Zilele de concediu de odihn\u0103 neluate p\u00e2n\u0103 la finele anului 2022"},"content":{"rendered":"<p>Concediul de odihn\u0103 este un drept fundamental al salaria\u021bilor, prev\u0103zut de Codul Muncii, care nu poate fi renun\u021bat sau cedat. Potrivit legisla\u021biei, angajatorii au obliga\u021bia de a acorda \u00een natur\u0103 acest concediu, iar salaria\u021bii trebuie s\u0103-l efectueze conform program\u0103rii stabilite colectiv sau individual. Aceasta reglementare are rolul de a asigura refacerea capacit\u0103\u021bii de munc\u0103 \u0219i echilibrul \u00eentre via\u021ba profesional\u0103 \u0219i cea personal\u0103.<\/p>\n<h2><strong>Obliga\u021bia de a acorda concediul de odihn\u0103<\/strong><\/h2>\n<p>Codul Muncii prevede c\u0103 \u00een cazul \u00een care un salariat nu a reu\u0219it s\u0103-\u0219i ia toate zilele de concediu de odihn\u0103 \u00eentr-un an calendaristic, acestea nu se pierd. Astfel, angajatorul este obligat s\u0103 acorde zilele neefectuate \u00eentr-o perioad\u0103 de 18 luni, \u00eencep\u00e2nd cu anul urm\u0103tor celui \u00een care s-a n\u0103scut dreptul la concediu. Astfel, pentru zilele de concediu r\u0103mase din 2022, termenul limit\u0103 este fialul acestei luni, respectiv, 30 iunie 2024.<\/p>\n<h2><strong>Durata minim\u0103 a concediului<\/strong><\/h2>\n<p>Conform <a href=\"https:\/\/www.iprotectiamuncii.ro\/codul-muncii-actualizat-2024\">articolului 145 alin. (1) din Codul Muncii<\/a>, durata minim\u0103 a concediului de odihn\u0103 anual este de 20 de zile lucr\u0103toare. Contractele de munc\u0103 pot prevedea mai multe zile de concediu, dar niciodat\u0103 mai pu\u021bine. De asemenea, articolul 146 alin. (1) prevede c\u0103 salaria\u021bii au dreptul de a efectua concediul de odihn\u0103 \u00een natur\u0103, iar <strong><em>compensarea \u00een bani este interzis\u0103, cu excep\u021bia cazurilor \u00een care contractul individual de munc\u0103 \u00eenceteaz\u0103<\/em><\/strong>.<\/p>\n<h2><strong>Programarea concediilor<\/strong><\/h2>\n<p>Angajatorul are obliga\u021bia de a stabili programarea concediilor, fie colectiv, fie individual, \u00een consultare cu salaria\u021bii. Aceasta trebuie s\u0103 fie f\u0103cut\u0103 p\u00e2n\u0103 la sf\u00e2r\u0219itul anului pentru anul urm\u0103tor. De asemenea, angajatorul trebuie s\u0103 \u021bin\u0103 eviden\u021ba concediilor de odihn\u0103 \u0219i s\u0103 comunice salaria\u021bilor perioadele programate. <strong><em>Salaria\u021bii sunt obliga\u021bi s\u0103 \u00ee\u0219i ia concediul conform program\u0103rii, excep\u021bie f\u0103c\u00e2nd cazurile prev\u0103zute expres de lege sau motivele obiective care \u00eempiedic\u0103 efectuarea concediului<\/em><\/strong>.<\/p>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/06\/shutterstock_2332060193.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-8245 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/06\/shutterstock_2332060193.jpg\" alt=\"acordarea concediilor de odihn\u0103 - programarea concediilor\" width=\"1000\" height=\"734\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/06\/shutterstock_2332060193.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/06\/shutterstock_2332060193-300x220.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/06\/shutterstock_2332060193-768x564.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/734;\" \/><\/a><\/p>\n<h2><strong>Solicitarea concediului<\/strong><\/h2>\n<p>Pentru a beneficia de concediul de odihn\u0103, salaria\u021bii sunt obliga\u021bi s\u0103 depun\u0103 o cerere scris\u0103 cu cel pu\u021bin 60 de zile \u00eenainte de perioada programat\u0103. \u00cen situa\u021bia \u00een care salariatul nu face o astfel de solicitare, angajatorul are obliga\u021bia de a acorda concediul conform program\u0103rii stabilite.<\/p>\n<h2><strong>Concediul este obligatoriu<\/strong><\/h2>\n<p>Angajatorul poate impune salaria\u021bilor s\u0103-\u0219i ia concediul de odihn\u0103 \u00een perioada stabilit\u0103 conform program\u0103rii. Aceasta este o m\u0103sur\u0103 necesar\u0103 pentru a asigura respectarea drepturilor salaria\u021bilor \u0219i pentru a evita acumularea oboselii care poate afecta negativ at\u00e2t s\u0103n\u0103tatea acestora, c\u00e2t \u0219i performan\u021ba la locul de munc\u0103.<\/p>\n<p>Angajatorii trebuie s\u0103 se asigure c\u0103 salaria\u021bii \u00ee\u0219i iau concediul de odihn\u0103 anual \u00een natur\u0103, conform program\u0103rii stabilite. Aceasta nu este doar o obliga\u021bie legal\u0103, ci \u0219i una moral\u0103, av\u00e2nd \u00een vedere importan\u021ba repausului pentru men\u021binerea s\u0103n\u0103t\u0103\u021bii \u0219i eficien\u021bei muncii.
