OUG 96\/2003 enumer\u0103, spre exemplu, \u00een Anexa nr. 1 o serie de activitati care pot prezenta un risc specific de expunere la agen\u021bi, procese sau condi\u021bii de munc\u0103, impun\u00e2nd angajatorilor datoria de a evalua aceste riscuri \u00een ceea ce prive\u0219te natura, intensitatea \u0219i durata expunerii salariatelor gravide \u0219i\/sau mame, l\u0103uze sau care al\u0103pteaz\u0103.<\/p>\n<p style=\"text-align: justify;\">Aceste reglement\u0103ri subliniaz\u0103 importan\u021ba protec\u021biei angajatelor \u00een st\u0103ri vulnerabile, stabilind norme precise pentru acordarea concediului de risc maternal atunci c\u00e2nd nu se pot lua alte m\u0103suri preventive.<\/p>\n<p style=\"text-align: justify;\">Procesul de acordare a acestui drept \u00eencepe odat\u0103 ce angajata \u00ee\u0219i informeaz\u0103 angajatorul despre sarcin\u0103 printr-o notificare scris\u0103, ata\u0219\u00e2nd \u0219i un aviz medical care confirm\u0103 starea sa. De aici, angajatorul, \u00eempreun\u0103 cu medicul de medicina muncii, are responsabilitatea de a \u00eendeplini o serie de obliga\u021bii \u00een termene stabilite, analiz\u00e2nd \u0219i lu\u00e2nd m\u0103surile necesare pentru protec\u021bia s\u0103n\u0103t\u0103\u021bii \u0219i securit\u0103\u021bii angajatei.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/03\/concediul-de-risc-maternal.-cine-plateste-scaled.jpg\"><img decoding=\"async\" class=\"alignnone size-large wp-image-8062 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/03\/concediul-de-risc-maternal.-cine-plateste-1024x683.jpg\" alt=\"concediul de risc maternal. pas cu pas\" width=\"1024\" height=\"683\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/03\/concediul-de-risc-maternal.-cine-plateste-1024x683.jpg 1024w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/03\/concediul-de-risc-maternal.-cine-plateste-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/03\/concediul-de-risc-maternal.-cine-plateste-768x512.jpg 768w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/03\/concediul-de-risc-maternal.-cine-plateste-1536x1024.jpg 1536w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2024\/03\/concediul-de-risc-maternal.-cine-plateste-2048x1366.jpg 2048w\" data-sizes=\"(max-width: 1024px) 100vw, 1024px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1024px; --smush-placeholder-aspect-ratio: 1024\/683;\" \/><\/a><\/p>\n<ol style=\"text-align: justify;\">\n<li>Angajatorii trebuie s\u0103 protejeze salariatele gravide, l\u0103uze sau care al\u0103pteaz\u0103 de orice risc care le-ar putea periclita s\u0103n\u0103tatea sau securitatea, inclusiv s\u0103 le exonereze de munc\u0103 care ar putea fi d\u0103una s\u0103n\u0103t\u0103\u021bii acestora, st\u0103rii de graviditate a acestora sau nou-n\u0103scu\u021bilor.<\/li>\n<li>Angajatorii au obliga\u021bia s\u0103 evalueze \u0219i s\u0103 monitorizeze \u00een mod constant riscurile la care sunt expuse salariatele, lu\u00e2nd m\u0103surile adecvate de preven\u021bie. Aceast\u0103 evaluare implic\u0103 participarea obligatorie a medicului de medicina muncii, iar concluziile \u0219i m\u0103surile de preven\u021bie trebuie documentate official. Angajatorul are la dispozi\u021bie un termen de cinci zile lucr\u0103toare pentru a distribui copii ale acestor rapoarte reprezentan\u021bilor salaria\u021bilor responsabili de securitate \u0219i s\u0103n\u0103tate \u00een munc\u0103 \u0219i de a informa \u00een scris salariata asupra rezultatelor evalu\u0103rii privind riscurile la care poate fi expus\u0103 la locul de munc\u0103, a m\u0103surilor care trebuie luate referitor la securitatea \u0219i s\u0103n\u0103tatea \u00een munc\u0103, precum \u0219i asupra drepturilor recunoscute de lege.