Conform acesteia, prelungirea posibil\u0103 dup\u0103 atingerea v\u00e2rstei de pensionare pentru func\u021bionarii publici trebuie s\u0103 aib\u0103 durata fix\u0103 de un an. A\u0219adar, o men\u021binere \u00een func\u021bie pe o perioad\u0103 mai scurt\u0103, precum \u0219ase luni, nu este conform\u0103 cu legea.<\/span><\/p>\n<h2><b>Ce spune Codul administrativ despre pensionare \u0219i prelungirea activit\u0103\u021bii<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Raportul de serviciu al func\u021bionarilor publici \u00eenceteaz\u0103 de drept la data \u00eendeplinirii cumulative a condi\u021biilor legale pentru pensionare \u2013 v\u00e2rsta standard \u0219i stagiul minim de cotizare. Totu\u0219i, Codul administrativ (<\/span><a href=\"about:blank\"><span style=\"font-weight: 400;\">OUG nr. 57\/2019<\/span><\/a><span style=\"font-weight: 400;\">) permite, \u00een mod excep\u021bional, ca ace\u0219tia s\u0103 solicite men\u021binerea \u00een func\u021bie pentru maximum trei ani, cu <\/span><b>prelungiri anuale<\/b><span style=\"font-weight: 400;\">, \u00een baza unei cereri formulate cu dou\u0103 luni \u00eenainte de pensionare \u0219i cu aprobarea conducerii institu\u021biei publice.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00centrebarea ridicat\u0103 \u00een practic\u0103 a fost dac\u0103 aceste prelungiri pot avea o durat\u0103 mai scurt\u0103 de un an, \u00een func\u021bie de decizia conduc\u0103torului institu\u021biei, sau dac\u0103 un an este perioada minim\u0103 obligatorie.<\/span><\/p>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/04\/pensionare-functionari-publici.jpg\"><img decoding=\"async\" class=\"aligncenter wp-image-8720 size-full lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/04\/pensionare-functionari-publici.jpg\" alt=\"pensionare functionari publici\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/04\/pensionare-functionari-publici.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/04\/pensionare-functionari-publici-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/04\/pensionare-functionari-publici-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/p>\n<h2><b>Ce a decis ICCJ?\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Prin Decizia pronun\u021bat\u0103 \u00een data de 29 aprilie 2024, ICCJ a stabilit f\u0103r\u0103 echivoc c\u0103 <\/span><b>prelungirea anual\u0103 a raportului de serviciu este obligatoriu de un an \u00eentreg<\/b><span style=\"font-weight: 400;\">, nefiind permis\u0103 acordarea unei durate mai scurte.<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">\u201eDispozi\u021biile art. 517 alin. (2) din Codul administrativ se interpreteaz\u0103 \u00een sensul c\u0103 durata prelungirii este de un an\u201d<\/span><\/i><span style=\"font-weight: 400;\">, a statuat completul pentru dezlegarea unor chestiuni de drept al ICCJ.<\/span><\/p>\n<h2><b>Contextul spe\u021bei: prelungire de doar \u0219ase luni, considerat\u0103 abuziv\u0103<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Litigiul a pornit de la solicitarea unui comisar-\u0219ef care, la atingerea v\u00e2rstei de pensionare, a cerut s\u0103 fie men\u021binut \u00een func\u021bie conform legii. Institu\u021bia i-a aprobat doar o prelungire de \u0219ase luni, consider\u00e2nd c\u0103 are discre\u021bia de a stabili perioada. Func\u021bionarul a atacat decizia \u00een instan\u021b\u0103, sus\u021bin\u00e2nd c\u0103 prelungirea anual\u0103 prev\u0103zut\u0103 de Codul administrativ \u00eenseamn\u0103 un drept la men\u021binerea pentru un an \u00eentreg, nu mai pu\u021bin.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Prima instan\u021b\u0103 i-a respins cererea, dar curtea de apel a considerat c\u0103 este necesar\u0103 o interpretare oficial\u0103 a expresiei \u201eprelungire anual\u0103\u201d \u0219i a sesizat ICCJ.