Aceast\u0103 suspendare are loc atunci c\u00e2nd salariatul desf\u0103\u0219oar\u0103 o activitate specific\u0103 ca asistent maternal, asistent personal pentru persoane cu handicap sever sau asistent personal profesionist, conform unui contract \u00eencheiat \u00een conformitate cu legea. Aceast\u0103 ocupa\u021bie este reglementat\u0103 at\u00e2t de Legea nr. 272\/2004 privind protec\u021bia \u0219i promovarea drepturilor copilului, c\u00e2t \u0219i de Hot\u0103r\u00e2rea Guvernului nr. 679\/2003 privind condi\u021biile de ob\u021binere a atestatului, procedurile de atestare \u0219i statutul asistentului maternal profesionist.<\/p>\n<p>Pentru a desf\u0103\u0219ura activitatea de asistent maternal, este necesar s\u0103 ob\u021bine\u021bi un atestat, care este emis pe o perioad\u0103 maxim\u0103 de trei ani, dar poate fi re\u00eennoit, suspendat sau retras. \u00cen conformitate cu HG nr. 679\/2003, un CIM pentru asistentul maternal se \u00eencheie pe durata de valabilitate a atestatului.<\/p>\n<p>Astfel, \u00een cazurile obi\u0219nuite de suspendare a contractului individual de munc\u0103, angajatorii pot stabili cu u\u0219urin\u021b\u0103 perioada maxim\u0103 de suspendare (de exemplu, concediul pentru cre\u0219terea copilului este de maximum doi ani, sau trei ani \u00een cazul copiilor cu handicap). Legea actual\u0103 specific\u0103 c\u0103 o persoan\u0103 care desf\u0103\u0219oar\u0103 o activitate salarizat\u0103 (\u00een afara celei de asistent maternal) poate deveni asistent maternal doar dup\u0103 \u00eencetarea contractului individual de munc\u0103 pentru activitatea salarizat\u0103. Prin urmare, este neclar cum se vor aplica prevederile Legii 140\/2023 \u00een aceast\u0103 situa\u021bie, \u00een care legea actual\u0103 prevede clar c\u0103 asistentul maternal trebuie s\u0103 \u00eencheie contractul individual de munc\u0103 ini\u021bial pentru a deveni asistent maternal.<\/p>\n<h2><strong>Efectele Suspend\u0103rii Contractului Individual de Munc\u0103<\/strong><\/h2>\n<p>La fel ca orice alt\u0103 suspendare, aceast\u0103 form\u0103 de suspendare genereaz\u0103 anumite consecin\u021be juridice. \u00cen urma suspend\u0103rii CIM, salariatul nu va mai presta munc\u0103 pentru angajatorul s\u0103u \u0219i nu va mai primi drepturi salariale. Cu toate acestea, anumite drepturi \u0219i obliga\u021bii ale ambelor p\u0103r\u021bi pot supravie\u021bui pe durata suspend\u0103rii.
