Cadrul legal existent protejeaz\u0103 angaja\u021bii \u0219i oblig\u0103 angajatorii s\u0103 adopte m\u0103suri clare pentru prevenirea \u0219i combaterea h\u0103r\u021buirii la locul de munc\u0103.<\/p>\n<h2><strong>Ce este h\u0103r\u021buirea la locul de munc\u0103 \u0219i cum o recuno\u0219tem?<\/strong><\/h2>\n<p>Conform Codului Muncii \u0219i <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/275395\">Hot\u0103r\u00e2rii de Guvern nr. 970\/2023<\/a>, h\u0103r\u021buirea este un comportament nedorit, manifestat verbal, fizic sau nonverbal, care are ca scop ori efect umilirea, intimidarea sau excluderea unei persoane. Aceasta poate fi de natur\u0103 sexual\u0103 (avansuri, remarci, gesturi sugestive) sau moral\u0103 (marginalizare, critici nejustificate, excludere sistematic\u0103, suprasolicitare inten\u021bionat\u0103).<\/p>\n<p><strong>Exemple frecvente de comportamente abuzive:<\/strong><\/p>\n<ul>\n<li>Comentarii despre aspectul fizic sau via\u021ba personal\u0103<\/li>\n<li>Glume sau remarci jignitoare repetate<\/li>\n<li>Atingeri neconsim\u021bite sau gesturi sugestive<\/li>\n<li>E-mailuri sau mesaje cu con\u021binut ofensator<\/li>\n<li>Excluderea deliberat\u0103 din activit\u0103\u021bi de echip\u0103<\/li>\n<li>Atribuirea excesiv\u0103 de sarcini ca form\u0103 de presiune psihologic\u0103<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/04\/ce-este-hartuirea-la-locul-de-munca-si-cum-o-recunostem.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-8653 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/04\/ce-este-hartuirea-la-locul-de-munca-si-cum-o-recunostem.jpg\" alt=\"Ce este h\u0103r\u021buirea la locul de munc\u0103 \u0219i cum o recuno\u0219tem\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/04\/ce-este-hartuirea-la-locul-de-munca-si-cum-o-recunostem.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/04\/ce-este-hartuirea-la-locul-de-munca-si-cum-o-recunostem-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/04\/ce-este-hartuirea-la-locul-de-munca-si-cum-o-recunostem-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/p>\n<h2><strong>Ce prevede legisla\u021bia \u00een vigoare \u0219i care sunt obliga\u021biile angajatorului?<\/strong><\/h2>\n<p>Conform HG 970\/2023, to\u021bi angajatorii, indiferent de domeniu sau dimensiune, trebuie s\u0103:<\/p>\n<ul>\n<li>Elaboreze o politic\u0103 anti-h\u0103r\u021buire clar\u0103 \u0219i accesibil\u0103 angaja\u021bilor;<\/li>\n<li>Informeze \u0219i instruiasc\u0103 anual echipele cu privire la prevenirea h\u0103r\u021buirii;<\/li>\n<li>Desemneze un responsabil sau o comisie care gestioneaz\u0103 sesiz\u0103rile;<\/li>\n<li>Asigure un mecanism de raportare confiden\u021bial \u0219i eficient.<\/li>\n<\/ul>\n<p>\u00cen companiile unde serviciile de <a href=\"https:\/\/www.lugera.ro\/servicii\/payroll-si-administrare-personal\/\">payroll<\/a> sunt externalizate sau gestionate centralizat, este esen\u021bial ca aceste echipe s\u0103 colaboreze str\u00e2ns cu HR-ul pentru a asigura aplicarea corect\u0103 a politicilor anti-h\u0103r\u021buire \u0219i pentru a gestiona situa\u021biile care pot afecta integritatea mediului de lucru.<\/p>\n<h2><strong>Cum poate reac\u021biona un angajat care se simte h\u0103r\u021buit?<\/strong><\/h2>\n<ol>\n<li><strong>Identificarea situa\u021biei:<\/strong> Angajatul trebuie s\u0103 \u00eencerce s\u0103 clarifice dac\u0103 a fost expus unui comportament care poate fi calificat drept h\u0103r\u021buire.<\/li>\n<li><strong>Sesizarea informal\u0103:<\/strong> Se recomand\u0103, acolo unde este posibil, o discu\u021bie direct\u0103 cu persoana care a avut un comportament inadecvat. Dac\u0103 acest lucru nu este posibil, se poate apela la superiorul ierarhic sau la reprezentantul desemnat.<\/li>\n<li><strong>Pl\u00e2ngerea formal\u0103:<\/strong> Poate fi transmis\u0103 scris (olograf sau electronic) sau verbal, urmat\u0103 de redactarea unui proces-verbal. Aceasta poate include documente, mesaje, martori etc.<\/li>\n<li><strong>Investiga\u021bia intern\u0103:<\/strong> Comisia sau responsabilul desemnat analizeaz\u0103 cazul, audiaz\u0103 p\u0103r\u021bile implicate \u0219i redacteaz\u0103 un raport de caz. Aceasta etap\u0103 trebuie finalizat\u0103 \u00een maximum 45 de zile lucr\u0103toare.<\/li>\n<li><strong>Solu\u021bionarea:<\/strong> Se propun m\u0103suri corective sau disciplinare, dac\u0103 este cazul. Angajatorii au datoria de a preveni, iar angaja\u021bii au dreptul s\u0103 fie respecta\u021bi.