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hot\u0103r\u00e2rea definitiv\u0103 a \u00cenaltei Cur\u021bi pune cap\u0103t oric\u0103rei controverse: expresia <\/span><i><span style=\"font-weight: 400;\">\u201eprelungire anual\u0103\u201d<\/span><\/i><span style=\"font-weight: 400;\"> are sensul de durat\u0103 fix\u0103 de un an, nu de perioad\u0103 flexibil\u0103 care are loc o dat\u0103 pe an.<\/span><\/p>\n<h2><b>Ce \u00eenseamn\u0103 aceast\u0103 decizie pentru institu\u021biile publice?\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Aceast\u0103 decizie va produce efecte \u00een toate cazurile similare, devenind un reper obligatoriu pentru instan\u021be \u0219i autorit\u0103\u021bi. Institu\u021biile publice nu mai pot acorda prelungiri mai scurte de un an pentru func\u021bionarii afla\u021bi \u00een aceast\u0103 situa\u021bie, iar func\u021bionarii care primesc o decizie contrar\u0103 pot invoca hot\u0103r\u00e2rea ICCJ \u00een instan\u021b\u0103.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Este important de subliniat c\u0103, de\u0219i <\/span><a href=\"https:\/\/www.lugera.ro\/blog\/legea-pensiilor-flexibilitate-la-varsta-pensionarii-continuarea-activitatii-profesionale-pana-la-70-de-ani-sub-reglementarea-legii-nr-360-2023\/\"><span style=\"font-weight: 400;\">legea<\/span><\/a><span style=\"font-weight: 400;\"> permite maximum trei ani de men\u021binere, ace\u0219tia pot fi ob\u021binu\u021bi doar prin solicit\u0103ri \u0219i aprob\u0103ri anuale.<\/span><\/p>\n<h2><b>Ce se \u00eent\u00e2mpl\u0103 dac\u0103 func\u021bionarul opteaz\u0103 pentru suspendarea pensiei?\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">\u00cenalta Curte a clarificat \u00eentr-un alt context c\u0103, odat\u0103 ce raportul de serviciu a \u00eencetat prin pensionare, nu mai poate fi reactivat doar prin renun\u021barea ulterioar\u0103 la pensie. A\u0219adar, solicitarea de suspendare a pl\u0103\u021bii pensiei nu are efect asupra \u00eencet\u0103rii raportului de serviciu.<\/span><\/p>\n<h2><b>Un aspect util pentru departamentele de HR \u0219i payroll din sectorul public<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Implementarea acestei decizii \u00een practic\u0103 implic\u0103, pentru institu\u021biile publice, actualizarea procedurilor de gestionare a resurselor umane \u0219i a raport\u0103rilor administrative, inclusiv \u00een sistemele de salarizare \u0219i \u00een eviden\u021bele Reges-Online. Departamentele de HR trebuie s\u0103 se asigure c\u0103 orice decizie de prelungire este \u00eenregistrat\u0103 cu durata corect\u0103, iar payroll-ul trebuie s\u0103 urm\u0103reasc\u0103 derularea drepturilor salariale asociate acestor prelungiri, f\u0103r\u0103 \u00eentreruperi nejustificate.<\/span><\/p>\n<p><b>Aten\u021bie!<\/b><span style=\"font-weight: 400;\"> Aceast\u0103 posibilitate de <\/span><b>prelungire anual\u0103 a raportului de serviciu peste v\u00e2rsta standard de pensionare<\/b><span style=\"font-weight: 400;\"> se aplic\u0103 <\/span><b>exclusiv func\u021bionarilor publici<\/b><span style=\"font-weight: 400;\">, adic\u0103 personalului angajat \u00een baza unui <\/span><b>raport de serviciu<\/b><span style=\"font-weight: 400;\">, conform <\/span><b>Codului administrativ (OUG nr. 57\/2019)<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pentru <\/span><b>salaria\u021bii din sectorul privat sau din alte categorii profesionale angajate prin contract individual de munc\u0103 (CIM)<\/b><span style=\"font-weight: 400;\">, situa\u021bia este diferit\u0103:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00cen dreptul muncii, <\/span><b>contractul nu \u00eenceteaz\u0103 automat<\/b><span style=\"font-weight: 400;\"> la \u00eemplinirea v\u00e2rstei standard de pensionare. Angajatul poate continua activitatea dac\u0103 nu solicit\u0103 deschiderea dreptului la pensie \u0219i dac\u0103 ambele p\u0103r\u021bi sunt de acord.