De\u0219i baza legal\u0103 privind acordarea \u0219i plata concediilor medicale r\u0103m\u00e2ne \u00een continuare <\/span><a href=\"https:\/\/legislatie.just.ro\/public\/DetaliiDocument\/66305\"><span style=\"font-weight: 400;\">OUG 158\/2005<\/span><\/a><span style=\"font-weight: 400;\">, introducerea Reges-Online a impus o serie de noi obliga\u021bii administrative, cu termene stricte \u0219i responsabilit\u0103\u021bi clar delimitate pentru angajatori. \u00cen acest context, gestionarea corect\u0103 a concediilor nu este doar o cerin\u021b\u0103 procedural\u0103, ci \u0219i un factor esen\u021bial \u00een evitarea sanc\u021biunilor \u0219i \u00een men\u021binerea conformit\u0103\u021bii organiza\u021bionale.<\/span><\/p>\n<h2><b>Baza legal\u0103 a concediilor medicale<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Concediile medicale sunt reglementate prin:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>OUG 158\/2005<\/b><span style=\"font-weight: 400;\"> \u2013 stabile\u0219te condi\u021biile de acordare \u0219i calcul al indemniza\u021biilor;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Codul muncii<\/b><span style=\"font-weight: 400;\"> (Legea 53\/2003) \u2013 prevede c\u0103 incapacitatea temporar\u0103 de munc\u0103 reprezint\u0103 o cauz\u0103 legal\u0103 de suspendare a contractului individual de munc\u0103 (CIM);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>HG 295\/2025<\/b><span style=\"font-weight: 400;\"> \u2013 introduce obliga\u021bia explicit\u0103 de raportare a suspend\u0103rilor \u00een Reges-Online.<\/span><\/li>\n<\/ul>\n<h2><b>Obliga\u021biile angajatorului \u00een Reges-Online<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Conform HG 295\/2025, angajatorii trebuie s\u0103:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00eenregistreze <\/span><b>suspendarea CIM<\/b><span style=\"font-weight: 400;\"> cauzat\u0103 de concediul medical \u00een termen de <\/span><b>3 zile lucr\u0103toare<\/b><span style=\"font-weight: 400;\"> de la primirea certificatului;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">opereze <\/span><b>\u00eencetarea suspend\u0103rii<\/b><span style=\"font-weight: 400;\"> \u00een sistem, de regul\u0103 cu <\/span><b>o zi \u00eenainte<\/b><span style=\"font-weight: 400;\"> de reluarea activit\u0103\u021bii, de\u0219i textul normativ nu ofer\u0103 un termen expres \u0219i poate genera interpret\u0103ri divergente;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">p\u0103streze eviden\u021ba complet\u0103 \u0219i corect\u0103 a documenta\u021biei medicale, cu accent pe termenul de transmitere \u0219i verificarea exact\u0103 a datelor \u00eenscrise.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Neconformitatea cu aceste obliga\u021bii poate atrage <\/span><b>sanc\u021biuni contraven\u021bionale<\/b><span style=\"font-weight: 400;\">. --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/p>\n<h2><b>Pa\u0219ii esen\u021biali \u00een gestionarea concediului medical<\/b><\/h2>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Notificarea angajatorului<\/b><span style=\"font-weight: 400;\"> \u2013 Salariatul trebuie s\u0103 anun\u021be incapacitatea de munc\u0103 c\u00e2t mai cur\u00e2nd, preferabil prin canale rapide (email, telefon).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Depunerea certificatului medical<\/b><span style=\"font-weight: 400;\"> \u2013 Conform normelor OUG 158\/2005, certificatul trebuie transmis p\u00e2n\u0103 la data de 5 a lunii urm\u0103toare celei pentru care a fost emis.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Verificarea certificatului<\/b><span style=\"font-weight: 400;\"> \u2013 HR sau persoana responsabil\u0103 verific\u0103 datele de identificare, perioada concediului, codul de diagnostic, codul indemniza\u021biei, semn\u0103tura \u0219i parafa medicului.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Operarea suspend\u0103rii \u00een <\/b><a href=\"https:\/\/www.lugera.ro\/blog\/reges-online-tot-ce-trebuie-sa-stie-angajatorii\/\"><b>Reges-Online<\/b><\/a><span style=\"font-weight: 400;\"> \u2013 Suspendarea CIM este raportat\u0103 \u00een termenul legal.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Raportarea \u00eencet\u0103rii suspend\u0103rii<\/b><span style=\"font-weight: 400;\"> \u2013 La revenirea angajatului, \u00eencetarea suspend\u0103rii se \u00eenregistreaz\u0103, \u00een lipsa unui termen expres, cu o zi \u00eenainte de reluarea activit\u0103\u021bii, conform regulii generale.<\/span><\/li>\n<\/ol>\n<h2><b>Ce trebuie s\u0103 \u0219tie salaria\u021bii<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Au dreptul la concediu medical dac\u0103 sunt asigura\u021bi \u0219i ob\u021bin un certificat medical valid;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Trebuie s\u0103 notifice angajatorul f\u0103r\u0103 \u00eent\u00e2rziere;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">S\u0103 respecte termenul de predare a certificatului pentru a evita \u00eent\u00e2rzierea pl\u0103\u021bii indemniza\u021biei;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">S\u0103 verifice corectitudinea datelor personale transmise \u00een sistem;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">S\u0103 cunoasc\u0103 diferen\u021ba \u00eentre salariu \u0219i indemniza\u021bie: pe durata concediului medical nu se acord\u0103 salariu, ci o indemniza\u021bie de asigur\u0103ri sociale propor\u021bional\u0103 cu diagnosticul \u0219i tipul concediului.<\/span><\/li>\n<\/ul>\n<h2><b>Recomand\u0103ri pentru angajatori<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Implementarea unui <\/span><b>flux intern documentat<\/b><span style=\"font-weight: 400;\">, care s\u0103 includ\u0103 toate etapele de gestionare a concediilor medicale;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Instruirea personalului administrativ cu privire la <\/span><b>termenele de raportare \u00een Reges-Online<\/b><span style=\"font-weight: 400;\">;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00cencheierea de <\/span><b>contracte de externalizare HR\/<\/b><a href=\"https:\/\/www.lugera.ro\/servicii\/payroll-si-administrare-personal\/\"><b>payroll<\/b><\/a><span style=\"font-weight: 400;\"> care s\u0103 prevad\u0103 \u00een mod explicit obliga\u021bia prestatorului de a comunica rapid evenimentele ce \u021bin de suspendarea \u0219i reluarea activit\u0103\u021bii;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Utilizarea unui sistem informatic integrat care s\u0103 permit\u0103 corelarea cu cerin\u021bele Reges-Online \u0219i generarea automat\u0103 de notific\u0103ri pentru termene-limit\u0103.<\/span><\/li>\n<\/ul>\n<h2><b>Concluzie<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">HG 295\/2025 nu modific\u0103 \u00een sine regimul medical al concediilor, dar creeaz\u0103 un nou cadru procedural, mai strict, pentru angajatori.
