Recent, modul de calcul al acestui termen a fost clarificat printr-un recurs \u00een interesul legii, dar exist\u0103 \u00eenc\u0103 multe aspecte practice pe care angajatorii nu le respect\u0103 \u00eentotdeauna.<\/p>\n<h2><strong>Calculul Termenului de Preaviz<\/strong><\/h2>\n<p>Pe 20 mai, <a href=\"https:\/\/www.ilegis.ro\/oficiale\/index\/act\/284151\" target=\"_blank\" rel=\"noopener\">\u00cenalta Curte a stabilit definitiv modul de calcul al termenului de preaviz<\/a>: perioada de preaviz \u00een cadul concedierii \u00eencepe din ziua urm\u0103toare comunic\u0103rii notific\u0103rii de preaviz \u0219i se \u00eencheie \u00een ultima zi a termenului. Aceast\u0103 clarificare elimin\u0103 orice alte interpret\u0103ri care au fost aplicate anterior. Astfel, cei care au dreptul la minimul de 20 de zile de preaviz \u00eencep s\u0103 le calculeze din ziua urm\u0103toare primirii notific\u0103rii de concediere. Decizia, publicat\u0103 \u00een <a href=\"https:\/\/lege5.ro\/MonitorOficial\/mongq3danzygiyq\/monitorul-oficial-partea-i-nr-573-19-06-2024\" target=\"_blank\" rel=\"noopener\">Monitorul Oficial nr. 573<\/a>, specific\u0103 c\u0103 prevederile din Codul de procedur\u0103 civil\u0103 \u0219i Codul civil referitoare la calculul termenelor nu se aplic\u0103 termenului de preaviz la concediere din cauza naturii diferite a termenelor stabilite \u00een Codul muncii. Aceasta pentru a evita prelungiri nejustificate \u0219i contrare intereselor protejate \u00een raporturile de munc\u0103.<\/p>\n<p>\u00cen interpretarea \u0219i aplicarea unitar\u0103 a dispozi\u021biilor art. 75 alin. (1) \u0219i art. 278 alin. (1) din Codul muncii, termenul de preaviz \u00eencepe s\u0103 curg\u0103 din ziua urm\u0103toare comunic\u0103rii notific\u0103rii de preaviz \u0219i se \u00eempline\u0219te \u00een ultima zi a termenului.<\/p>\n<h2><strong>Importan\u021ba respect\u0103rii preavizului<\/strong><\/h2>\n<p>Respectarea preavizului este crucial\u0103 la concedierea unui angajat. Nerespectarea acestuia poate duce la anularea concedierii \u00een instan\u021b\u0103. \u00cenalta Curte a afirmat c\u0103 perioada de preaviz nu poate fi compensat\u0103 cu altceva. Contractele colective sau individuale pot prevedea termene mai lungi de preaviz. Decizia de concediere trebuie s\u0103 includ\u0103 motivele concedierii, durata preavizului \u0219i criteriile de stabilire a ordinii de priorit\u0103\u021bi \u00een cazul concedierilor colective. Legea nu face diferen\u021be \u00eentre cele dou\u0103 tipuri de contracte c\u00e2nd vine vorba de preaviz \u0219i motivele concedierii. Preavizul se aplic\u0103 \u0219i pentru contractele pe perioad\u0103 determinat\u0103 \u00een caz de concediere.<\/p>\n<h2><strong>Drepturile \u00een perioada preavizului<\/strong><\/h2>\n<p>Pe perioada preavizului, toate bonusurile \u0219i beneficiile acordate anterior trebuie s\u0103 continue s\u0103 fie oferite angajatului. Aceasta asigur\u0103 o tranzi\u021bie echitabil\u0103 \u0219i respectarea drepturilor salaria\u021bilor pe durata preavizului.<\/p>\n<p>Aceste aspecte sunt esen\u021biale pentru a asigura conformitatea legal\u0103 \u0219i pentru a proteja drepturile angaja\u021bilor \u00een cazul concedierii.
