{"id":8545,"date":"2025-01-24T19:03:55","date_gmt":"2025-01-24T17:03:55","guid":{"rendered":"https:\/\/www.lugera.ro\/blog\/?p=8545"},"modified":"2025-02-07T19:27:47","modified_gmt":"2025-02-07T17:27:47","slug":"legea-concediilor-medicale-in-2025-tipuri-de-indemnizatii-si-decontarea-acestora","status":"publish","type":"post","link":"https:\/\/www.lugera.ro\/blog\/legea-concediilor-medicale-in-2025-tipuri-de-indemnizatii-si-decontarea-acestora\/","title":{"rendered":"Legea concediilor medicale \u00een 2025: Tipuri de indemniza\u021bii \u0219i decontarea acestora"},"content":{"rendered":"<p>Concediul medical este un drept esen\u021bial al salaria\u021bilor, reglementat prin <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/66305\">Ordonan\u021ba de Urgen\u021b\u0103 nr. 158\/2005<\/a>, care stabile\u0219te condi\u021biile de acordare a acestuia \u0219i modul \u00een care se suport\u0103 indemniza\u021biile aferente. \u00cen anumite situa\u021bii, angajatorii sunt obliga\u021bi s\u0103 pl\u0103teasc\u0103 indemniza\u021bia pentru concediul medical, urm\u00e2nd s\u0103 solicite ulterior decontarea sumelor de la stat. \u00cen alte cazuri, indemniza\u021bia este suportat\u0103 integral din Fondul Na\u021bional Unic de Asigur\u0103ri Sociale de S\u0103n\u0103tate (FNUASS), f\u0103r\u0103 ca angajatorul s\u0103 suporte vreun cost. Aten\u021bie, pentru indemniza\u021bia suportat\u0103 de FNUASS, suma este pl\u0103tit\u0103 de angajatorul care va \u00eenainta o cerere de recuperare la Casa de S\u0103n\u0103tate.&nbsp; &nbsp;&nbsp;<\/p>\n<p>\u00cen 2025, aceste prevederi r\u0103m\u00e2n esen\u021biale pentru angaja\u021bi \u0219i angajatori deopotriv\u0103. Potrivit legisla\u021biei actuale:<\/p>\n<ul>\n<li>Salaria\u021bii care au un stagiu de cotizare de cel pu\u021bin \u0219ase luni \u00een ultimele 12 luni pot solicita concediu medical pentru \u00eengrijirea copilului bolnav.<\/li>\n<li>Limita de v\u00e2rst\u0103 pentru copil a fost extins\u0103 la 12 ani (fa\u021b\u0103 de 7 ani anterior), iar \u00een cazul copiilor cu handicap sau afec\u021biuni grave, concediul poate fi acordat p\u00e2n\u0103 la v\u00e2rsta de 18 ani.<\/li>\n<li>Concediul este valabil indiferent dac\u0103 afec\u021biunea copilului este minor\u0103 (de exemplu, o viroz\u0103) sau grav\u0103 (precum o boal\u0103 cronic\u0103), iar p\u0103rintele poate beneficia de acest drept \u0219i atunci c\u00e2nd copilul necesit\u0103 tratament medical \u00een afara \u021b\u0103rii.<\/li>\n<\/ul>\n<ol start=\"2\">\n<li><strong> Concediul de maternitate (sarcin\u0103 \u0219i l\u0103uzie)<\/strong><\/li>\n<\/ol>\n<p>Concediul de maternitate este reglementat de <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/66305\" target=\"_blank\" rel=\"noopener\">OUG nr. 158\/2005<\/a> \u0219i se acord\u0103 pe o perioad\u0103 total\u0103 de 126 de zile calendaristice, \u00eemp\u0103r\u021bite \u00een concediu pentru sarcin\u0103 \u0219i concediu pentru l\u0103uzie.<\/p>\n<ul>\n<li>Indemniza\u021bia de maternitate este de 85% din baza de calcul a veniturilor brute realizate.<\/li>\n<li>Indemniza\u021bia este pl\u0103tit\u0103 de angajator \u0219i decontat\u0103 ulterior integral din FNUASS, cu condi\u021bia ca salariata s\u0103 aib\u0103 un stagiu minim de cotizare de \u0219ase luni \u00een ultimele 12 luni.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li><strong> Concediul medical pentru risc maternal<\/strong><\/li>\n<\/ol>\n<p>Concediul pentru risc maternal este destinat protej\u0103rii salariatelor \u00eens\u0103rcinate sau care au n\u0103scut recent, \u00een cazul \u00een care locul de munc\u0103 prezint\u0103 factori de risc pentru s\u0103n\u0103tatea mamei sau a f\u0103tului.<\/p>\n<ul>\n<li>Durata maxim\u0103 a acestui concediu este de 120 de zile, iar perioada poate fi acordat\u0103 integral sau frac\u021bionat.<\/li>\n<li>Indemniza\u021bia este de 75% din baza de calcul \u0219i, spre deosebire de alte tipuri de concedii medicale, nu necesit\u0103 stagiu de cotizare.