<\/strong><\/h2>\n<p>Suspendarea contractului individual de munc\u0103 poate interveni fie \u00een mod automat, cu acordul ambelor p\u0103r\u021bi, fie prin decizia unilateral\u0103 a uneia dintre p\u0103r\u021bi. <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/128647\" target=\"_blank\" rel=\"noopener\">Conform Codului Muncii<\/a>, suspendarea contractului individual de munc\u0103 implic\u0103 \u00eencetarea temporar\u0103 a muncii prestate de c\u0103tre salariat \u0219i a pl\u0103\u021bii salariului de c\u0103tre angajator.<\/p>\n<p>Trebuie subliniat c\u0103 pe durata suspend\u0103rii pot exista \u00een continuare alte drepturi \u0219i obliga\u021bii pentru p\u0103r\u021bile implicate, care pot fi reglementate prin legi speciale, contracte colective de munc\u0103, contracte individuale de munc\u0103 sau regulamente interne.<\/p>\n<p>Dac\u0103 suspendarea contractului de munc\u0103 are la baz\u0103 o ac\u021biune imputabil\u0103 salariatului, pe durata suspend\u0103rii acesta nu va beneficia de niciun drept specific func\u021biei sale de salariat.<\/p>\n<p>\u00cen cazul \u00een care, \u00een timpul suspend\u0103rii contractului, apare o cauz\u0103 legal\u0103 de \u00eencetare de drept a contractului de munc\u0103, trebuie s\u0103 preciz\u0103m c\u0103 aceasta va prevala. \u00cen acord cu prevederile Codului Muncii, \u201d\u00ee<em>n cazul suspend\u0103rii contractului individual de munc\u0103, se suspend\u0103 toate termenele care au leg\u0103tura cu \u00eencheierea, modificarea, executarea sau \u00eencetarea contractului individual de munc\u0103, cu excep\u021bia situa\u021biilor \u00een care contractul individual de munc\u0103 \u00eenceteaz\u0103 de drept.<\/em>\u201d<\/p>\n<h2><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/10\/shutterstock_2339360709.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7860 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/10\/shutterstock_2339360709.jpg\" alt=\"suspendarea contractului de munca drepturi\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/10\/shutterstock_2339360709.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/10\/shutterstock_2339360709-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/10\/shutterstock_2339360709-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/h2>\n<h2><strong>Contractul individual de munc\u0103 se suspend\u0103 de drept \u00een urm\u0103toarele situa\u021bii: <\/strong><\/h2>\n<p>a) concediu de maternitate;<\/p>\n<p>b) concediu pentru incapacitate temporar\u0103 de munc\u0103;<\/p>\n<p>c) carantin\u0103;<\/p>\n<p>d) exercitarea unei func\u021bii \u00een cadrul unei autorit\u0103\u021bi executive, legislative ori judec\u0103tore\u0219ti, pe toat\u0103 durata mandatului, dac\u0103 legea nu prevede altfel;<\/p>\n<p>e) \u00eendeplinirea unei func\u021bii de conducere salarizate \u00een sindicat;<\/p>\n<p>f) for\u021ba major\u0103;<\/p>\n<p>g) \u00een cazul \u00een care salariatul este arestat preventiv, \u00een condi\u021biile <a href=\"https:\/\/lege5.ro\/Gratuit\/geztkobvha\/codul-de-procedura-penala-din-2010\" target=\"_blank\" rel=\"noopener\">Codului de procedur\u0103 penal\u0103<\/a>;<\/p>\n<p>h) de la data expir\u0103rii perioadei pentru care au fost emise avizele, autoriza\u021biile ori atest\u0103rile necesare pentru exercitarea profesiei. Dac\u0103 \u00een termen de 6 luni salariatul nu \u0219i-a re\u00eennoit avizele, autoriza\u021biile ori atest\u0103rile necesare pentru exercitarea profesiei, contractul individual de munc\u0103 \u00eenceteaz\u0103 de drept;<\/p>\n<p>i) \u00een alte cazuri expres prev\u0103zute de lege.