De\u0219i obligativitatea form\u0103rii este clar reglementat\u0103, \u00een practic\u0103 apar deseori confuzii \u2014 mai ales c\u00e2nd angajatorii cer salaria\u021bilor s\u0103 suporte aceste costuri. \u00cens\u0103 cine are, de fapt, responsabilitatea financiar\u0103?<\/span><\/p>\n<h2><b>Instruirea impus\u0103 prin lege \u2013 o obliga\u021bie exclusiv\u0103 a angajatorului<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Conform legisla\u021biei muncii \u0219i reglement\u0103rilor privind s\u0103n\u0103tatea \u0219i securitatea la locul de munc\u0103, angajatorii sunt cei care trebuie s\u0103 suporte integral cheltuielile asociate instruirii obligatorii. Vorbim aici despre cursuri esen\u021biale pentru activit\u0103\u021bi specifice, cum ar fi cele de igien\u0103 \u00een sectorul alimentar sau formarea minim\u0103 pentru securitatea \u00een munc\u0103.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aceast\u0103 responsabilitate este clar prev\u0103zut\u0103 \u00een lege: orice formare impus\u0103 pentru a permite angajatului s\u0103 \u00ee\u0219i desf\u0103\u0219oare legal activitatea trebuie acoperit\u0103 financiar de angajator. Impunerea unui cost asupra salariatului, \u00een astfel de cazuri, nu doar c\u0103 este contrar\u0103 reglement\u0103rilor na\u021bionale, ci \u0219i celor europene.<\/span><\/p>\n<h2><b>Cursuri pl\u0103tite de angajator. Codul muncii oblig\u0103 angajatorii s\u0103 asigure formarea profesional\u0103 a salaria\u021bilor dup\u0103 cum urmeaz\u0103:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">o dat\u0103 la <\/span><b>2 ani<\/b><span style=\"font-weight: 400;\">, dac\u0103 societatea are peste <\/span><b>21 de angaja\u021bi<\/b><span style=\"font-weight: 400;\">;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">o dat\u0103 la <\/span><b>3 ani<\/b><span style=\"font-weight: 400;\">, \u00een cazul firmelor cu mai pu\u021bin de <\/span><b>21 de angaja\u021bi<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Aceast\u0103 formare, chiar dac\u0103 nu este \u201eimpus\u0103 de lege\u201d \u00een mod direct pentru accesul la un post, trebuie totu\u0219i asigurat\u0103 din ini\u021biativa angajatorului. Iar \u00een acest caz, <\/span><b>toate costurile aferente \u2013 taxe, transport, cazare, materiale \u2013 trebuie acoperite de angajator<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><b>&#x26a0;&#xfe0f;<\/b><b> Se poate recupera costul form\u0103rii dac\u0103 salariatul pleac\u0103?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Da. \u00cen situa\u021biile \u00een care formarea este oferit\u0103 la ini\u021biativa angajatorului, acesta are dreptul s\u0103 stabileasc\u0103 o perioad\u0103 minim\u0103 \u00een care salariatul trebuie s\u0103 r\u0103m\u00e2n\u0103 \u00een firm\u0103, printr-un act adi\u021bional. Dac\u0103 angajatul p\u0103r\u0103se\u0219te compania \u00eenainte de expirarea termenului agreat, poate fi obligat s\u0103 restituie o parte propor\u021bional\u0103 din costurile form\u0103rii.<\/span><\/p>\n<p><b>&#x1f4cc;<\/b><b> Ce NU poate face angajatorul:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Nu poate solicita angajatului s\u0103 pl\u0103teasc\u0103 pentru cursuri de igien\u0103 sau siguran\u021b\u0103 cerute de legisla\u021bie;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Nu poate condi\u021biona ocuparea postului de achitarea unor costuri impuse pentru instruire obligatorie;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Nu poate retrage contravaloarea cursului din salariu sau alte drepturi salariale.<\/span><\/li>\n<\/ul>\n<p><b>&#x2705;<\/b><b> Check-list pentru angajatori: ce trebuie s\u0103 \u0219tii<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cursurile cerute de legisla\u021bie (ex: igien\u0103, SSM) trebuie pl\u0103tite integral de angajator.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Formarea profesional\u0103 este obligatorie periodic \u2013 cel pu\u021bin o dat\u0103 la 2 sau 3 ani, \u00een func\u021bie de m\u0103rimea companiei.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Angajatorul poate recupera costul form\u0103rii ini\u021biate voluntar doar dac\u0103 exist\u0103 un angajament scris semnat cu salariatul.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Orice re\u021binere din salariu f\u0103r\u0103 acordul expres al angajatului este ilegal\u0103.<\/span><\/li>\n<\/ul>\n<h2><b>\u00centreb\u0103ri frecvente (FAQ)<\/b><\/h2>\n<ol>\n<li><b> Poate angajatorul s\u0103 cear\u0103 bani pentru un curs de igien\u0103?<\/b><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">&#x1f6d1; <\/span><span style=\"font-weight: 400;\">Nu. Este ilegal. Aceste cursuri sunt parte din obliga\u021biile de securitate \u00een munc\u0103 \u0219i nu pot fi pl\u0103tite de salariat.<\/span><\/li>\n<li><b> Dac\u0103 accept s\u0103 pl\u0103tesc, pot cere banii \u00eenapoi ulterior?<\/b><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">&#x2714;<\/span><span style=\"font-weight: 400;\"> Da, po\u021bi solicita returnarea sumelor, deoarece costurile nu ar fi trebuit s\u0103 fie transferate asupra ta.<\/span><\/li>\n<li><b> Dac\u0103 formarea este legat\u0103 de dezvoltarea carierei, pot fi obligat s\u0103 r\u0103m\u00e2n \u00een firm\u0103?<\/b><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">&#x2714;<\/span><span style=\"font-weight: 400;\"> Da, dar doar dac\u0103 ai semnat un act adi\u021bional care prevede clar aceast\u0103 obliga\u021bie.<\/span><\/li>\n<li><b>Ce se \u00eent\u00e2mpl\u0103 dac\u0103 angajatorul refuz\u0103 formarea obligatorie?<\/b><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">&#x1f4cc;<\/span><span style=\"font-weight: 400;\"> Salariatul poate solicita un concediu de formare pl\u0103tit de p\u00e2n\u0103 la 10 zile lucr\u0103toare sau 80 de ore, cu p\u0103strarea salariului.<\/span><\/li>\n<\/ol>\n<h2><b>Concluzie<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">\u00cen orice rela\u021bie de munc\u0103, echilibrul dintre drepturi \u0219i obliga\u021bii trebuie men\u021binut prin respectarea legii. Instruirea obligatorie pentru a putea presta activitatea legal nu poate deveni o povar\u0103 financiar\u0103 pentru angajat.
