Fiecare angajator, indiferent de dimensiunea firmei, trebuie s\u0103 respecte anumite cerin\u021be legale legate de accesul angaja\u021bilor la programe de formare. Iat\u0103 detaliate cele mai importante repere legislative:<\/p>\n<h2><strong>Obliga\u021biile Generale ale Angajatorului<\/strong><\/h2>\n<p>Conform <strong>Art. 194 \u0219i Art. 195 din Codul muncii<\/strong>, to\u021bi angajatorii trebuie s\u0103 asigure angaja\u021bilor accesul la programe de formare profesional\u0103.<\/p>\n<ul>\n<li>Dac\u0103 o firm\u0103 are mai pu\u021bin de 21 de angaja\u021bi, formarea profesional\u0103 trebuie asigurat\u0103 cel pu\u021bin o dat\u0103 la trei ani.<\/li>\n<li>Pentru companiile cu 21 de angaja\u021bi sau mai mul\u021bi, formarea trebuie oferit\u0103 cel pu\u021bin o dat\u0103 la doi ani.<\/li>\n<\/ul>\n<h2><strong>Informarea Prealabil\u0103 a Angajatului<\/strong><\/h2>\n<p>\u00cen conformitate cu <strong>Art. 17 din Codul muncii<\/strong>, orice angajator are obliga\u021bia de a informa candidatul, \u00eenainte de angajare, cu privire la posibilit\u0103\u021bile de formare profesional\u0103. Nerespectarea acestui drept de informare poate fi considerat\u0103 o \u00eenc\u0103lcare a drepturilor angajatului, care poate sesiza <strong>Inspec\u021bia Muncii<\/strong> \u0219i poate solicita desp\u0103gubiri.<\/p>\n<h2><strong>Formarea Profesional\u0103 \u00een Regulamentul Intern<\/strong><\/h2>\n<p>Potrivit <strong>Art. 242 din Codul muncii<\/strong>, regulamentul intern al companiei trebuie s\u0103 includ\u0103 informa\u021bii despre politica de formare profesional\u0103 a angaja\u021bilor. Aceast\u0103 prevedere asigur\u0103 accesul tuturor salaria\u021bilor la o politic\u0103 clar\u0103 privind formarea profesional\u0103, oferindu-le un cadru de dezvoltare.<\/p>\n<h2><strong>Formarea Profesional\u0103 ca Timp de Munc\u0103<\/strong><\/h2>\n<p>Conform unei decizii a <strong>Cur\u021bii de Justi\u021bie a Uniunii Europene (CJUE)<\/strong>, timpul petrecut de un angajat la cursurile de formare constituie timp de lucru, indiferent dac\u0103 acestea se desf\u0103\u0219oar\u0103 \u00een afara programului de munc\u0103 sau la sediul unei entit\u0103\u021bi de formare.<\/p>\n<p>\u00cen plus,<strong> Art. 195 din Codul muncii<\/strong> stipuleaz\u0103 c\u0103 \u201e<em>timpul alocat form\u0103rii profesionale este considerat timp de munc\u0103<\/em>\u201d, iar angajatorii nu pot considera angaja\u021bii ca absen\u021bi sau s\u0103 suspende contractul de munc\u0103 pe durata acestor sesiuni de formare.<\/p>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/11\/shutterstock_2298734097.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-8422 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/11\/shutterstock_2298734097.jpg\" alt=\"Repere Esen\u021biale pentru Formarea Profesional\u0103 a Angaja\u021bilor \u0219i Obliga\u021biile Legale ale Angajatorilor\" width=\"1000\" height=\"692\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/11\/shutterstock_2298734097.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/11\/shutterstock_2298734097-300x208.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/11\/shutterstock_2298734097-768x531.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/692;\" \/><\/a><\/p>\n<h2><strong>Interzicerea Suspend\u0103rii Contractului \u00een Perioada de Formare<\/strong><\/h2>\n<p>O gre\u0219eal\u0103 frecvent\u0103 este considerarea ca absen\u021b\u0103 a angajatului aflat la formare. Conform <strong>Art. 49 din Codul muncii<\/strong>, timpul alocat form\u0103rii profesionale nu poate justifica suspendarea contractului de munc\u0103, iar nerespectarea acestui articol poate duce la sanc\u021biuni pentru neplata salariului la timp.<\/p>\n<h2><strong>Planul Anual de Formare Profesional\u0103<\/strong><\/h2>\n<p>Firmele cu mai mult de 20 de angaja\u021bi sunt obligate s\u0103 \u00eentocmeasc\u0103 anual un plan de formare profesional\u0103, conform <strong>Art. 194 alin. (3) din Codul muncii<\/strong>. Acesta trebuie elaborat prin consultarea sindicatelor sau a reprezentan\u021bilor angaja\u021bilor \u0219i anexat contractului colectiv de munc\u0103, dac\u0103 acesta exist\u0103.