<\/p>\n<h2><strong>Contractul individual de munc\u0103 poate fi suspendat \u0219i din ini\u021biativa salariatului, \u00een urm\u0103toarele situa\u021bii: <\/strong><\/h2>\n<p>a) concediu pentru cre\u0219terea copilului \u00een v\u00e2rst\u0103 de p\u00e2n\u0103 la 2 ani sau, \u00een cazul copilului cu dizabilit\u0103\u021bi, p\u00e2n\u0103 la \u00eemplinirea v\u00e2rstei de 3 ani;<\/p>\n<p>b) concediu pentru \u00eengrijirea copilului bolnav \u00een v\u00e2rst\u0103 de p\u00e2n\u0103 la 7 ani sau, \u00een cazul copilului cu dizabilit\u0103\u021bi, pentru afec\u021biuni intercurente, p\u00e2n\u0103 la \u00eemplinirea v\u00e2rstei de 18 ani;<\/p>\n<p>c) concediu paternal;<\/p>\n<p>d) concediu pentru formare profesional\u0103;<\/p>\n<p>e) exercitarea unor func\u021bii elective \u00een cadrul organismelor profesionale constituite la nivel central sau local, pe toat\u0103 durata mandatului;<\/p>\n<p>f) participarea la grev\u0103;<\/p>\n<p>g) concediu de acomodare.<\/p>\n<p>(2) Contractul individual de munc\u0103 poate fi suspendat \u00een situa\u021bia absen\u021belor nemotivate ale salariatului, \u00een condi\u021biile stabilite prin contractul colectiv de munc\u0103 aplicabil, contractul individual de munc\u0103, precum \u0219i prin regulamentul intern.<\/p>\n<p>(3) Drepturile dob\u00e2ndite de salariat anterior momentului acord\u0103rii concediilor prev\u0103zute la alin. (1) \u0219i la art. 1521 ori absent\u0103rii de la locul de munc\u0103 \u00een condi\u021biile prev\u0103zute la art. 1522 se men\u021bin pe toat\u0103 durata concediului, respectiv a perioadei de absen\u021b\u0103.<\/p>\n<p>Din 2023, conform <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/270741\" target=\"_blank\" rel=\"noopener\">Legii nr. 140<\/a>, s-a introdus \u00een Codul Muncii o nou\u0103 situa\u021bie de <a href=\"https:\/\/www.lugera.ro\/blog\/suspendare-contract-de-munca-un-nou-caz-de-suspendare-la-initiativa-salariatului-este-aplicabil-din-29-mai\/\" target=\"_blank\" rel=\"noopener\">suspendare la ini\u021biativa salariatului<\/a>: h) desf\u0103\u0219urarea, pe baza de contract legal, a activit\u0103\u021bii de asistent maternal, asistent personal pentru persoane cu dizabilit\u0103\u021bi grave sau asistent personal profesionist. Toate drepturile dob\u00e2ndite de salariat \u00eenainte de suspendare, precum \u0219i cele prev\u0103zute de articolul 152 din Codul Muncii, care stipuleaz\u0103 c\u0103 \u00een cazul unor evenimente familiale deosebite, salaria\u021bii au dreptul la zile libere pl\u0103tite, care nu se includ \u00een concediul de odihn\u0103, r\u0103m\u00e2n valabile pe durata suspend\u0103rii.<\/p>\n<p>De asemenea, suspendarea contractului individual de munc\u0103 poate interveni \u00een cazul absen\u021bei nejustificate a salariatului, \u00een conformitate cu prevederile contractului colectiv de munc\u0103 aplicabil, contractului individual de munc\u0103 sau regulamentului intern.<\/p>\n<h2><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/10\/shutterstock_1390203548.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7861 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/10\/shutterstock_1390203548.jpg\" alt=\"suspendarea contractului de munca initiative\" width=\"1000\" height=\"668\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/10\/shutterstock_1390203548.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/10\/shutterstock_1390203548-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/10\/shutterstock_1390203548-768x513.