<\/li>\n<li>\u00cen decurs de 10 zile lucr\u0103toare de la notificarea scris\u0103 a angajatei, angajatorul este obligat s\u0103 informeze medicul de medicina muncii \u0219i inspectoratul teritorial de munc\u0103 despre situa\u021bie, respect\u00e2nd confiden\u021bialitatea \u0219i divulg\u00e2nd informa\u021biile doar cu acordul expres al salariatei.<\/li>\n<li>Dac\u0103 evalu\u0103rile indic\u0103 un risc pentru angajata gravid\u0103, l\u0103uz\u0103 sau care al\u0103pteaz\u0103, angajatorul trebuie s\u0103 adapteze temporar condi\u021biile de munc\u0103 sau programul de lucru, evit\u00e2nd expunerea la riscuri, pe baza recomand\u0103rilor medicului de medicina muncii sau a medicului de familie, cu men\u021binerea veniturilor salariale.<\/li>\n<li>\u00cen cazul \u00een care angajatorul nu poate schimba condi\u021biile de munc\u0103, angajatorul va c\u0103uta s\u0103 redistribuie angajata pe un alt post de munc\u0103 sigur, conform recomand\u0103rilor medicului de medicina muncii ori a medicului de familie, de asemenea, cu p\u0103strarea remunera\u021biei.<\/li>\n<li>Dac\u0103 m\u0103surile de mai sus nu sunt fezabile din motive obiective, angajatele gravide, l\u0103uze sau care al\u0103pteaz\u0103 sunt eligibile pentru concediu de risc maternal:\n<ul>\n<li>\u00cenainte de data solicit\u0103rii concediului de maternitate, pentru salariatele gravide;<\/li>\n<li>Dup\u0103 data revenirii din concediul de l\u0103uzie obligatoriu \u00een cazul \u00een care nu solicit\u0103 concediul \u0219i indemniza\u021bia pentru cre\u0219terea \u0219i \u00eengrijirea copilului p\u00e2n\u0103 la \u00eemplinirea v\u00e2rstei de 2 ani sau, \u00een cazul copilului cu dizabilit\u0103\u021bi, p\u00e2n\u0103 la 3 ani.<\/li>\n<\/ul>\n<\/li>\n<li>Concediul de risc maternal poate fi acordat pentru perioade de maximum 30 de zile calendaristice, pe o durat\u0103 total\u0103 de maximum 120 de zile calendaristice, \u00een \u00eentregime sau frac\u0163ionat, asiguratelor gravide, asiguratelor care au n\u0103scut recent sau care al\u0103pteaz\u0103. Acordarea certificatului medical este condi\u021bionat\u0103 de respectarea salariatei a consulta\u021biilor prenatale \u0219i postnatale.<\/li>\n<li>Angajatele nu pot fi obligate s\u0103 lucreze noaptea f\u0103r\u0103 un acord explicit \u0219i un control medical prealabil. Conform HG 537\/2004 salariatele gravide, l\u0103uze sau care al\u0103pteaz\u0103 nu pot munci \u00een condi\u0163ii cu caracter insalubru sau greu de suportat, respectiv:<\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"list-style-type: none;\">\n<ul>\n<li>colectarea, transportul \u015fi depozitarea dejec\u0163iilor menajere, umane, animaliere;<\/li>\n<li>igienizarea grupurilor sanitare;<\/li>\n<li>s\u0103patul \u015fan\u0163urilor;<\/li>\n<li>\u00eenc\u0103rcatul sau desc\u0103rcatul cu lopata al diverselor produse;<\/li>\n<li>ridicarea unor greut\u0103\u0163i mai mari de 10 kg;<\/li>\n<li>munca \u00een condi\u0163ii de expunere la temperaturi extreme, definite conform prevederilor&nbsp;<a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/23101\">Ordonan\u0163ei de urgen\u0163\u0103 a Guvernului nr. 99\/2000<\/a>privind m\u0103surile ce pot fi aplicate \u00een perioadele cu temperaturi extreme pentru protec\u0163ia persoanelor \u00eencadrate \u00een munc\u0103, aprobat\u0103 prin&nbsp;<a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/29743\">Legea nr. 436\/2001<\/a>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong><em>Cine pl\u0103te\u0219te concediul de risc maternal<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Concediul de risc maternal se pl\u0103te\u0219te de c\u0103tre angajator, fiind ulterior decontat integral din FNUASS.