<\/p>\n<h2><strong>Dreptul de Refuz al Angajatului la Formarea Condi\u021bionat\u0103<\/strong><\/h2>\n<p>Angajatorii nu pot impune participarea la formarea profesional\u0103 condi\u021bion\u00e2nd-o de o obliga\u021bie adi\u021bional\u0103, cum ar fi obligativitatea r\u0103m\u00e2nerii pe o anumit\u0103 perioad\u0103. <strong>Art. 39 \u0219i 40 din Codul muncii<\/strong> permit angajatului s\u0103 refuze astfel de condi\u021bion\u0103ri nerezonabile.<\/p>\n<h2><strong>Concediu Pl\u0103tit pentru Formare Profesional\u0103<\/strong><\/h2>\n<p>Potrivit <strong>Art. 157 din Codul muncii<\/strong>, angaja\u021bii care nu au beneficiat de formare profesional\u0103 din partea angajatorului pot solicita un concediu pl\u0103tit de p\u00e2n\u0103 la 10 zile lucr\u0103toare sau 80 de ore. Acest concediu trebuie solicitat cu cel pu\u021bin o lun\u0103 \u00eenainte, iar costurile form\u0103rii vor fi suportate de angajat, \u00een timp ce indemniza\u021bia este asigurat\u0103 de angajator.<\/p>\n<h2><strong>Formare Intern\u0103 Autorizat\u0103<\/strong><\/h2>\n<p>Conform <strong>Art. 196 \u0219i 197 din Codul muncii<\/strong>, formarea profesional\u0103 poate fi realizat\u0103 \u0219i la nivel intern, prin contracte speciale de formare, precum contractul de calificare profesional\u0103 sau de adaptare profesional\u0103. Totu\u0219i, pentru ca aceast\u0103 formare s\u0103 fie recunoscut\u0103 legal, angajatorul trebuie s\u0103 urmeze procedurile de autorizare necesare.<\/p>\n<h2><strong>Clauza de Formare Profesional\u0103<\/strong><\/h2>\n<p><strong>Art. 195 din Codul muncii<\/strong> permite angajatorilor s\u0103 impun\u0103 angaja\u021bilor o clauz\u0103 de formare profesional\u0103 prin care ace\u0219tia se angajeaz\u0103 s\u0103 r\u0103m\u00e2n\u0103 \u00een companie pentru o anumit\u0103 perioad\u0103 dup\u0103 finalizarea cursului. Totu\u0219i, aceast\u0103 clauz\u0103 trebuie s\u0103 fie propor\u021bional\u0103 cu investi\u021bia f\u0103cut\u0103 de angajator \u0219i nu poate dep\u0103\u0219i, de regul\u0103, doi ani.<\/p>\n<h2><strong>Regimul Fiscal al Cheltuielilor cu Formarea Profesional\u0103<\/strong><\/h2>\n<p><strong>Codul fiscal<\/strong> prevede un regim fiscal preferen\u021bial pentru cheltuielile suportate de angajator pentru formarea profesional\u0103. Art. 76 \u0219i Art. 142 din Codul fiscal specific\u0103 faptul c\u0103 aceste cheltuieli nu sunt impozabile \u0219i nu intr\u0103 \u00een baza de calcul pentru contribu\u021biile sociale, cu condi\u021bia ca acestea s\u0103 fie legate de activitatea angajatului \u0219i pl\u0103tite direct de companie.<\/p>\n<h2><strong>Formarea Profesional\u0103 \u00een Concediul pentru Cre\u0219terea Copilului<\/strong><\/h2>\n<p>De\u0219i contractul de munc\u0103 este suspendat \u00een perioada concediului pentru cre\u0219terea copilului, <strong>Art. 49 \u0219i Art. 56 din Codul muncii<\/strong> permit ca angajatul \u0219i angajatorul s\u0103 stabileasc\u0103 prin acord posibilitatea de a participa la cursuri de formare \u00een acest timp. Cheltuielile asociate cu formarea nu sunt considerate drepturi salariale, ci drepturi stabilite prin acordurile colective sau regulamentul intern.<\/p>\n<h2><strong>Risc\u0103 vreo sanc\u021biune firmele care nu asigur\u0103 formarea profesional\u0103 a salaria\u021bilor?<\/strong><\/h2>\n<p>De\u0219i Codul Muncii impune angajatorilor obliga\u021bia de a asigura accesul angaja\u021bilor la programe de formare profesional\u0103 \u0219i de a elabora anual un plan de formare, acesta nu prevede sanc\u021biuni directe pentru nerespectarea acestor obliga\u021bii. Totu\u0219i, dac\u0103 un salariat sesizeaz\u0103 Inspectoratul Teritorial de Munc\u0103 (ITM) \u00een leg\u0103tur\u0103 cu lipsa form\u0103rii, ITM poate interveni \u0219i dispune corectarea situa\u021biei. Dac\u0103 angajatorul nu se conformeaz\u0103 \u00een termenul stabilit, risc\u0103 o amend\u0103 \u00eentre 5.000 \u0219i 10.000 de lei, conform Legii nr. 108\/1999. Aceast\u0103 abordare gradual\u0103 implic\u0103 o etap\u0103 ini\u021bial\u0103 de remediere, \u00een care angajatorului i se acord\u0103 timp s\u0103 \u00eendeplineasc\u0103 m\u0103surile impuse prin procesul-verbal de control; dac\u0103 aceste m\u0103suri nu sunt respectate, sanc\u021biunea financiar\u0103 devine aplicabil\u0103.<\/p>\n<p>Formarea profesional\u0103 reprezint\u0103 at\u00e2t un drept, c\u00e2t \u0219i o responsabilitate pentru angaja\u021bi \u0219i angajatori, reglementat\u0103 strict prin Codul muncii \u0219i Codul fiscal.