<\/li>\n<li>La fel ca \u00een cazul concediului de maternitate, indemniza\u021bia este pl\u0103tit\u0103 de angajator \u0219i decontat\u0103 ulterior integral din FNUASS.<\/li>\n<\/ul>\n<ol start=\"4\">\n<li><strong> Concediul medical pentru carantin\u0103 \u0219i izolare<\/strong><\/li>\n<\/ol>\n<p>\u00cen cazul bolilor transmisibile care necesit\u0103 carantin\u0103 sau izolare, salaria\u021bii pot beneficia de concediu medical, indiferent de stagiul de cotizare.<\/p>\n<ul>\n<li>Indemniza\u021bia este de 100% din baza de calcul \u0219i se suport\u0103 integral din FNUASS.<\/li>\n<li>Aceast\u0103 prevedere se aplic\u0103 at\u00e2t \u00een cazul \u00een care carantina este impus\u0103 printr-o decizie a autorit\u0103\u021bilor sanitare, c\u00e2t \u0219i dac\u0103 medicul de familie constat\u0103 necesitatea izol\u0103rii.<\/li>\n<\/ul>\n<ol start=\"5\">\n<li><strong> Concediul medical pentru \u00eengrijirea pacientului cu afec\u021biuni oncologice<\/strong><\/li>\n<\/ol>\n<p>Aceast\u0103 categorie de <a href=\"https:\/\/www.lugera.ro\/blog\/modificari-privind-eliberarea-concediului-medical-situatii-noi-si-clarificari-pentru-concediul-de-sarcina-si-lauzie\/\" target=\"_blank\" rel=\"noopener\">concediu<\/a> a fost introdus\u0103 \u00een urm\u0103 cu c\u00e2\u021biva ani \u0219i se acord\u0103 unei persoane care \u00eenso\u021be\u0219te pacientul oncologic la tratamente sau interven\u021bii medicale esen\u021biale.<\/p>\n<ul>\n<li>Durata maxim\u0103 a concediului este de 45 de zile calendaristice pe an pentru fiecare pacient.<\/li>\n<li>Indemniza\u021bia este de 85% din baza de calcul \u0219i se deconteaz\u0103 integral din FNUASS.<\/li>\n<\/ul>\n<h2><strong>Ce concedii medicale sunt suportate par\u021bial de angajator?<\/strong><\/h2>\n<p><a --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/p>\n<p><strong>Concediul medical pentru incapacitate temporar\u0103 de munc\u0103<\/strong><\/p>\n<p>Pentru concediile de <a href=\"https:\/\/www.lugera.ro\/blog\/obligatiile-legale-in-cazul-incapacitatii-temporare-de-munca-provocate-de-accidente-usoare\/\" target=\"_blank\" rel=\"noopener\">incapacitate temporar\u0103 de munc\u0103<\/a>, angajatorul suport\u0103 primele cinci zile, iar restul perioadei este decontat de FNUASS. \u00cen cazul accidentelor de munc\u0103, primele trei zile sunt pl\u0103tite de angajator, restul fiind suportat de casele teritoriale de pensii.<\/p>\n<p>Spre deosebire de concediile men\u021bionate anterior, care sunt pl\u0103tite de angajator \u0219i, ulterior, decontate integral de la stat, concediul medical pentru incapacitate temporar\u0103 de munc\u0103 este suportat par\u021bial de angajator.<\/p>\n<ul>\n<li>Primele cinci zile de concediu sunt pl\u0103tite de angajator, iar restul perioadei este decontat de FNUASS.<\/li>\n<li>Cuantumul indemniza\u021biei variaz\u0103 \u00eentre 75% \u0219i 100% din baza de calcul, \u00een func\u021bie de cauza incapacit\u0103\u021bii de munc\u0103 (boal\u0103 obi\u0219nuit\u0103, accident, etc.).<\/li>\n<\/ul>\n<p>Este important de men\u021bionat c\u0103 aceast\u0103 regul\u0103 nu se aplic\u0103 \u00een cazul concediilor medicale pentru accidente de munc\u0103 \u0219i boli profesionale, unde primele trei zile sunt suportate de angajator, iar restul de casele teritoriale de pensii.<\/p>\n<h2><strong>Ce trebuie s\u0103 re\u021bin\u0103 angajatorii \u0219i salaria\u021bii?<\/strong><\/h2>\n<p>\u00cen 2025, concediile medicale continu\u0103 s\u0103 fie un mecanism important de protec\u021bie social\u0103, iar angajatorii trebuie s\u0103 cunoasc\u0103 clar care indemniza\u021bii pot fi recuperate integral de la stat. Totodat\u0103, salaria\u021bii trebuie s\u0103 fie informa\u021bi despre drepturile lor, pentru a putea beneficia de concedii medicale f\u0103r\u0103 probleme.<\/p>\n<p>\u00cen concluzie, fie c\u0103 este vorba despre \u00eengrijirea unui copil bolnav, maternitate, risc maternal sau alte situa\u021bii medicale, este important ca angaja\u021bii s\u0103 \u00ee\u0219i cunoasc\u0103 drepturile \u0219i s\u0103 se asigure c\u0103 angajatorii respect\u0103 prevederile legale.
