Una dintre modific\u0103rile majore este eliminarea Comisiei de evaluare din schema stagiaturii, iar atribu\u021biile acesteia vor fi transferate mentorului stagiarului. Aceast\u0103 decizie are scopul de a simplifica procesul \u0219i de a face stagiatura mai accesibil\u0103 \u0219i mai eficient\u0103 la nivel formal.<\/p>\n<p>\u00cen temeiul Legii nr. 408\/2023, mentorul va prelua atribu\u021biile de evaluare, av\u00e2nd responsabilitatea de a evalua obiectiv activitatea stagiarului \u0219i de a propune modalit\u0103\u021bi de \u00eembun\u0103t\u0103\u021bire a performan\u021belor acestuia. De asemenea, stagiarul nu mai este obligat s\u0103 \u00eentocmeasc\u0103 raportul de stagiu \u0219i s\u0103 organizeze eviden\u021ba activit\u0103\u021bilor, reduc\u00e2nd astfel barierele administrative.<\/p>\n<p>O alt\u0103 schimbare important\u0103 este legat\u0103 de procesul de finalizare a stagiului. Mentorul va \u00eentocmi referatul de evaluare cu zece zile lucr\u0103toare \u00eenainte de terminarea stagiului, iar angajatorul va elibera un certificat sau o adeverin\u021b\u0103 de finalizare pe baza acestui referat. De asemenea, stagiarul va primi referatul \u00een termen de trei zile lucr\u0103toare \u0219i are posibilitatea s\u0103-l conteste, dac\u0103 este cazul.<\/p>\n<p>Pentru a face stagierea \u0219i mai atractiv\u0103, Legea 408\/2023 aduce beneficii \u0219i angajatorilor. Ace\u0219tia pot solicita finan\u021bare din partea statului pe perioada derul\u0103rii contractului de stagiu, \u00een cuantum de 2.250 lei\/lun\u0103. Procedurile pentru ob\u021binerea finan\u021b\u0103rii au fost simplificate, iar angajatorii trebuie s\u0103 \u00eencheie o conven\u021bie special\u0103 cu agen\u021bia teritorial\u0103 pentru ocuparea for\u021bei de munc\u0103 \u0219i s\u0103 depun\u0103 lunar documentele necesare pentru a beneficia de aceast\u0103 facilitate.<\/p>\n<p>Contractele de stagiu \u00eencheiate \u00een acord cu prevederile Legii 335\/2013 aflat\u0103 \u00een derulare la data de 22 decembrie 2023, \u00ee\u0219i vor produce efectele p\u00e2n\u0103 la expirarea duratei pentru care au fost \u00eencheiate, respect\u00e2nd regulile \u00een vigoare la momentul \u00eencheierii contractului. Este de a\u0219teptat ca aceste ajust\u0103ri s\u0103 fac\u0103 procesul de stagiu mai atractiv \u0219i mai eficient pentru to\u021bi cei implica\u021bi.<\/p>\n<p>Guvernul are responsabilitatea s\u0103 ajusteze normele de aplicare ale Legii 335\/2013, care au fost aprobate prin <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/205325\">Hot\u0103r\u00e2rea de Guvern 473\/2014<\/a>, \u00eentr-un interval de 90 de zile de la momentul \u00een care legea a intrat \u00een vigoare. Conform acesteia, angajatorii care \u00eencheie contracte de stagiu au posibilitatea s\u0103 solicite o finan\u021bare din partea statului \u00een cuantum de 2.250 lei lunar pe durata derul\u0103rii contractului de stagiu.<\/p>\n<p>Pentru a beneficia de aceast\u0103 finan\u021bare, angajatorii trebuie s\u0103 respecte urm\u0103torii pa\u0219i:<\/p>\n<ul>\n<li>S\u0103 elaboreze contracte scrise de stagiu, care s\u0103 serveasc\u0103 drept anexe la contractele individuale de munc\u0103 ale stagiariilor;<\/li>\n<li>S\u0103 se prezinte la agen\u021bia teritorial\u0103 pentru ocuparea for\u021bei de munc\u0103 \u00een termen de 30 de zile lucr\u0103toare de la \u00eencheierea contractului de stagiu, unde s\u0103 \u00eencheie o conven\u021bie special\u0103;<\/li>\n<li>S\u0103 depun\u0103 la agen\u021bia de munc\u0103 o serie de documente, printre care copii ale actelor de identitate ale stagiariilor, ale contractelor individuale de munc\u0103 \u0219i ale celor de stagiu;<\/li>\n<li>S\u0103 transmit\u0103 lunar la agen\u021bia de munc\u0103 un tabel nominal cu stagiarii, fi\u0219a de eviden\u021b\u0103 zilnic\u0103 a activit\u0103\u021bilor acestora \u0219i statele de plat\u0103 corespunz\u0103toare fiec\u0103rei luni.