Suspendarea automat\u0103 (de drept)\u00a0<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Aceasta intervine \u00een mod obligatoriu, f\u0103r\u0103 a fi necesar acordul prealabil al p\u0103r\u021bilor. C\u00e2teva exemple:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">concediu medical pentru incapacitate temporar\u0103 de munc\u0103;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">concediu de maternitate sau risc maternal;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">concediu pentru \u00eengrijitor sau urgen\u021be familiale;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">carantin\u0103;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">exercitarea unui mandat public (executiv, legislativ sau judiciar);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">func\u021bie sindical\u0103 remunerat\u0103;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">arest preventiv (conform <\/span><a href=\"https:\/\/lege5.ro\/Gratuit\/geztkobvha\/codul-de-procedura-penala-din-2010\"><span style=\"font-weight: 400;\">Codului de procedur\u0103 penal\u0103<\/span><\/a><span style=\"font-weight: 400;\">);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">for\u021b\u0103 major\u0103;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">expirarea valabilit\u0103\u021bii documentelor necesare exercit\u0103rii profesiei.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u00cen toate aceste situa\u021bii, salariatul \u00ee\u0219i p\u0103streaz\u0103 vechimea \u00een munc\u0103, iar drepturile dob\u00e2ndite anterior r\u0103m\u00e2n valabile.<\/span><\/p>\n<p><strong>2. Suspendarea prin consim\u021b\u0103m\u00e2nt reciproc<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Aceasta presupune acordul expres al angajatorului \u0219i al salariatului, fiind adesea utilizat\u0103 \u00een<\/span> <span style=\"font-weight: 400;\">urm\u0103toarele cazuri:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">concediu f\u0103r\u0103 plat\u0103 (pentru motive personale sau studii);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">alte motive agreate contractual.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Important: perioada de concediu f\u0103r\u0103 plat\u0103 nu contribuie la calculul vechimii \u00een munc\u0103.<\/span><\/p>\n<p><strong>3. Suspendarea CIM la ini\u021biativa angajatului<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Salariatul poate solicita suspendarea contractului pentru:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">concediu de cre\u0219tere a copilului;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">concediu de \u00eengrijire a copilului bolnav;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">concediu paternal;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">concediu de acomodare (adop\u021bie);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">formare profesional\u0103;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">exercitarea de func\u021bii elective;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">participare la grev\u0103;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">desf\u0103\u0219urarea activit\u0103\u021bii ca asistent maternal, personal sau profesionist.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Toate aceste situa\u021bii impun angajatorului obliga\u021bia de a \u00eenregistra suspendarea \u00een <\/span><a href=\"https:\/\/www.lugera.ro\/blog\/reges-online-tot-ce-trebuie-sa-stie-angajatorii\/\"><span style=\"font-weight: 400;\">Reges-Online<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><strong>4. Suspendarea la decizia angajatorului<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Codul muncii permite angajatorului s\u0103 suspende CIM \u00een cazuri precum:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">reducerea sau \u00eentreruperea temporar\u0103 a activit\u0103\u021bii din motive obiective;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">deta\u0219area salariatului;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">restric\u021bii judiciare care \u00eempiedic\u0103 desf\u0103\u0219urarea muncii (control judiciar, arest la domiciliu);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">formularea unei pl\u00e2ngeri penale \u00eempotriva salariatului;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">suspendarea documentelor profesionale necesare;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">starea de urgen\u021b\u0103 sau alte situa\u021bii excep\u021bionale.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u00cen cazurile imputabile salariatului, acesta pierde orice drept salarial pe durata suspend\u0103rii.<\/span><\/p>\n<h2><b>Efectele juridice ale suspend\u0103rii CIM<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Suspendarea contractului implic\u0103:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">oprirea temporar\u0103 a dreptului la salariu \u0219i obliga\u021biei de prestare a muncii;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">imposibilitatea modific\u0103rii contractului, cu excep\u021bia \u00eencet\u0103rii de drept;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">suspendarea termenelor legale, inclusiv a celor de preaviz.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Exemplu: Un salariat aflat \u00een perioada de preaviz intr\u0103 \u00een concediu medical. Perioada de preaviz se suspend\u0103 \u0219i se reia dup\u0103 revenirea la serviciu.<\/span><\/p>\n<h2><b>Obliga\u021bii de raportare \u00een Reges-Online<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Conform <\/span><a href=\"https:\/\/legislatie.just.ro\/public\/DetaliiDocument\/295995\"><span style=\"font-weight: 400;\">HG 295\/2025<\/span><\/a><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">suspendarea CIM trebuie raportat\u0103 \u00een registru \u00een maximum 3 zile lucr\u0103toare de la documentul justificativ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00eencetarea suspend\u0103rii se transmite anterior relu\u0103rii activit\u0103\u021bii.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Nerespectarea acestor termene atrage amenzi \u00eentre 3.000 \u0219i 5.000 lei.<\/span><\/p>\n<h2><b>Impactul asupra departamentului de payroll<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Suspendarea contractului de munc\u0103 are implica\u021bii directe asupra calculului salarial, ceea ce face esen\u021bial\u0103 colaborarea str\u00e2ns\u0103 \u00eentre departamentul de resurse umane \u0219i cel de <\/span><a href=\"https:\/\/www.lugera.ro\/servicii\/payroll-si-administrare-personal\/\"><span style=\"font-weight: 400;\">payroll<\/span><\/a><span style=\"font-weight: 400;\">. \u00centreruperea obliga\u021biei de plat\u0103 a salariului \u0219i eviden\u021bierea corect\u0103 a perioadei de suspendare \u00een flutura\u0219ii de salariu necesit\u0103 actualiz\u0103ri precise \u00een sistemele de salarizare. Mai mult, \u00een cazul indemniza\u021biilor de concediu medical sau de cre\u0219tere a copilului, departamentul de payroll trebuie s\u0103 gestioneze corect raportarea \u00een <\/span><a href=\"https:\/\/www.lugera.ro\/blog\/actualizarile-formularului-d112-aduse-de-ordinul-anaf-723-2024\/\"><span style=\"font-weight: 400;\">Declara\u021bia 112<\/span><\/a><span style=\"font-weight: 400;\"> \u0219i respectarea termenelor de plat\u0103, \u00een conformitate cu reglement\u0103rile \u00een vigoare.<\/span><\/p>\n<h2><b>Concluzie<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Suspendarea contractului de munc\u0103 este un instrument legal ce permite ajustarea rela\u021biei de munc\u0103 \u00een func\u021bie de realit\u0103\u021bile individuale \u0219i organiza\u021bionale. Cunoa\u0219terea situa\u021biilor \u00een care poate fi aplicat\u0103, precum \u0219i a obliga\u021biilor administrative aferente, este esen\u021bial\u0103 pentru angajatori \u0219i salaria\u021bi,
