Directiva \u00ee\u0219i propune s\u0103 stabileasc\u0103 un cadru legislativ unitar la nivel european, destinat corectei \u00eencadr\u0103ri a statutului profesional al lucr\u0103torilor digitali. Astfel, aceasta introduce criterii clare pentru a determina dac\u0103 lucr\u0103torii de pe platformele digitale sunt angaja\u021bi ai platformelor. Pe l\u00e2ng\u0103 criteriile de angajare, directiva asigur\u0103 transparen\u021ba utiliz\u0103rii algoritmilor \u0219i protejeaz\u0103 datele personale ale lucr\u0103torilor. \u00cen Rom\u00e2nia, reglement\u0103rile existente sunt limitate, fiind \u00een vigoare o singur\u0103 prevedere specific\u0103 unui tip de angajat pe platform\u0103 digital\u0103, introdus\u0103 \u00een acest an. Dezbaterile privind nevoia unei reglement\u0103ri unitare la nivelul Uniunii Europene pe acest subiect au \u00eenceput cu mai mul\u021bi ani \u00een urm\u0103. Acordul din decembrie 2022 dintre Parlamentul European \u0219i Consiliu privind textul propus al directivei marcheaz\u0103 un pas decisiv \u00een reglementare, iar odat\u0103 semnat\u0103 directiva de c\u0103tre co-legiuitori \u0219i publicat\u0103 \u00een Jurnalul Oficial UE, statele membre, inclusiv Rom\u00e2nia, vor avea obliga\u021bia de a o transpune \u00een termen de doi ani.<\/p>\n<h2><strong>Corectarea Incadr\u0103rii Eronate a Lucr\u0103torilor ca Independen\u021bi<\/strong><\/h2>\n<p>Noua directiv\u0103 urm\u0103re\u0219te corectarea situa\u021biilor de \u00eencadrare eronat\u0103 a lucr\u0103torilor ca independen\u021bi, chiar \u0219i \u00een condi\u021biile \u00een care activitatea lor este, de fapt, dependent\u0103 de platform\u0103 \u0219i ar trebui s\u0103 fie tratat\u0103 din punct de vedere legislativ drept munc\u0103 dependent\u0103. Potrivit datelor prezentate de Consiliul UE, \u00een Uniune exist\u0103 aproximativ 28 de milioane de lucr\u0103tori care activeaz\u0103 prin platforme digitale, unii dintre ei \u00een activit\u0103\u021bi precum transportul de persoane (de exemplu, \u0219oferii de taxi) sau livrarea de produse alimentare. Ace\u0219ti lucr\u0103tori sunt considera\u021bi \u00een mod frecvent independen\u021bi, de\u0219i sunt adesea supu\u0219i unor reguli \u0219i restric\u021bii similare celor impuse angaja\u021bilor.<\/p>\n<h2><strong>Prezum\u021bia de Angajare \u0219i Criteriile Aplicabile<\/strong><\/h2>\n<p>Directiva aduce o modificare semnificativ\u0103 prin introducerea unei prezum\u021bii juridice de angajare pentru lucr\u0103torii de pe platforme. Astfel, ace\u0219tia vor fi considera\u021bi angaja\u021bi ai platformei digitale dac\u0103 rela\u021bia de munc\u0103 \u00eendepline\u0219te cel pu\u021bin dou\u0103 din cinci criterii stabilite, precum limitarea veniturilor, supravegherea electronic\u0103 a performan\u021bei, controlul asupra repartiz\u0103rii \u0219i aloc\u0103rii sarcinilor sau programului de lucru \u0219i restric\u021bii legate de libertatea de organizare a muncii. Platformele vor avea posibilitatea de a combate aceast\u0103 prezum\u021bie juridic\u0103, dar sarcina probei va reveni acestora, nu lucr\u0103torilor. Totodat\u0103, statele membre vor putea ad\u0103uga \u0219i alte criterii relevante \u00een func\u021bie de specificul local.