Recent, Codul muncii a fost completat prin <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/283394\">Legea nr. 161\/2024<\/a>, care aduce noi reglement\u0103ri pentru munca de noapte. Acestea includ interdic\u021bia de a obliga la munca de noapte nu doar femeile gravide, l\u0103uze \u0219i cele care al\u0103pteaz\u0103, ci \u0219i <em><strong>p\u0103rin\u021bii care-\u0219i cresc singuri copiii<\/strong><\/em>.<\/p>\n<p>\u201eStudiile au demonstrat c\u0103 organismul uman este mai sensibil noaptea la perturb\u0103rile de mediu \u0219i la anumite forme solicitante de organizare a muncii \u0219i c\u0103 perioadele lungi de munc\u0103 de noapte pot afecta s\u0103n\u0103tatea lucr\u0103torilor \u0219i pot periclita securitatea la locul de munc\u0103\u201d, se arat\u0103 \u00een expunerea de motive a Directivei 2003\/88\/CE.<\/p>\n<p>Codul muncii con\u021bine dispozi\u021bii favorabile pentru cei care desf\u0103\u0219oar\u0103 activit\u0103\u021bi de noapte, dar pentru a beneficia de aceste drepturi este esen\u021bial s\u0103 fie clar identificate condi\u021biile \u00een care un angajat intr\u0103 \u00een categoria \u201esalariatului de noapte\u201d, conform art. 125 alin (2) din Codul muncii.<\/p>\n<h2><strong> Defini\u021bia salariatului de noapte<\/strong><\/h2>\n<p>Salariatul de noapte este definit ca cel al c\u0103rui program de lucru include cel pu\u021bin trei ore \u00een intervalul 22:00 \u2013 6:00 sau cel pu\u021bin 30% din timpul s\u0103u lunar de lucru. Astfel, indiferent dac\u0103 angajatul lucreaz\u0103 p\u00e2n\u0103 la miezul nop\u021bii sau dac\u0103, \u00een medie, peste 30% din orele sale de munc\u0103 lunare se desf\u0103\u0219oar\u0103 noaptea, acesta este considerat salariat de noapte.<\/p>\n<h2><strong> Reducerea timpului de lucru sau sporul salarial&nbsp;<\/strong><\/h2>\n<p>Conform art. 126 din Codul muncii, angajatorul poate alege fie s\u0103 reduc\u0103 timpul zilnic de munc\u0103 al salariatului de noapte cu o or\u0103 f\u0103r\u0103 a afecta drepturile salariale (lit. a), fie s\u0103 acorde un spor salarial de 25% pentru orele lucrate noaptea (lit. b). Prioritatea ar trebui s\u0103 fie reducerea programului de lucru, conform scopului Directivei europene care fundamenteaz\u0103 aceste reglement\u0103ri, asigur\u00e2ndu-se astfel un nivel de superior protec\u021bie.<\/p>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/06\/shutterstock_2291020251.jpg\"><img decoding=\"async\" class=\"alignnone wp-image-8234 size-full lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/06\/shutterstock_2291020251.jpg\" alt=\"munca de noapte codul muncii - reducerea timpului de lucru\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/06\/shutterstock_2291020251.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/06\/shutterstock_2291020251-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/06\/shutterstock_2291020251-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/p>\n<h2><strong> Durata maxim\u0103 a timpului de lucru<\/strong><\/h2>\n<p>Durata normal\u0103 a timpului de lucru pentru salariatul de noapte nu va dep\u0103\u0219i o medie de 8 ore pe zi, calculat\u0103 pe o perioad\u0103 de referin\u021b\u0103 de maximum 3 luni calendaristice, cu respectarea repausului s\u0103pt\u0103m\u00e2nal. Aceasta include \u0219i munca suplimentar\u0103, asigur\u00e2ndu-se c\u0103 angaja\u021bii nu lucreaz\u0103 mai mult de 8 ore pe zi \u00een medie, \u00eentr-o perioad\u0103 de 24 de ore.<\/p>\n<h2><strong> Condi\u021bii speciale de munc\u0103<\/strong><\/h2>\n<p>\u00cen cazul \u00een care activitatea se desf\u0103\u0219oar\u0103 \u00een condi\u021bii speciale sau deosebite de munc\u0103, durata normal\u0103 a timpului de lucru nu va dep\u0103\u0219i 8 ore pe parcursul oric\u0103rei perioade de 24 de ore. Medicul de medicina muncii va evalua aptitudinea lucr\u0103torului pentru munca de noapte, pe baza fi\u0219ei de identificare a factorilor de risc profesional.<\/p>\n<h2><strong> Protec\u021bia s\u0103n\u0103t\u0103\u021bii angaja\u021bilor<\/strong><\/h2>\n<p>Dac\u0103, ulterior \u00eenceperii activit\u0103\u021bii de noapte, sunt identificate probleme de s\u0103n\u0103tate legate de aceast\u0103 munc\u0103, angajatorul are obliga\u021bia de a transfera lucr\u0103torul la o munc\u0103 de zi pentru care este apt. Aceasta protec\u021bie este prev\u0103zut\u0103 de art. 127 alin (3) din Codul muncii, oferind angaja\u021bilor siguran\u021ba c\u0103 s\u0103n\u0103tatea lor nu va fi compromis\u0103.<\/p>\n<h2><strong> Excep\u021bii \u0219i protec\u021bie suplimentar\u0103<\/strong><\/h2>\n<p>Femeile gravide, l\u0103uze sau care al\u0103pteaz\u0103 pot presta munc\u0103 de noapte doar cu acordul lor \u0219i cu avizul medicului specialist.
