Intrat\u0103 \u00een vigoare la 22 decembrie 2022 pentru entit\u0103\u021bile cu peste 250 de angaja\u021bi, aceast\u0103 lege impune necesitatea existen\u021bei unui canal intern de raportare \u0219i a procedurilor corespunz\u0103toare pentru protec\u021bia avertizorilor. Iat\u0103 cum se aplic\u0103 noile reglement\u0103ri \u0219i ce obliga\u021bii revin angajatorilor.<\/p>\n<p>Principala obliga\u021bie impus\u0103 de <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/262872\">Legea nr. 361\/2022<\/a> este aceea de a furniza un canal intern de raportare, oferind astfel avertizorilor posibilitatea de a semnala nereguli sau \u00eenc\u0103lc\u0103ri ale legii \u00een cadrul companiilor. Aceast\u0103 m\u0103sur\u0103, aplicabil\u0103 \u00eencep\u00e2nd cu 17 decembrie 2023 pentru firmele cu 50-249 de angaja\u021bi, a intrat \u00een vigoare la 22 decembrie 2022 pentru entit\u0103\u021bile cu peste 250 de angaja\u021bi.<\/p>\n<p>Raportarea, conform Legii avertizorilor, se refer\u0103 la comunicarea f\u0103cut\u0103 de avertizor, fie scris\u0103, fie oral\u0103, privind orice \u00eenc\u0103lcare a legii identificat\u0103 \u00een cadrul unei companii. Un aspect important este c\u0103 aceast\u0103 raportare are caracter intern, dar legea recunoa\u0219te avertizorului dreptul de a alege \u00eentre canalul intern \u0219i cel extern, \u00een anumite condi\u021bii.<\/p>\n<p>Pentru entit\u0103\u021bile vizate, cum ar fi autorit\u0103\u021bile, institu\u021biile publice, persoanele juridice de drept public \u0219i privat (inclusiv ONG-urile \u0219i societ\u0103\u021bile de avocatur\u0103), Legea avertizorilor impune anumite obliga\u021bii, iar nerespectarea acestora poate atrage amenzi \u00eentre 3.000 \u0219i 30.000 de lei. <strong><em>Este important de men\u021bionat c\u0103 angajatorii priva\u021bi cu mai pu\u021bin de 50 de angaja\u021bi nu sunt obliga\u021bi s\u0103 implementeze un canal intern de raportare conform prevederilor Legii 361\/2022.<\/em><\/strong><\/p>\n<p>Conform legisla\u021biei, entit\u0103\u021bile vizate trebuie s\u0103 stabileasc\u0103 proceduri care s\u0103 includ\u0103:<\/p>\n<p>a) metode de primire a raport\u0103rilor pentru a proteja confiden\u021bialitatea identit\u0103\u021bii avertizorului;<\/p>\n<p>b) confirmarea primirii raport\u0103rii \u00een termen de \u0219apte zile de la primire;<\/p>\n<p>c) desemnarea unei persoane sau a unui compartiment responsabil cu gestionarea raport\u0103rilor;<\/p>\n<p>d) desf\u0103\u0219urarea de ac\u021biuni subsecvente cu diligen\u021b\u0103;<\/p>\n<p>e) informarea avertizorului despre stadiul ac\u021biunilor subsecvente \u00een termen de trei luni de la primirea raportului;<\/p>\n<p>f) informarea conducerii companiei despre rezolvarea raport\u0103rilor;<\/p>\n<p>g) furnizarea de informa\u021bii despre procedurile de raportare extern\u0103;<\/p>\n<p>h) informarea avertizorului despre modul de solu\u021bionare a raportului.<\/p>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/12\/shutterstock_2264753323.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7965 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/12\/shutterstock_2264753323.jpg\" alt=\"Legea Whistleblower: Obliga\u021bii \u0219i Implica\u021bii pentru Companii \u00cencep\u00e2nd cu 17 Decembrie 2023\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/12\/shutterstock_2264753323.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/12\/shutterstock_2264753323-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/12\/shutterstock_2264753323-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/p>\n<p>Companiile sunt, de asemenea, obligate s\u0103 stabileasc\u0103 condi\u021bii \u00een care o raportare poate fi clasat\u0103 (respins\u0103) \u0219i s\u0103 comunice aceast\u0103 decizie avertizorului. Confidentialitatea identit\u0103\u021bii avertizorului trebuie men\u021binut\u0103 dup\u0103 efectuarea unei raport\u0103ri, iar informa\u021biile care ar putea duce la identificarea acestuia nu trebuie dezv\u0103luite.<\/p>\n<p>O alt\u0103 prevedere important\u0103 pentru companiile mai mici este posibilitatea de a se grupa \u0219i de a utiliza sau partaja resurse \u00een ceea ce prive\u0219te primirea raport\u0103rilor \u0219i ac\u021biunile subsecvente. \u00cen plus, entit\u0103\u021bile vizate trebuie s\u0103 desemneze o persoan\u0103 sau un compartiment responsabil cu primirea, \u00eenregistrarea, examinarea, desf\u0103\u0219urarea ac\u021biunilor subsecvente \u0219i solu\u021bionarea raport\u0103rilor, garant\u00e2nd impar\u021bialitatea \u0219i independen\u021ba \u00een exercitarea acestor atribu\u021bii.<\/p>\n<p>Aceast\u0103 persoan\u0103 sau compartiment, \u00eempreun\u0103 cu modalit\u0103\u021bile de raportare, trebuie s\u0103 fie aduse la cuno\u0219tin\u021ba fiec\u0103rui angajat prin afi\u0219are pe pagina de internet a institu\u021biei \u0219i prin afi\u0219are la sediu, \u00eentr-un loc vizibil \u0219i accesibil. Angajatorii au responsabilitatea de a se asigura c\u0103 cel pu\u021bin un mijloc de raportare este accesibil \u00een orice moment.<\/p>\n<p>\u00cen cazul \u00eenc\u0103lc\u0103rii acestei obliga\u021bii, amenzile prev\u0103zute de lege pot ajunge \u00eentre 4.000 \u0219i 40.000 de lei.
