Legea prevede c\u0103 acesta trebuie s\u0103 anun\u021be concediul medical la to\u021bi angajatorii s\u0103i, chiar \u0219i \u00een cazul \u00een care unul dintre locurile de munc\u0103 implic\u0103 telemunc\u0103. Ignorarea acestei cerin\u021be poate duce la amenzi \u0219i obliga\u021bia de a returna indemniza\u021bia de concediu medical. Conform legii, este specificat angajatorul care trebuie s\u0103 primeasc\u0103 certificatul \u00een original \u0219i care trebuie s\u0103 primeasc\u0103 copiile certificate.<\/p>\n<p>Astfel, conform <a href=\"https:\/\/www.codulmuncii.ro\/homepage.html\">Codului Muncii<\/a>, o persoan\u0103 poate avea mai multe contracte de munc\u0103 simultan, cu condi\u021bia s\u0103 nu aib\u0103 mai multe programe de lucru care s\u0103 se suprapun\u0103. Dac\u0103 acesta lucreaz\u0103 pentru mai mul\u021bi angajatori, trebuie s\u0103 declare c\u0103 este \u00een concediu medical la to\u021bi ace\u0219tia. Motivul este simplu: atunci c\u00e2nd angajatul se afl\u0103 \u00een concediu medical, raportul de munc\u0103 este suspendat temporar, ceea ce \u00eenseamn\u0103 c\u0103 nu poate s\u0103-\u0219i \u00eendeplineasc\u0103 responsabilit\u0103\u021bile de lucru. Mai mult, prime\u0219te o indemniza\u021bie pentru concediul medical.<\/p>\n<p>Conform Ordonan\u021bei de Urgen\u021b\u0103 nr. 158\/2005, indemniza\u021biile de concediu se calculeaz\u0103 \u0219i se pl\u0103tesc de c\u0103tre &nbsp;fiecare angajator la care angajatul a lucrat cel pu\u021bin \u0219ase luni (aceste perioade nu se cumuleaz\u0103, ci se evalueaz\u0103 separat), iar baza de calcul pentru fiecare indemniza\u021bie este venitul ob\u021binut la fiecare loc de munc\u0103. Singura excep\u021bie prev\u0103zut\u0103 de ordonan\u021b\u0103 este situa\u021bia cadrelor didactice care \u00ee\u0219i completeaz\u0103 norma didactic\u0103 la mai multe institu\u021bii de \u00eenv\u0103\u021b\u0103m\u00e2nt. (Articolul 58 din <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/265580\">ORDINul nr. 670\/131\/2023<\/a>, pentru modificarea \u0219i completarea&nbsp;<a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/253968\">Normelor<\/a>&nbsp;de aplicare a prevederilor&nbsp;<a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/264157\">Ordonan\u021bei de urgen\u021b\u0103 a Guvernului nr. 158\/2005<\/a>&nbsp;privind concediile \u0219i indemniza\u021biile de asigur\u0103ri sociale de s\u0103n\u0103tate, aprobate prin&nbsp;<a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/253967\">Ordinul ministrului s\u0103n\u0103t\u0103\u021bii \u0219i al pre\u0219edintelui Casei Na\u021bionale de Asigur\u0103ri de S\u0103n\u0103tate nr. 15\/2018\/1.311\/2017<\/a> (2)&nbsp;Prin excep\u021bie de la alin. Spre exemplu, chiar dac\u0103 unul dintre locurile de munc\u0103 ale acestuia presupune telemunc\u0103, aceasta nu \u00eenseamn\u0103 c\u0103 poate continua s\u0103 lucreze \u00een timpul unui concediu medical. A\u0219adar, indiferent dac\u0103 acesta lucreaz\u0103 la birou sau \u00een alt\u0103 loca\u021bie, el nu poate s\u0103 \u00ee\u0219i \u00eendeplineasc\u0103 sarcinile de lucru \u00een timpul concediului medical.<\/p>\n<p><strong><em>Este important de men\u021bionat c\u0103, \u00een cazul \u00een care un angajat nu \u00eendepline\u0219te cerin\u021bele legale pentru a beneficia de concediul medical \u0219i indemniza\u021bia aferent\u0103, el nu va fi trecut ca absent nemotivat de c\u0103tre angajator. Certificatul medical este utilizat pentru a motiva absen\u021ba.<\/em><\/strong><\/p>\n<h2><strong>Angajatul dispune de un singur certificat medical.
