Pot ap\u0103rea situa\u021bii \u00een care angajatorii trebuie s\u0103 rotunjeasc\u0103 acest procent \u00een sus, pentru a respecta cerin\u021bele legale.<\/p>\n<p>Spre exemplu, dac\u0103 o companie are \u00een medie 62 de angaja\u021bi, procentul de 4% \u00eenseamn\u0103 2,48 persoane. Deoarece legea impune cel pu\u021bin 4%, angajatorul trebuie s\u0103 angajeze trei persoane cu handicap, pentru a nu risca o interpretare eronat\u0103 a obliga\u021biei.<\/p>\n<h2><strong>Ce se \u00eent\u00e2mpl\u0103 dac\u0103 angajatorul nu poate angaja persoane cu handicap?<\/strong><\/h2>\n<p>Dac\u0103 nu exist\u0103 posturi vacante sau nu se identific\u0103 persoane cu handicap potrivite pentru ocuparea locurilor de munc\u0103 disponibile, angajatorul trebuie s\u0103 aleag\u0103 una dintre urm\u0103toarele op\u021biuni:<\/p>\n<ol>\n<li>Plata unei contribu\u021bii lunare la bugetul de stat, echivalent\u0103 cu salariul minim brut pe \u021bar\u0103, \u00eenmul\u021bit cu num\u0103rul de locuri de munc\u0103 neocupate de persoane cu dizabilit\u0103\u021bi;<\/li>\n<li>Plata a cel pu\u021bin 50% din contribu\u021bie la bugetul de stat, iar diferen\u021ba trebuie utilizat\u0103 pentru achizi\u021bionarea de produse sau servicii de la unit\u0103\u021bi protejate care angajeaz\u0103 persoane cu handicap.<\/li>\n<\/ol>\n<h2><strong>Ce s-a schimbat \u00een 2025?<\/strong><\/h2>\n<p>Noua reglementare nu mai permite angajatorilor s\u0103 pl\u0103teasc\u0103 pur \u0219i simplu contribu\u021bia compensatorie f\u0103r\u0103 s\u0103 \u00eencerce s\u0103 angajeze persoane cu dizabilit\u0103\u021bi. Acestea trebuie s\u0103 fie \u00eenregistrate legal \u0219i s\u0103 activeze \u00een raza teritorial\u0103 a sediului angajatorului.<\/li>\n<li>Transmiterea unei cereri scrise c\u0103tre Autoritatea Na\u021bional\u0103 pentru Protec\u021bia Drepturilor Persoanelor cu Dizabilit\u0103\u021bi (ANPDPD) \u0219i Agen\u021bia Na\u021bional\u0103 pentru Ocuparea For\u021bei de Munc\u0103 (ANOFM), \u00een termen de 10 zile de la momentul \u00een care angajatorul a atins pragul de 50 de salaria\u021bi.<\/li>\n<li>Dovada demersurilor realizate, prin notific\u0103rile \u0219i documentele care atest\u0103 contactarea ONG-urilor \u0219i primirea unui r\u0103spuns din partea acestora.<\/li>\n<\/ol>\n<p>Dac\u0103, \u00een urma acestor ac\u021biuni, nu se identific\u0103 persoane cu dizabilit\u0103\u021bi care s\u0103 ocupe posturile vacante, angajatorul poate trece la plata contribu\u021biei compensatorii.<\/p>\n<h2><strong>Ce se \u00eent\u00e2mpl\u0103 dac\u0103 nu exist\u0103 locuri de munc\u0103 disponibile?<\/strong><\/h2>\n<p>Dac\u0103 toate posturile dintr-o companie sunt ocupate \u0219i nu exist\u0103 posibilitatea de a \u00eencadra persoane cu handicap, angajatorul trebuie s\u0103 opteze pentru plata contribu\u021biei compensatorii.<\/p>\n<p>Legea nu prevede excep\u021bii pentru situa\u021biile \u00een care schema de personal este complet\u0103, ceea ce \u00eenseamn\u0103 c\u0103 firmele care au peste 50 de angaja\u021bi vor fi \u00een continuare obligate s\u0103 pl\u0103teasc\u0103 aceast\u0103 contribu\u021bie dac\u0103 nu au angaja\u021bi cu dizabilit\u0103\u021bi.<\/p>\n<h2><strong>Raportarea anual\u0103 obligatorie<\/strong><\/h2>\n<p>O alt\u0103 obliga\u021bie nou introdus\u0103 este raportarea anual\u0103, care trebuie transmis\u0103 p\u00e2n\u0103 la 31 ianuarie a fiec\u0103rui an.