<\/li>\n<\/ul>\n<p>Este important de men\u021bionat c\u0103 finan\u021barea din partea statului se acord\u0103 doar pentru perioada \u00een care raportul de munc\u0103 este \u00een desf\u0103\u0219urare, respectiv c\u00e2t timp nu este suspendat, iar suma acordat\u0103 este propor\u021bional\u0103 cu timpul efectiv lucrat de stagiari.<\/p>\n<p>\u00cen situa\u021bia \u00een care angajatorul decide s\u0103 \u00eentrerup\u0103 contractul de munc\u0103 al stagiarului (f\u0103r\u0103 a fi necesar preavizul), acesta nu va mai primi suma aferent\u0103 finan\u021b\u0103rii. Mai mult, va fi obligat s\u0103 returneze sumele deja primite, la care se adaug\u0103 dob\u00e2nda de referin\u021b\u0103 a B\u0103ncii Na\u021bionale a Rom\u00e2niei, \u00een vigoare la data \u00eencet\u0103rii raportului de munc\u0103.<\/p>\n<h2><strong>Multitudinea de documente solicitate face ca acest program s\u0103 nu fie foarte atractiv pentru angajatori<\/strong><\/h2>\n<p>Aceast\u0103 modalitate de preg\u0103tire nu reprezint\u0103 o op\u021biune atr\u0103g\u0103toare pentru angajatori, conform statisticilor prezentate \u00een expunerea de motive a proiectului de lege, furnizate de Ministerul Muncii. Mai precis, \u00een anul 2020, doar 26 de absolven\u021bi de studii superioare au fost \u00eencadra\u021bi \u00een locuri de munc\u0103 destinate stagiarilor, conform datelor Agen\u021biei Na\u021bionale pentru Ocuparea For\u021bei de Munc\u0103, \u00een timp ce \u00een 2021 acest num\u0103r a sc\u0103zut la doar doi absolven\u021bi.<\/p>\n<p>Rezultatele unui chestionar distribuit angajatorilor care au beneficiat de prevederile Legii stagiaturii evidentiaz\u0103 c\u0103 ace\u0219tia consider\u0103, \u00een propor\u021bie de 33,3%, c\u0103 procesul de \u00eencheiere a unui contract de stagiatur\u0103 este birocratic. Jum\u0103tate dintre responden\u021bi identific\u0103 procedurile \u00eendelungate \u0219i dificult\u0103\u021bile \u00een organizarea perioadei de stagiu \u0219i \u00een evaluarea stagiariilor drept principalele probleme. \u00cen plus, 83,3% dintre participan\u021bi sunt de p\u0103rere c\u0103 evaluarea ar trebui realizat\u0103 de c\u0103tre angajator, iar 66,7% consider\u0103 c\u0103 evaluarea stagiariilor ar trebui efectuat\u0103 prin observarea direct\u0103 a activit\u0103\u021bii acestora, comportamentului, performan\u021belor \u0219i \u00eendeplinirii obiectivelor stabilite \u00een raport cu programul de activit\u0103\u021bi aprobat de angajator.<\/p>\n<p>De asemenea, se constat\u0103 c\u0103 angajatorii nu manifest\u0103 interes fa\u021b\u0103 de subven\u021biile acordate pentru organizarea de stagii profesionale, motivul principal fiind volumul mare de documente ce trebuie \u00eentocmite, \u00een special la \u00eencheierea perioadei de stagiu, conform preciz\u0103rilor din nota de fundamentare.<\/p>\n<p>Photo credit&nbsp;<a href=\"https:\/\/www.shutterstock.com\/\" target=\"_blank\" rel=\"noopener\">shutterstock.com<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Odat\u0103 cu intrarea \u00een vigoare a Legii nr. 408\/2023, stagiatura la locul de munc\u0103 cunoa\u0219te schimb\u0103ri semnificative menite s\u0103 fac\u0103 acest proces mai atractiv pentru angajatori.