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/668;\" \/><\/a><\/h2>\n<h2><strong>Suspendarea la Ini\u021biativa Angajatorului a Contractului individual de munc\u0103 poate surveni \u00een urm\u0103toarele situa\u021bii: <\/strong><\/h2>\n<p>a) pe durata cercet\u0103rii disciplinare prealabile, \u00een condi\u021biile legii [declarat neconstitu\u021bional prin Decizia Cur\u021bii Constitu\u021bionale nr. 261\/2016];<\/p>\n<p>b) \u00een cazul \u00een care angajatorul a formulat pl\u00e2ngere penal\u0103 \u00eempotriva salariatului sau acesta a fost trimis \u00een judecat\u0103 pentru fapte penale incompatibile cu func\u021bia sa, p\u00e2n\u0103 la r\u0103m\u00e2nerea definitiv\u0103 a hot\u0103r\u00e2rii judec\u0103tore\u0219ti [declarat par\u021bial neconstitu\u021bional prin Decizia Cur\u021bii Constitu\u021bionale nr. 279\/2015];<\/p>\n<p>c) \u00een caz de \u00eentrerupere sau reducere temporar\u0103 a activit\u0103\u021bii, f\u0103r\u0103 \u00eencetarea raportului de munc\u0103, din motive economice, tehnologice, structurale sau similare;<\/p>\n<p>c1) \u00een cazul \u00een care \u00eempotriva salariatului s-a luat, \u00een condi\u021biile Codului de procedur\u0103 penal\u0103, m\u0103sura controlului judiciar ori a controlului judiciar pe cau\u021biune, dac\u0103 \u00een sarcina acestuia au fost stabilite obliga\u021bii care \u00eempiedic\u0103 executarea contractului de munc\u0103, precum \u0219i \u00een cazul \u00een care salariatul este arestat la domiciliu, iar con\u021binutul m\u0103surii \u00eempiedic\u0103 executarea contractului de munc\u0103;<\/p>\n<p>d) pe durata deta\u0219\u0103rii;<\/p>\n<p>e) pe durata suspend\u0103rii de c\u0103tre autorit\u0103\u021bile competente a avizelor, autoriza\u021biilor sau atest\u0103rilor necesare pentru a exercita o anumit\u0103 profesie;<\/p>\n<p>f) pe durata suspend\u0103rii temporare a activit\u0103\u021bii \u0219i\/sau a reducerii acesteia ca urmare a decret\u0103rii st\u0103rii de asediu sau st\u0103rii de urgen\u021b\u0103 potrivit art. 93 alin. (1) din <a href=\"https:\/\/www.constitutiaromaniei.ro\/\" target=\"_blank\" rel=\"noopener\">Constitu\u021bia Rom\u00e2niei<\/a>, republicat\u0103.<\/p>\n<p>(2) \u00cen cazurile prev\u0103zute la alin. (1) lit. a) \u0219i b), dac\u0103 se constat\u0103 nevinov\u0103\u021bia celui \u00een cauz\u0103, salariatul \u00ee\u0219i reia activitatea anterioar\u0103 \u0219i i se pl\u0103te\u0219te, \u00een temeiul normelor \u0219i principiilor r\u0103spunderii civile contractuale, o desp\u0103gubire egal\u0103 cu salariul \u0219i celelalte drepturi de care a fost lipsit pe perioada suspend\u0103rii contractului.<\/p>\n<p>(3) \u00cen cazul reducerii temporare a activit\u0103\u021bii, pentru motive economice, tehnologice, structurale sau similare, pe perioade care dep\u0103\u0219esc 30 de zile lucr\u0103toare, angajatorul va avea posibilitatea reducerii programului de lucru de la 5 zile la 4 zile pe s\u0103pt\u0103m\u00e2n\u0103, cu reducerea corespunz\u0103toare a salariului, p\u00e2n\u0103 c\u00e2nd situa\u021bia care a cauzat reducerea programului este remediat\u0103, cu consultarea prealabil\u0103 a sindicatului reprezentativ de la nivelul unit\u0103\u021bii sau a reprezentan\u021bilor salaria\u021bilor, dup\u0103 caz.<\/p>\n<h2><strong>Suspendarea prin Acordul P\u0103r\u021bilor <\/strong><\/h2>\n<p>Contractul individual de munc\u0103 poate fi suspendat prin acordul ambelor p\u0103r\u021bi \u00een cazul concediilor f\u0103r\u0103 plat\u0103 pentru studii sau interese personale.<\/p>\n<p>Photo credit&nbsp;shutterstock.com<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Exist\u0103 numeroase situa\u021bii \u00een care contractul de munc\u0103 poate fi suspendat, iar cele mai comune includ concediul de maternitate, concediul medical, concediul pentru cre\u0219terea copilului cu v\u00e2rsta de p\u00e2n\u0103 la 2 ani sau concediul pentru formare profesional\u0103.
