\u0103.<\/span><\/p>\n<p><b>Ce este obligatoriu s\u0103 con\u021bin\u0103 decizia de delegare:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Perioada exact\u0103 (durata deleg\u0103rii)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Destina\u021bia (unde lucreaz\u0103 temporar)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Scopul deplas\u0103rii (de ce are loc delegarea)<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">&#x1f50e;<\/span><span style=\"font-weight: 400;\"> Dac\u0103 perioada deleg\u0103rii dep\u0103\u0219e\u0219te 60 de zile \u00eentr-un an, este necesar acordul scris al salariatului.<\/span><\/p>\n<p><b>Cheltuieli acoperite:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Transport<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cazare<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Indemniza\u021bie de delegare (diurn\u0103)<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Este recomandat ca toate aceste condi\u021bii s\u0103 fie reglementate \u00een regulamentul intern, contractul colectiv de munc\u0103 sau o procedur\u0103 intern\u0103 clar\u0103.<\/span><\/p>\n<h2><b> Mobilitatea permanent\u0103 \u2013 clauza de mobilitate \u00een contract<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Un salariat cu activitate \u00een mai multe locuri trebuie s\u0103 aib\u0103 <\/span><a href=\"https:\/\/www.lugera.ro\/blog\/clauza-de-mobilitate-in-contractele-de-munca-elemente-esentiale-si-implicatii\/\"><b>clauza de mobilitate<\/b><\/a><span style=\"font-weight: 400;\"> inclus\u0103 expres \u00een contractul individual de munc\u0103.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aceasta trebuie s\u0103 prevad\u0103:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Faptul c\u0103 salariatul nu are un loc fix de munc\u0103<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Suma acordat\u0103 lunar ca <\/span><b>indemniza\u021bie de mobilitate<\/b><span style=\"font-weight: 400;\"> (aceasta este obligatorie)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Modul \u00een care se acoper\u0103 cheltuielile de deplasare<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">&#x1f4cc;<\/span><span style=\"font-weight: 400;\"> Indemniza\u021bia de mobilitate trebuie acordat\u0103 permanent (nu doar \u00een lunile cu deplas\u0103ri) \u0219i declarat\u0103 \u00een registrul electronic de eviden\u021b\u0103 a salaria\u021bilor (Reges-Online).<\/span><\/p>\n<p><b>Documente recomandate pentru justificare:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Foi de parcurs<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Raport\u0103ri de activitate<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Bonuri, pontaje, extrase de tahograf (pentru \u0219oferi)<\/span><\/li>\n<\/ul>\n<h2><b> Deta\u0219area \u2013 angajatul lucreaz\u0103 temporar la alt angajator<\/b><\/h2>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/delegare-si-detasare-reglementari-legale-si-impact-asupra-contractului-de-munca\/\"><span style=\"font-weight: 400;\">Deta\u0219area<\/span><\/a><span style=\"font-weight: 400;\"> presupune trimiterea salariatului, temporar, s\u0103 lucreze pentru un alt angajator. Are loc cu acordul salariatului \u0219i implic\u0103 o dispozi\u021bie de deta\u0219are.<\/span><\/p>\n<p><b>Aspecte cheie:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Durata ini\u021bial\u0103 este de maximum 6 luni, cu posibilitatea de prelungire \u00een condi\u021bii speciale<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Salariatul poate refuza deta\u0219area doar pentru motive personale temeinice<\/span><\/li>\n<\/ul>\n<h2><b>Deta\u0219area transna\u021bional\u0103 \u2013 lucrul \u00een alt stat UE<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Pentru deta\u0219\u0103rile \u00een str\u0103in\u0103tate, este esen\u021bial ca salariatul s\u0103 r\u0103m\u00e2n\u0103 \u00een rela\u021bie de munc\u0103 cu angajatorul rom\u00e2n \u0219i s\u0103 existe un contract \u00eentre firma din Rom\u00e2nia \u0219i partenerul din statul gazd\u0103.<\/span><\/p>\n<p><b>Ce trebuie preg\u0103tit:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Formularul A1<\/b><span style=\"font-weight: 400;\"> \u2013 atest\u0103 protec\u021bia datelor<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Pe l\u00e2ng\u0103 documentele administrative, angajatorii trebuie s\u0103 \u021bin\u0103 cont \u0219i de:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Tratatele de evitare a dublei impuneri<\/b><span style=\"font-weight: 400;\"> (dac\u0103 deta\u0219area dep\u0103\u0219e\u0219te 183 de zile\/an)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>GDPR<\/b><span style=\"font-weight: 400;\"> \u2013 mai ales c\u00e2nd colaborarea implic\u0103 transfer de date personale c\u0103tre parteneri externi<\/span><\/li>\n<\/ul>\n<h2><b>Concluzie<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Indiferent de forma mobilit\u0103\u021bii \u2013 delegare, mobilitate permanent\u0103 sau deta\u0219are transna\u021bional\u0103 \u2013 cheia respect\u0103rii legii const\u0103 \u00een <\/span><b>documentarea riguroas\u0103<\/b><span style=\"font-weight: 400;\"> \u0219i <\/span><b>adaptarea contractelor de munc\u0103 \u0219i procedurilor interne<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Este recomandabil ca angajatorii s\u0103 revizuiasc\u0103 periodic contractele, s\u0103 actualizeze regulamentul intern \u0219i s\u0103 colaboreze cu speciali\u0219ti \u00een legisla\u021bia muncii pentru a evita interpret\u0103ri gre\u0219ite sau sanc\u021biuni fiscale.<\/span><\/p>\n<h2><b>\u00a0\u00centreb\u0103ri frecvente (FAQ)<\/b><\/h2>\n<ol>\n<li><b> Este obligatorie includerea
