Neglijarea acestui drept fundamental nu numai c\u0103 poate genera tensiuni pe termen scurt, acceptate uneori de angaja\u021bi f\u0103r\u0103 a con\u0219tientiza poten\u021bialele nelegalit\u0103\u021bi, dar pe termen lung poate afecta serios s\u0103n\u0103tatea lucr\u0103torilor \u0219i, implicit, poate avea consecin\u021be asupra angajatorilor \u0219i bugetului de stat. Situa\u021biile \u00een care angajatorii nu respect\u0103 acordarea repausului s\u0103pt\u0103m\u00e2nal de 48 de ore consecutive ridic\u0103, de asemenea, probleme legate de munca suplimentar\u0103, put\u00e2nd chiar s\u0103 cad\u0103 sub inciden\u021ba muncii nedeclarate, \u00een cazul angaja\u021bilor cu timp par\u021bial, prin dep\u0103\u0219irea duratei contractuale de munc\u0103.<\/p>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/04\/shutterstock_2233738219.jpg\"><img decoding=\"async\" class=\"alignnone size-large wp-image-8107 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/04\/shutterstock_2233738219-1024x683.jpg\" alt=\"Repaus saptamanal\" width=\"1024\" height=\"683\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/04\/shutterstock_2233738219-1024x683.jpg 1024w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/04\/shutterstock_2233738219-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/04\/shutterstock_2233738219-768x512.jpg 768w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/04\/shutterstock_2233738219-1536x1024.jpg 1536w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/04\/shutterstock_2233738219.jpg 1680w\" data-sizes=\"(max-width: 1024px) 100vw, 1024px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1024px; --smush-placeholder-aspect-ratio: 1024\/683;\" \/><\/a><\/p>\n<p>Legisla\u021bia \u00een vigoare prevede sanc\u021biuni aplicabile de inspectorii de munc\u0103 \u0219i obliga\u021bia angajatorilor de a compensa munca suplimentar\u0103 efectuat\u0103, fie prin ore libere pl\u0103tite, fie prin acordarea unui spor salarial negociat, care nu poate fi inferior a 75% din salariul de baz\u0103. Codul muncii stipuleaz\u0103 c\u0103 munca suplimentar\u0103 trebuie compensat\u0103 \u00eentr-un termen de 90 de zile de la efectuarea acesteia, fie prin ore libere pl\u0103tite, fie prin acordarea unui spor salarial dac\u0103 termenul este dep\u0103\u0219it. \u00cen situa\u021bia neconformit\u0103\u021bii angajatorului cu aceste m\u0103suri, angajatul are dreptul de a se adresa instan\u021bei competente pentru recuperarea sumelor datorate, conform Legii 108\/1999.<\/p>\n<p>Este esen\u021bial ca angaja\u021bii s\u0103 fie bine informa\u021bi cu privire la aspectele ce \u021bin de munca suplimentar\u0103, inclusiv faptul c\u0103 aceasta este posibil\u0103 doar pentru angajamentele cu norm\u0103 \u00eentreag\u0103, fiind interzis\u0103 \u00een cazul contractelor cu timp par\u021bial \u0219i al minorilor. Angajatorul, nu angajatul, este cel care poate solicita efectuarea muncii suplimentare, iar angaja\u021bii trebuie s\u0103 de\u021bin\u0103 o copie a contractului de munc\u0103, care s\u0103 cuprind\u0103 detaliile legate de timpul de munc\u0103 \u0219i de repaus, inclusiv munc\u0103 suplimentar\u0103 \u0219i condi\u021biile de munc\u0103 \u00een zilele de s\u0103rb\u0103toare legal\u0103.<\/p>\n<p>Angajatul are dreptul de a refuza munca suplimentar\u0103 f\u0103r\u0103 a fi sanc\u021bionat pentru acest motiv. Conform Codului muncii, timpul maxim de munc\u0103 s\u0103pt\u0103m\u00e2nal, cu orele suplimentare incluse, nu poate dep\u0103\u0219i 48 de ore, cu excep\u021bii specifice reglementate. De asemenea, repartizarea timpului de munc\u0103 trebuie s\u0103 fie uniform\u0103, cu cinci zile de munc\u0103 consecutive urmate de dou\u0103 zile de repaus, iar orice suspendare a repausului s\u0103pt\u0103m\u00e2nal necesit\u0103 acordul salaria\u021bilor \u0219i autorizarea inspectoratelor teritoriale de munc\u0103, cu compensa\u021bii sporite pentru munca suplimentar\u0103 efectuat\u0103.<\/p>\n<p>Prin respectarea acestor norme se urm\u0103re\u0219te protec\u021bia securit\u0103\u021bii \u0219i s\u0103n\u0103t\u0103\u021bii lucr\u0103torilor, iar cunoa\u0219terea drepturilor \u0219i obliga\u021biilor at\u00e2t de c\u0103tre angajatori, c\u00e2t \u0219i de angaja\u021bi este esen\u021bial\u0103 pentru a asigura un mediu de munc\u0103 echitabil \u0219i s\u0103n\u0103tos.<\/p>\n<p style=\"text-align: left;\">Sursa foto <a href=\"http:\/\/shutterstock.com\">shutterstock.com<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Repaus s\u0103pt\u0103m\u00e2nal &#8211; Respectarea repausului s\u0103pt\u0103m\u00e2nal de 48 de ore consecutive \u0219i reglementarea muncii suplimentare constituie dou\u0103 aspecte esen\u021biale \u00een rela\u021bia dintre angajatori \u0219i angaja\u021bi cu norm\u0103 \u00eentreag\u0103.