<\/p>\n<p>Conform directivei, criteriile includ:<\/p>\n<ul>\n<li>aplicarea de limite superioare veniturilor lucr\u0103torilor;<\/li>\n<li>monitorizarea performan\u021bei lucr\u0103torilor, inclusiv prin mijloace electronice;<\/li>\n<li>controlul platformei asupra repartiz\u0103rii sarcinilor \u0219i condi\u021biilor de munc\u0103;<\/li>\n<li>limit\u0103ri ale programului de lucru;<\/li>\n<li>restric\u021bii privind libertatea de organizare a activit\u0103\u021bii \u0219i norme de conduit\u0103.<\/li>\n<\/ul>\n<h2><strong>Transparen\u021ba Algoritmic\u0103 \u0219i Protec\u021bia Datelor Personale<\/strong><\/h2>\n<p>Directiva include prevederi referitoare la transparen\u021ba \u00een utilizarea algoritmilor pentru gestionarea lucr\u0103torilor, \u00eentruc\u00e2t algoritmii sunt folosi\u021bi tot mai des pentru monitorizarea performan\u021bei \u0219i alocarea sarcinilor. Viitoarea reglementare oblig\u0103 platformele s\u0103 informeze lucr\u0103torii \u00een leg\u0103tur\u0103 cu modalit\u0103\u021bile de monitorizare \u0219i deciziile automate care \u00eei privesc. Totodat\u0103, sunt prev\u0103zute restric\u021bii pentru prelucrarea anumitor tipuri de date sensibile, precum cele legate de starea emo\u021bional\u0103, conversa\u021biile private, activitatea sindical\u0103, originea rasial\u0103 sau s\u0103n\u0103tatea. Conform acestei noi directive, ace\u0219ti lucr\u0103tori ar trebui s\u0103 beneficieze de drepturi similare angaja\u021bilor, inclusiv accesul la asigur\u0103ri medicale, indemniza\u021bii pentru accidente de munc\u0103 \u0219i asigurare de \u0219omaj.<\/p>\n<h2><strong>Abord\u0103ri Legislative Diferite ale Statelor Membre<\/strong><\/h2>\n<p>La nivelul statelor membre, reglement\u0103rile privind munca pe platformele digitale sunt neuniforme. \u00cen Fran\u021ba, Italia \u0219i Spania exist\u0103 deja prevederi na\u021bionale care reglementeaz\u0103 activitatea lucr\u0103torilor digitali \u00een anumite sectoare, cum ar fi transportul \u0219i livr\u0103rile de produse alimentare. Legea mobilit\u0103\u021bii din Fran\u021ba, de exemplu, prevede dreptul lucr\u0103torilor de pe platforme de a refuza o sarcin\u0103 f\u0103r\u0103 a fi penaliza\u021bi \u0219i de a se deconecta de la platform\u0103. \u00cen Rom\u00e2nia, lipsa unei legisla\u021bii specifice a dus la \u00eencadrarea lucr\u0103torilor fie ca angaja\u021bi cu norme foarte reduse, fie ca independen\u021bi (PFA), situa\u021bie care nu ofer\u0103 protec\u021bia necesar\u0103 \u0219i nu corespunde specificului activit\u0103\u021bii desf\u0103\u0219urate.<\/p>\n<h2><strong>Reglementarea Activit\u0103\u021bii Casnice \u00een Rom\u00e2nia prin Legea 111\/2022<\/strong><\/h2>\n<p>\u00cen Rom\u00e2nia, singura reglementare specific\u0103 pentru lucr\u0103torii de pe platforme este Legea nr. 111\/2022 privind reglementarea activit\u0103\u021bii prestatorului casnic, intrat\u0103 \u00een vigoare la 1 ianuarie 2024. Aceast\u0103 lege define\u0219te activitatea casnic\u0103 drept munc\u0103 ocazional\u0103 \u0219i necalificat\u0103, incluz\u00e2nd activit\u0103\u021bi precum cur\u0103\u021benia, c\u0103lcatul rufelor, croitoria, prepararea mesei sau \u00eengrijirea nespecializat\u0103 a unei persoane dependente. Sistemul de plat\u0103 pentru activit\u0103\u021bile casnice se bazeaz\u0103 pe tichete cu o valoare de 15 lei, iar lucr\u0103torii pot beneficia de asigurare de s\u0103n\u0103tate \u0219i indemniza\u021bie de \u0219omaj. Normele de aplicare ale acestei legi, stabilite prin HG nr. 822\/2022, prev\u0103d c\u0103 tichetele pot fi achizi\u021bionate de beneficiari de la agen\u021biile de ocupare a for\u021bei de munc\u0103, oficiile po\u0219tale sau printr-o platform\u0103 online \u00een curs de implementare.