Conform <strong>Codului Muncii<\/strong>, angajatorii sunt obliga\u021bi s\u0103 respecte salariul minim pe economie garantat \u00een plat\u0103 stabilit prin hot\u0103r\u00e2re de Guvern (HG). \u00cen cazul \u00een care un contract colectiv de munc\u0103 (CCM) prevede un salariu minim mai mare, acesta va fi aplicabil, dar dac\u0103 nivelul minim legal \u00eel dep\u0103\u0219e\u0219te cel din contractul colectiv, salariul minim garantat prin HG devine obligatoriu.<\/p>\n<h2><strong>Obliga\u021biile angajatorului \u00een privin\u021ba salariului minim<\/strong><\/h2>\n<ol>\n<li><strong>Respectarea salariului minim garantat prin HG<\/strong><br \/>\nAngajatorii nu pot oferi salarii mai mici dec\u00e2t salariul minim stabilit legal, nici m\u0103car prin negociere \u00een contractele individuale sau colective de munc\u0103. Orice \u00eenc\u0103lcare a acestei obliga\u021bii poate atrage sanc\u021biuni severe, inclusiv amenzi cuprinse \u00eentre <strong>3.000 \u0219i 5.000 lei pentru fiecare salariat afectat<\/strong>.<\/li>\n<li><strong>Prioritatea legii asupra contractului colectiv<\/strong><br \/>\nChiar dac\u0103 un CCM constituie \u201elegea p\u0103r\u021bilor\u201d, prevederile acestuia nu pot contrazice legea. \u00cen situa\u021bia \u00een care salariul minim legal dep\u0103\u0219e\u0219te salariul minim stabilit \u00een contractul colectiv, angajatorii trebuie s\u0103 pl\u0103teasc\u0103 salaria\u021bilor minimul legal.<\/li>\n<\/ol>\n<h2><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/12\/salariul-minim-obligatiile-angajatorului.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-8497 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/12\/salariul-minim-obligatiile-angajatorului.jpg\" alt=\"Obliga'iile Angajatorului Salariul Minim\" width=\"1000\" height=\"333\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/12\/salariul-minim-obligatiile-angajatorului.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/12\/salariul-minim-obligatiile-angajatorului-300x100.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/12\/salariul-minim-obligatiile-angajatorului-768x256.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/333;\" \/><\/a><\/h2>\n<h2><strong>Ce se \u00eent\u00e2mpl\u0103 c\u00e2nd salariul minim legal dep\u0103\u0219e\u0219te cel din contractul colectiv?<\/strong><\/h2>\n<p>Este posibil ca un CCM, \u00eencheiat pe o perioad\u0103 mai lung\u0103, s\u0103 prevad\u0103 un salariu minim mai mic dec\u00e2t cel stabilit ulterior prin HG. \u00cen astfel de cazuri:<\/p>\n<ul>\n<li><strong>Salariul minim garantat prin HG devine aplicabil automat.<\/strong><\/li>\n<li>Nu este necesar\u0103 modificarea contractului colectiv pentru a reflecta noul prag minim, \u00eens\u0103 angajatorul trebuie s\u0103 se conformeze \u0219i s\u0103 asigure plata salariului minim legal.<\/li>\n<\/ul>\n<p>Exemplu: Dac\u0103 un CCM stabile\u0219te un salariu minim de 4.100 lei, dar HG prevede o majorare la 4.500 lei, angajatorul este obligat s\u0103 pl\u0103teasc\u0103 salariul de 4.500 lei, indiferent de valoarea men\u021bionat\u0103 \u00een contract.<\/p>\n<h2><strong>Recomand\u0103ri pentru contractele colective de munc\u0103<\/strong><\/h2>\n<p>Pentru a evita ambiguit\u0103\u021bi \u00een cazul major\u0103rilor legislative ale salariului minim, speciali\u0219tii recomand\u0103 includerea unor clauze specifice \u00een CCM:<\/p>\n<ol>\n<li><strong>Clauza de actualizare automat\u0103.<\/strong><br \/>\nCCM poate stipula c\u0103, \u00een cazul \u00een care salariul minim garantat prin HG dep\u0103\u0219e\u0219te cel din contract, salariul minim aplicabil va fi cel stabilit prin lege.<\/li>\n<li><strong>Clauze de corec\u021bie procentual\u0103.<\/strong><br \/>\nO alt\u0103 solu\u021bie este includerea unei prevederi care ajusteaz\u0103 salariul minim din CCM la nivelul legal, plus un procent negociat (de exemplu, +10%).<\/li>\n<\/ol>\n<h2><strong>Perioada maxim\u0103 de aplicare a salariului minim<\/strong><\/h2>\n<p>Conform legisla\u021biei, angajatorii pot pl\u0103ti salaria\u021bii cu <a href=\"https:\/\/www.lugera.ro\/blog\/obligatia-de-crestere-salariu-minim-avertisment-pentru-angajatori-si-implicatii-pratice\/\">salariul minim brut garantat \u00een plat\u0103 pentru o perioad\u0103 de maximum <strong>24 de luni<\/strong> la acela\u0219i angajator<\/a>. Dup\u0103 aceast\u0103 perioad\u0103, salariul trebuie majorat pentru a reflecta cre\u0219terea \u00een competen\u021be \u0219i experien\u021b\u0103.<\/p>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/12\/salariul-minim.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-8499 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/12\/salariul-minim.jpg\" alt=\"Salariul minim. Pentru angajatori, este esen\u021bial s\u0103 respecte \u00eentocmai reglement\u0103rile \u00een vigoare, av\u00e2nd \u00een vedere sanc\u021biunile semnificative aplicabile \u00een caz de neconformare.
