De\u0219i poate p\u0103rea un instrument flexibil pentru acoperirea unor nevoi temporare ale angajatorului, regimul juridic aplicabil este strict \u0219i urm\u0103re\u0219te \u00een primul r\u00e2nd <\/span><b>protejarea s\u0103n\u0103t\u0103\u021bii \u0219i echilibrului salaria\u021bilor<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2><b>Ce este munca suplimentar\u0103 conform Codului muncii?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Codul muncii define\u0219te, \u00een <\/span><a href=\"https:\/\/www.codulmuncii.ro\/titlul_3\/capitolul_1\/sectiunea_1\/art_112_1.html\"><span style=\"font-weight: 400;\">art. 112<\/span><\/a><span style=\"font-weight: 400;\"> \u0219i <\/span><a href=\"https:\/\/www.codulmuncii.ro\/art_120_1.html\"><span style=\"font-weight: 400;\">art. 120<\/span><\/a><span style=\"font-weight: 400;\">, munca suplimentar\u0103 ca fiind orice activitate prestat\u0103 <\/span><b>peste durata normal\u0103 de lucru<\/b><span style=\"font-weight: 400;\">, adic\u0103 peste 8 ore pe zi sau 40 de ore pe s\u0103pt\u0103m\u00e2n\u0103 pentru salaria\u021bii cu norm\u0103 \u00eentreag\u0103. <\/span><b>Ini\u021biativa apar\u021bine exclusiv angajatorului<\/b><span style=\"font-weight: 400;\">, iar aceasta trebuie s\u0103 fie justificat\u0103 prin nevoi obiective \u2013 cum ar fi cre\u0219terea temporar\u0103 a volumului de munc\u0103 sau \u00eenlocuirea unui coleg indisponibil.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Importan\u021ba acestui aspect pentru profesioni\u0219tii \u00een <\/span><a href=\"https:\/\/www.lugera.ro\/servicii\/payroll-si-administrare-personal\/\"><b>payroll<\/b><\/a><span style=\"font-weight: 400;\"> este major\u0103, \u00eentruc\u00e2t orice or\u0103 suplimentar\u0103 trebuie corect eviden\u021biat\u0103 \u0219i compensat\u0103 conform legii.<\/span><\/p>\n<h2><b>Acordul salariatului \u2013 condi\u021bie esen\u021bial\u0103<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Conform <\/span><a href=\"https:\/\/www.codulmuncii.ro\/titlul_3\/capitolul_1\/sectiunea_2\/art_121_1.html\"><span style=\"font-weight: 400;\">art. 121<\/span><\/a><span style=\"font-weight: 400;\"> alin. (1), <\/span><b>munca suplimentar\u0103 poate fi prestat\u0103 doar cu acordul expres al salariatului<\/b><span style=\"font-weight: 400;\">. Angajatorul nu poate impune unilateral prelungirea programului \u00een condi\u021bii normale. Excep\u021bie fac doar situa\u021biile prev\u0103zute de art. 120 alin. (2), respectiv:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">cazuri de for\u021b\u0103 major\u0103;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">interven\u021bii pentru prevenirea sau \u00eenl\u0103turarea unor accidente.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Orice acord general pentru munc\u0103 suplimentar\u0103, dat de salariat \u00een prealabil, este <\/span><b>nul de drept<\/b><span style=\"font-weight: 400;\">. Refuzul de a presta munc\u0103 suplimentar\u0103 nu poate atrage sanc\u021biuni disciplinare.<\/span><\/p>\n<h2><b>Limitele legale ale muncii suplimentare<\/b><\/h2>\n<p><a href=\"https:\/\/www.codulmuncii.ro\/titlul_3\/capitolul_1\/sectiunea_1\/art_114_1.html\"><span style=\"font-weight: 400;\">Art. 114<\/span><\/a><span style=\"font-weight: 400;\"> Codul muncii stabile\u0219te o limit\u0103 clar\u0103: <\/span><b>durata maxim\u0103 a muncii, inclusiv orele suplimentare, nu poate dep\u0103\u0219i 48 de ore pe s\u0103pt\u0103m\u00e2n\u0103<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dep\u0103\u0219irea acestui prag este permis\u0103 doar \u00een condi\u021bii excep\u021bionale, cu condi\u021bia ca <\/span><b>media orelor lucrate, \u00eentr-o perioad\u0103 de maximum 4 luni, s\u0103 nu dep\u0103\u0219easc\u0103 48 ore pe s\u0103pt\u0103m\u00e2n\u0103<\/b><span style=\"font-weight: 400;\">. Aceast\u0103 excep\u021bie trebuie aplicat\u0103 cu pruden\u021b\u0103 \u0219i justificat\u0103 documentar.<\/span><\/p>\n<h2><b>Interdic\u021bii privind munca suplimentar\u0103<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Exist\u0103 categorii de salaria\u021bi care <\/span><b>nu pot presta legal munc\u0103 suplimentar\u0103<\/b><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Tinerii sub 18 ani<\/b><span style=\"font-weight: 400;\"> (art. 122 alin. 2);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Alte categorii pot beneficia de protec\u021bie special\u0103 \u00een func\u021bie de prevederile contractelor colective sau individuale.