<\/p>\n<p>Rela\u021bia dintre prestator \u0219i beneficiar nu necesit\u0103 un contract scris, iar acordul este stabilit verbal. Prestatorii trebuie s\u0103 aib\u0103 cel pu\u021bin 16 ani \u0219i nu pot fi membri ai familiei beneficiarului. Durata maxim\u0103 de lucru permis\u0103 este de 12 ore pe zi pentru adul\u021bi \u0219i 6 ore pentru persoanele cu v\u00e2rste \u00eentre 16 \u0219i 18 ani.<\/p>\n<h2><strong>Impactul Directivei asupra Drepturilor Lucr\u0103torilor pe Platforme Digitale<\/strong><\/h2>\n<p>Adoptarea directivei reprezint\u0103 o solu\u021bie la provoc\u0103rile generate de cre\u0219terea economiei digitale, care, conform estim\u0103rilor, va include p\u00e2n\u0103 \u00een 2025 un num\u0103r de 43 de milioane de lucr\u0103tori \u00een UE, apropiindu-se de num\u0103rul celor din sectorul manufacturier. Cre\u0219terea semnificativ\u0103 a acestui sector a dus la necesitatea de a oferi claritate \u0219i protec\u021bie legal\u0103 pentru milioane de lucr\u0103tori care, de\u0219i contribuie la economia platformelor digitale, nu beneficiaz\u0103 de drepturile \u0219i securitatea oferite angaja\u021bilor clasici. Potrivit Comisiei Europene, aproximativ 5,5 milioane de lucr\u0103tori ar putea avea drepturi depline dac\u0103 ar fi corect clasifica\u021bi ca angaja\u021bi \u0219i nu ca independen\u021bi.<\/p>\n<h2><strong>Un Pas Spre Drepturile Lucr\u0103torilor Digitali \u0219i Transpunerea Directivei \u00een Legisla\u021biile Na\u021bionale<\/strong><\/h2>\n<p>Adoptarea directivei aduce un pas important pentru consolidarea drepturilor lucr\u0103torilor pe platforme digitale la nivel european \u0219i reprezint\u0103 un r\u0103spuns legislativ la transform\u0103rile rapide din economia digital\u0103. Pentru statele membre, inclusiv Rom\u00e2nia, urm\u0103torul pas va fi transpunerea directivei \u00een legisla\u021bia na\u021bional\u0103 \u00een termen de doi ani de la publicarea acesteia \u00een Jurnalul Oficial al Uniunii Europene.<\/p>\n<p>De\u0219i directiva reprezint\u0103 un cadru minim de protec\u021bie, aceasta ofer\u0103 statelor membre flexibilitatea de a adopta criterii \u0219i m\u0103suri suplimentare \u00een func\u021bie de particularit\u0103\u021bile pie\u021bei locale, asigur\u00e2nd astfel o implementare adaptat\u0103 nevoilor lucr\u0103torilor din fiecare stat membru. \u00cen Rom\u00e2nia, aceast\u0103 transpunere ar putea stimula actualizarea legisla\u021biei muncii pentru a include reglement\u0103ri specifice \u0219i complete pentru lucr\u0103torii pe platforme, contribuind astfel la reducerea incertitudinilor \u0219i a lacunelor legislative actuale.<\/p>\n<p>Adoptarea acestei directive marcheaz\u0103 un moment de referin\u021b\u0103 pentru protec\u021bia lucr\u0103torilor din economia digital\u0103 \u0219i pentru armonizarea standardelor de munc\u0103 \u00een UE. \u00cen contextul unei pie\u021be a muncii din ce \u00een ce mai digitalizate, directiva pune bazele unei noi abord\u0103ri legislative, prin care se asigur\u0103 c\u0103 drepturile \u0219i protec\u021biile fundamentale sunt garantate pentru to\u021bi lucr\u0103torii, indiferent de formatul contractual.
