Metodologia, recent publicat\u0103, ofer\u0103 linii directoare utile pentru angajatori privind situa\u021biile de h\u0103r\u021buire \u0219i impune obliga\u021bii referitoare la formarea profesional\u0103 anual\u0103, elaborarea unui ghid \u0219i actualizarea regulamentului intern. Este important de men\u021bionat c\u0103, potrivit noii reglement\u0103ri, aceast\u0103 metodologie este obligatorie pentru to\u021bi angajatorii, indiferent de m\u0103rimea personalului.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00cenc\u0103 din 2020, s-a stabilit c\u0103 angajatorul are responsabilitatea de a lua toate m\u0103surile necesare pentru prevenirea \u0219i combaterea h\u0103r\u021buirii morale la locul de munc\u0103, inclusiv prin introducerea de sanc\u021biuni disciplinare \u00een regulamentul intern pentru angaja\u021bii care s\u0103v\u00e2r\u0219esc astfel de fapte. Nerespectarea acestei obliga\u021bii este sanc\u021bionat\u0103 conform OG nr. 137\/2000, cu amenzi cuprinse \u00eentre 30.000 \u0219i 50.000 de lei. Totodat\u0103, s-a interzis stabilirea de c\u0103tre angajatori a regulilor sau m\u0103surilor interne care s\u0103 \u00eencurajeze h\u0103r\u021buirea moral\u0103 la locul de munc\u0103, sanc\u021bionat\u0103 cu amenzi de la 50.000 la 200.000 de lei.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00cen conformitate cu Legea nr. 202\/2002, angajatorii sunt obliga\u021bi s\u0103 informeze permanent angaja\u021bii cu privire la drepturile acestora \u00een ceea ce prive\u0219te egalitatea de \u0219anse \u0219i tratament \u00eentre femei \u0219i b\u0103rba\u021bi \u00een rela\u021biile de munc\u0103. Din 2018, institu\u021biile \u0219i autorit\u0103\u021bile publice centrale \u0219i locale, precum \u0219i companiile private cu peste 50 de angaja\u021bi, au posibilitatea de a desemna un angajat responsabil cu egalitatea de \u0219anse. Acesta poate fi \u00eens\u0103rcinat cu atribu\u021bii specifice \u00een domeniu, iar angajatorul poate opta pentru angajarea unui expert \u00een egalitate de \u0219anse. Prin HG nr. 262\/2019 s-au introdus norme suplimentare, inclusiv planuri anuale de ac\u021biune privind implementarea principiului egalit\u0103\u021bii de \u0219anse \u00eentre femei \u0219i b\u0103rba\u021bi.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/12\/shutterstock_1338049139.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7929 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/12\/shutterstock_1338049139.jpg\" alt=\"Hartuire\" width=\"1000\" height=\"587\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/12\/shutterstock_1338049139.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/12\/shutterstock_1338049139-300x176.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/12\/shutterstock_1338049139-768x451.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/587;\" \/><\/a><\/span><\/p>\n<p><span style=\"font-weight: 400;\">De\u0219i responsabilul cu egalitate de \u0219anse \u0219i tratament nu este impus angajatorilor, obliga\u021biile de informare, prevedere \u00een regulamentul intern \u0219i prevenire r\u0103m\u00e2n valabile pentru to\u021bi angajatorii, conform legisla\u021biei men\u021bionate anterior.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Astfel, <\/span><a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/275395\"><span style=\"font-weight: 400;\">hot\u0103r\u00e2rea<\/span><\/a><span style=\"font-weight: 400;\"> nr. 970 din 12 octombrie 2023pentru aprobarea&nbsp;<\/span><a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/275396\"><span style=\"font-weight: 400;\">Metodologiei<\/span><\/a><span style=\"font-weight: 400;\">&nbsp;privind prevenirea \u0219i combaterea h\u0103r\u021buirii pe criteriul de sex, precum \u0219i a h\u0103r\u021buirii morale la locul de munc\u0103 se aplic\u0103 tuturor angajatorilor, indiferent de dimensiunea personalului \u0219i domeniul de activitate.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aceast\u0103 metodologie impune urm\u0103toarele obliga\u021bii angajatorilor \u0219i conduc\u0103torilor \u00een vederea prevenirii \u0219i combaterii h\u0103r\u021buirii:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Implementarea metodologiei adaptat\u0103 situa\u021biei specifice a angajatorului, cu posibilitatea elabor\u0103rii unui ghid propriu privind prevenirea \u0219i combaterea h\u0103r\u021buirii, adaptat condi\u021biilor de munc\u0103 specifice.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Introducerea dispozi\u021biilor <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/24129\" target=\"_blank\" rel=\"noopener\">OG 137\/2000<\/a> \u0219i ale <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/35778\" target=\"_blank\" rel=\"noopener\">Legii nr. 202\/2002<\/a> \u00een regulamentul de ordine interioar\u0103.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Interzicerea \u0219i sanc\u021bionarea ac\u021biunilor ce pot duce la h\u0103r\u021buire moral\u0103 sau h\u0103r\u021buire pe criteriul de sex.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Crearea unui cadru de m\u0103suri de prevenire \u0219i protec\u021bie prin <a href=\"https:\/\/www.lugera.ro\/blog\/instruirea-anuala-privind-prevenirea-hartuirii-la-locul-de-munca-ce-prevede-hg-970-2023\/\" target=\"_blank\" rel=\"noopener\">instruirea angaja\u021bilor<\/a> \u00een vederea con\u0219tientiz\u0103rii \u0219i prevenirii fenomenului de h\u0103r\u021buire.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Informarea \u0219i instruirea anual\u0103 a angaja\u021bilor cu privire la prevederile metodologiei.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Diseminarea metodologiei prin toate mijloacele interne de comunicare \u0219i informare a angaja\u021bilor.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Conform prevederilor metodologiei \u201c<\/span><span style=\"font-weight: 400;\">Angajatorul, at\u00e2t din mediul public, c\u00e2t \u0219i din cel privat, cunoa\u0219te importan\u021ba monitoriz\u0103rii prezentului ghid privind prevenirea \u0219i combaterea h\u0103r\u021buirii pe criteriu de sex, precum \u0219i a h\u0103r\u021buirii morale la locul de munc\u0103 \u0219i se va asigura de aplicarea acestuia, \u00een termen de 6 luni de la intrarea \u00een vigoare a acestuia. Conduc\u0103torii direc\u021biilor, serviciilor, compartimentelor \u0219i responsabilii cu gestionarea cazurilor de h\u0103r\u021buire vor monitoriza \u0219i vor raporta conducerii institu\u021biei modalitatea de respectare a aplic\u0103rii prevederilor prezentului ghid, p\u00e2n\u0103 la sf\u00e2r\u0219itul primului trimestru al fiec\u0103rui an, pentru anul precedent, inclusiv num\u0103rul de incidente \u00eenregistrate \u0219i modul \u00een care acestea au fost solu\u021bionate, precum \u0219i recomand\u0103rile trasate.\u201d&nbsp;<\/span><\/p>\n<p>Conform HG 970\/2023, angajatorii trebuie s\u0103 organizeze instruiri anuale.