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Exist\u0103, totu\u0219i, posibilitatea angajatorului de a <\/span><b>\u00eenceta raportul de munc\u0103 de drept<\/b><span style=\"font-weight: 400;\"> conform art. 56 alin. (1) lit. c) din Codul muncii, atunci c\u00e2nd angajatul \u00eendepline\u0219te <\/span><b>cumulativ<\/b><span style=\"font-weight: 400;\"> condi\u021biile de v\u00e2rst\u0103 \u0219i stagiu minim pentru pensionare \u0219i ob\u021bine pensia.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Pe scurt: <\/span><b>Prelungirea anual\u0103, \u00een form\u0103 reglementat\u0103 \u0219i limitat\u0103<\/b><span style=\"font-weight: 400;\">, este o facilitate <\/span><b>specific\u0103 exclusiv administra\u021biei publice<\/b><span style=\"font-weight: 400;\"> \u0219i nu are corespondent direct \u00een sectorul privat.<\/span><\/p>\n<h2><b>\u00centreb\u0103ri frecvente despre prelungirea raportului de serviciu dup\u0103 pensionare<\/b><\/h2>\n<ol>\n<li><b> Poate fi acordat\u0103 prelungirea raportului de serviciu pentru o perioad\u0103 mai mic\u0103 de un an?<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Nu. Potrivit deciziei ICCJ, \u201eprelungirea anual\u0103\u201d prev\u0103zut\u0103 de Codul administrativ \u00eenseamn\u0103 o durat\u0103 fix\u0103 de un an. Orice perioad\u0103 mai scurt\u0103 este nelegal\u0103, chiar dac\u0103 este aprobat\u0103 de conduc\u0103torul institu\u021biei publice.<\/span><\/p>\n<ol start=\"2\">\n<li><b> C\u00e2\u021bi ani poate fi prelungit raportul de serviciu peste v\u00e2rsta de pensionare?<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Maximum 3 ani, prin prelungiri anuale succesive. Fiecare prelungire se face pe o durat\u0103 de un an \u0219i necesit\u0103 cerere individual\u0103 \u0219i aprobare din partea conducerii institu\u021biei.<\/span><\/p>\n<ol start=\"3\">\n<li><b> Este func\u021bionarul public obligat s\u0103 se pensioneze la \u00eemplinirea v\u00e2rstei legale?<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">\u00cen principiu, da \u2013 raportul de serviciu \u00eenceteaz\u0103 de drept. Totu\u0219i, \u00een baza unei cereri, func\u021bionarul poate fi men\u021binut \u00een func\u021bie pentru o perioad\u0103 de p\u00e2n\u0103 la 3 ani, dac\u0103 cererea este depus\u0103 cu cel pu\u021bin dou\u0103 luni \u00eenainte de data pension\u0103rii \u0219i este aprobat\u0103 de institu\u021bie.<\/span><\/p>\n<ol start=\"4\">\n<li><b> Ce se \u00eent\u00e2mpl\u0103 dac\u0103 un func\u021bionar solicit\u0103 suspendarea pensiei dup\u0103 ce a fost pensionat?<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Suspendarea ulterioar\u0103 a pensiei nu reactiveaz\u0103 raportul de serviciu. \u00cenalta Curte a stabilit c\u0103 \u00eencetarea raportului de serviciu se produce automat \u0219i nu poate fi anulat\u0103 prin renun\u021barea ulterioar\u0103 la pensie.<\/span><\/p>\n<ol start=\"5\">\n<li><b> Cine este responsabil cu actualizarea documentelor \u0219i raportarea \u00een sistemele oficiale?<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Departamentele de resurse umane \u0219i salarizare (<\/span><a href=\"https:\/\/www.lugera.ro\/servicii\/payroll-si-administrare-personal\/\"><span style=\"font-weight: 400;\">payroll<\/span><\/a><span style=\"font-weight: 400;\">) trebuie s\u0103 asigure corecta gestionare a documentelor de prelungire \u0219i actualizarea acestora \u00een sistemele interne \u0219i \u00een Reges-Online, \u00een conformitate cu HG 295\/2025.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>Surs\u0103 foto: shutterstock.com<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00cenalta Curte de Casa\u021bie \u0219i Justi\u021bie (ICCJ) a clarificat, printr-o hot\u0103r\u00e2re definitiv\u0103 pronun\u021bat\u0103 recent, interpretarea sintagmei \u201eprelungirea anual\u0103 a raportului de serviciu\u201d prev\u0103zut\u0103 de Codul administrativ.
