Poate regulamentul intern s\u0103 stabileasc\u0103 beneficii pentru angaja\u021bi?<\/strong><\/h2>\n<p>\u00cen multe companii, regulamentul intern include prevederi referitoare la acordarea unor beneficii, precum bonuri de mas\u0103, prime sau bonusuri. Totu\u0219i, conform <strong>Codului Muncii<\/strong> \u0219i <strong>Legii 367\/2022<\/strong>, beneficiile angaja\u021bilor <strong>nu pot fi stabilite unilateral<\/strong> de c\u0103tre angajator prin regulamentul intern. Acestea trebuie s\u0103 fie rezultatul unei negocieri colective sau individuale \u0219i incluse <strong>\u00een contractul individual sau colectiv de munc\u0103<\/strong>.<\/p>\n<h2><strong>Diferen\u021ba dintre regulamentul intern \u0219i contractul colectiv de munc\u0103 (CCM)<\/strong><\/h2>\n<p>&#x1f539; <strong>Regulamentul intern<\/strong> este un document intern al companiei, prin care angajatorul stabile\u0219te regulile de func\u021bionare a rela\u021biilor de munc\u0103. \u00cens\u0103 acesta <strong>nu poate modifica clauzele esen<\/strong><strong>\u021b<\/strong><strong>iale ale contractului individual de munc<\/strong><strong>\u0103<\/strong>, cum ar fi salariul sau beneficiile extrasalariale.<\/p>\n<p>&#x1f539; <strong>Contractul colectiv de munc<\/strong><strong>\u0103<\/strong><strong> (CCM)<\/strong> este rezultatul unei <strong>negocieri<\/strong> \u00eentre angajator \u0219i reprezentan\u021bii angaja\u021bilor (sindicat sau lucr\u0103tori desemna\u021bi). \u00cen acest document se stabilesc drepturi \u0219i obliga\u021bii, inclusiv <strong>beneficiile salariale<\/strong>, cum ar fi sporuri, prime sau bonuri de mas\u0103.<\/p>\n<p>&#x1f4e2; <em>Dac<\/em><em>\u0103<\/em><em> vrei s<\/em><em>\u0103<\/em><em> afli mai multe despre con<\/em><em>\u021b<\/em><em>inutul obligatoriu al regulamentului intern <\/em><em>\u0219<\/em><em>i modific<\/em><em>\u0103<\/em><em>rile aduse de Legea 283\/2022, cite<\/em><em>\u0219<\/em><em>te <a href=\"https:\/\/www.lugera.ro\/blog\/regulamentul-intern-trebuie-sa-includa-si-informatii-despre-preaviz-concediere-sau-demisie-precum-si-politica-generala-de-formare-profesionala-daca-este-cazul\/\">acest articol.<\/a><\/em><\/p>\n<h2><strong>Beneficiile incluse \u00een regulamentul intern sunt legale?<\/strong><\/h2>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/regulamentul-intern-trebuie-sa-includa-si-informatii-despre-preaviz-concediere-sau-demisie-precum-si-politica-generala-de-formare-profesionala-daca-este-cazul\/\" target=\"_blank\" rel=\"noopener\">Regulamentul intern<\/a> poate con\u021bine detalii despre beneficii, \u00eens\u0103 <strong>acestea trebuie s\u0103 fie deja stabilite prin contractul colectiv sau individual de munc\u0103<\/strong>. Nu este suficient ca ele s\u0103 fie men\u021bionate doar \u00een regulamentul intern, deoarece:<\/p>\n<p>&#x2714; <strong>Drepturile salariale trebuie negociate<\/strong> \u2013 Orice beneficiu financiar trebuie s\u0103 fie rezultatul unei <strong>negocieri colective<\/strong> sau individuale.<br \/>\n&#x2714; <strong>Regulamentul intern nu poate modifica contractele<\/strong> \u2013 Angajatorul <strong>nu poate introduce sau elimina unilateral beneficii<\/strong>, f\u0103r\u0103 acordul angaja\u021bilor.<br \/>\n&#x2714; <strong>Bonurile de mas\u0103 \u0219i alte beneficii trebuie incluse \u00een CCM<\/strong> \u2013 Dac\u0103 un contract colectiv de munc\u0103 este \u00een vigoare, acesta trebuie s\u0103 reglementeze \u0219i beneficiile oferite.<\/p>\n<h2><strong>Ce spune legisla\u021bia?<\/strong><\/h2>\n<p>&#x1f4dc; <strong>Codul Muncii \u2013 Art. 17 (3) <\/strong><strong>\u0219<\/strong><strong>i (4)<\/strong> \u2192 Drepturile salariale sunt esen\u021biale \u00een contractul de munc\u0103 \u0219i <strong>nu pot fi modificate prin acte interne ale angajatorului<\/strong>.<\/p>\n<p>&#x1f4dc; <strong>Legea 367\/2022 \u2013 Art. 229 (4)<\/strong> \u2192 Orice beneficii acordate angaja\u021bilor trebuie <strong>negociate<\/strong> \u00eempreun\u0103 cu sindicatele sau reprezentan\u021bii angaja\u021bilor.<\/p>\n<p>&#x1f4dc; <strong>HG 1045\/2018<\/strong> \u2192 Acordarea biletelor de valoare (ex. tichete de mas\u0103) trebuie reglementat\u0103 <strong>prin contractul colectiv de munc<\/strong><strong>\u0103<\/strong><strong>, nu prin regulamentul intern<\/strong>.<\/p>\n<h2><strong>Ce se \u00eent\u00e2mpl\u0103 dac\u0103 beneficiile sunt doar \u00een regulamentul intern?<\/strong><\/h2>\n<p>Dac\u0103 angajatorul stabile\u0219te unilateral beneficii prin regulamentul intern, exist\u0103 riscul ca acestea s\u0103 nu fie <strong>recunoscute legal<\/strong>. \u00cen cazul unui conflict de munc\u0103:<\/p>\n<p>&#x274c; <strong>Angaja\u021bii ar putea contesta \u00een instan\u021b\u0103 eliminarea unor beneficii<\/strong> dac\u0103 acestea nu sunt incluse \u00eentr-un contract colectiv sau individual.<br \/>\n&#x274c; <strong>Inspectoratele de munc\u0103 pot sanc\u021biona angajatorii<\/strong> care nu respect\u0103 prevederile privind negocierea drepturilor salariale.<br \/>\n&#x274c; <strong>Beneficiile stabilite doar prin regulamentul intern nu sunt garantate<\/strong> \u0219i pot fi eliminate oric\u00e2nd de angajator.<\/p>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/03\/regulament-intern-beneficii_ce-se-intampla-daca-beneficiile-sunt-doar-in-regulamentul-intern.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-8617 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2025\/03\/regulament-intern-beneficii_ce-se-intampla-daca-beneficiile-sunt-doar-in-regulamentul-intern.jpg\" alt=\"Regulament intern beneficii.