<\/span><\/li>\n<\/ul>\n<h2><b>Cum se compenseaz\u0103 munca suplimentar\u0103?<\/b><\/h2>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/06\/cum-se-compenseaza-munca-suplimentara.jpg\"><img decoding=\"async\" class=\"aligncenter wp-image-8789 size-full lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/06\/cum-se-compenseaza-munca-suplimentara.jpg\" alt=\"Cum se compenseaz\u0103 munca suplimentar\u0103\" width=\"1000\" height=\"659\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/06\/cum-se-compenseaza-munca-suplimentara.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/06\/cum-se-compenseaza-munca-suplimentara-300x198.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/06\/cum-se-compenseaza-munca-suplimentara-768x506.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/659;\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">Codul muncii impune o ordine clar\u0103 a compens\u0103rii:<\/span><\/p>\n<ol>\n<li><b> Compensarea cu timp liber pl\u0103tit \u2013 solu\u021bia prioritar\u0103<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Conform art. 122 alin. (1), angajatorul este obligat s\u0103 acorde <\/span><b>timp liber pl\u0103tit \u00een termen de 90 de zile calendaristice<\/b><span style=\"font-weight: 400;\"> de la efectuarea muncii suplimentare. Aceasta este forma standard de compensare \u0219i reflect\u0103 scopul legii de a proteja s\u0103n\u0103tatea angajatului.<\/span><\/p>\n<ol start=\"2\">\n<li><b> Spor salarial \u2013 doar \u00een subsidiar<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Dac\u0103 acordarea timpului liber nu este posibil\u0103 \u00een termenul legal, se aplic\u0103 art. 123: munca suplimentar\u0103 se pl\u0103te\u0219te cu <\/span><b>un spor de minimum 75% din salariul de baz\u0103<\/b><span style=\"font-weight: 400;\"> pentru fiecare or\u0103 lucrat\u0103 suplimentar.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Este important de re\u021binut c\u0103 acest spor nu poate fi \u00eenlocuit cu alte forme de compensa\u021bie, cum ar fi tichetele de mas\u0103. De asemenea, plata acestuia se face <\/span><b>\u00een luna urm\u0103toare expir\u0103rii celor 90 de zile<\/b><span style=\"font-weight: 400;\">, nu imediat dup\u0103 efectuarea muncii, de\u0219i \u00een practic\u0103 se fac deseori derog\u0103ri.<\/span><\/p>\n<h2><b>Obliga\u021bia de eviden\u021b\u0103 a orelor suplimentare<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Potrivit <\/span><a href=\"https:\/\/www.codulmuncii.ro\/art_119_1.html\"><span style=\"font-weight: 400;\">art. 119<\/span><\/a><span style=\"font-weight: 400;\"> din Codul muncii, angajatorul are obliga\u021bia s\u0103 \u021bin\u0103 <\/span><b>o eviden\u021b\u0103 clar\u0103 a orelor de munc\u0103 efectuate de fiecare salariat<\/b><span style=\"font-weight: 400;\">, incluz\u00e2nd:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">ora de \u00eenceput;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">ora de final;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">orele suplimentare efectuate.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Aceast\u0103 eviden\u021b\u0103 este esen\u021bial\u0103 at\u00e2t pentru conformitatea legal\u0103, c\u00e2t \u0219i pentru calculul corect \u00een sistemul de salarizare (<\/span><b>payroll<\/b><span style=\"font-weight: 400;\">).<\/span><\/p>\n<h2><b>Concluzii<\/b><\/h2>\n<p><b>Munca suplimentar\u0103, \u00een lumina Codului muncii, este o excep\u021bie, nu o regul\u0103.<\/b><span style=\"font-weight: 400;\"> Ea poate fi utilizat\u0103 doar \u00een condi\u021biile \u0219i limitele prev\u0103zute de lege, cu acordul salariatului \u0219i compensat\u0103 \u00een mod echitabil.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Din perspectiva unui specialist payroll, monitorizarea atent\u0103, documentarea corespunz\u0103toare \u0219i aplicarea fidel\u0103 a prevederilor legale sunt esen\u021biale pentru a evita riscuri legale \u0219i sanc\u021biuni.
