Aceast\u0103 directiv\u0103 aduce cu sine noi obliga\u021bii pentru angajatori, av\u00e2nd \u00een vedere at\u00e2t angaja\u021bii actuali, c\u00e2t \u0219i pe cei viitori. De asemenea, clauzele de confiden\u021bialitate referitoare la informa\u021biile salariale vor trebui interzise pentru a asigura respectarea dreptului la egalitate salarial\u0103. De asemenea, vor putea solicita, \u00een scris, informa\u021bii care s\u0103 le permit\u0103 s\u0103-\u0219i evalueze propriul salariu \u00een compara\u021bie cu colegii lor de pe pozi\u021bii similare. \u00cen plus, angajatorii trebuie s\u0103 informeze anual to\u021bi salaria\u021bii cu privire la dreptul lor de a primi date despre nivelul lor individual de remunerare \u0219i nivelurile medii de remunerare, \u00eemp\u0103r\u021bite pe sexe \u0219i categorii de lucr\u0103tori, \u0219i s\u0103 furnizeze aceste informa\u021bii la cererea acestora, \u00eentr-un termen rezonabil \u0219i accesibil pentru lucr\u0103torii cu handicap.<\/p>\n<h2><strong><em>Raport\u0103ri Periodice<\/em><\/strong><\/h2>\n<p>Angajatorii cu cel pu\u021bin 100 de lucr\u0103tori trebuie s\u0103 elaboreze raport\u0103ri periodice pentru a demonstra c\u0103 respect\u0103 obliga\u021bia de remunerare egal\u0103 \u0219i nediscriminatorie. Aceste raport\u0103ri trebuie efectuate pentru prima dat\u0103 p\u00e2n\u0103 la 7 iunie 2027. Conducerea \u00ee\u0219i asum\u0103 r\u0103spunderea pentru informa\u021biile con\u021binute de aceste raport\u0103ri, iar angaja\u021bii trebuie s\u0103 aib\u0103 acces la metodologiile utilizate de angajator.<\/p>\n<h2><strong><em>Diferen\u021be Salariale<\/em><\/strong><\/h2>\n<p>Dac\u0103 se constat\u0103 o diferen\u021b\u0103 de cel pu\u021bin 5% \u00een ceea ce prive\u0219te nivelul mediu de remunerare \u00eentre lucr\u0103torii de sex feminin \u0219i cei de sex masculin \u00een oricare categorie de lucr\u0103tori, angajatorul trebuie s\u0103 demonstreze criterii obiective pentru aceast\u0103 diferen\u021b\u0103 pentru ca aceasta s\u0103 fie admis\u0103. Un organism de monitorizare va superviza evaluarea \u0219i remedierea diferen\u021belor de remunerare.<\/p>\n<p>\u00cen situa\u021bia \u00een care se constat\u0103 o discrepan\u021b\u0103 semnificativ\u0103, de cel pu\u021bin 5% \u00een ceea ce prive\u0219te salariul mediu \u00eentre angaja\u021bii de sex feminin \u0219i cei de sex masculin, \u00een oricare dintre categoriile de angaja\u021bi, angajatorul va fi obligat s\u0103 justifice aceast\u0103 diferen\u021b\u0103 prin intermediul unor criterii obiective, pentru ca aceasta s\u0103 poat\u0103 fi acceptat\u0103 \u00een contextul respectiv. Procesul de evaluare va fi atent monitorizat de c\u0103tre o entitate de supraveghere \u0219i, \u00een general, va implica o procedur\u0103 formal\u0103 \u0219i exhaustiv\u0103. Scopul final al acestei evalu\u0103ri este, desigur, remedierea disparit\u0103\u021bilor salariale.<\/p>\n<p>Chiar \u0219i dup\u0103 ce directiva european\u0103 privind transparen\u021ba salarial\u0103 va fi implementat\u0103, este posibil s\u0103 existe varia\u021bii salariale \u00eentre cei care ocup\u0103 aceea\u0219i pozi\u021bie. <strong><em>Salariile, bonusurile \u0219i alte componente ale remunera\u021biei pot s\u0103 difere \u00eentre angaja\u021bi, cu condi\u021bia s\u0103 nu se bazeze pe criterii discriminatorii.<\/em><\/strong><\/p>\n<h2><strong><em>Anun\u021burile de recrutare \u0219i procesul de recrutare<\/em><\/strong><\/h2>\n<p>Anun\u021burile de recrutare \u0219i denumirile posturilor trebuie s\u0103 fie ajustate pentru a se conforma noilor cerin\u021be stipulate \u00een recenta directiv\u0103 european\u0103 privind transparen\u021ba salarial\u0103. Acest lucru implic\u0103 obliga\u021bia angajatorilor de a specifica \u00een anun\u021bul de angajare nivelul salarial ini\u021bial \u0219i alte componente ale remunera\u021biei lunare, fie \u00eentr-o sum\u0103 fix\u0103, fie \u00eentr-un interval. A doua cerin\u021b\u0103 se axeaz\u0103 mai degrab\u0103 pe principiul egalit\u0103\u021bii \u00eentre sexe &#8211; astfel, anun\u021burile pentru posturile vacante \u0219i denumirile posturilor trebuie s\u0103 fie neutre din punct de vedere al sexului. Cu alte cuvinte, companiile nu vor mai putea folosi termeni precum &#8222;secretar\u0103&#8221; \u00een mod exclusiv. Aceasta reprezint\u0103 o modalitate de a promova \u00een principiu &#8222;egalitatea de \u0219anse la angajare&#8221; prin utilizarea unor denumiri de pozi\u021bii neutre din punct de vedere al sexului \u0219i prin aplicarea unei proceduri de recrutare nediscriminatorii. \u00cen plus, directiva prevede c\u0103 \u201e<em>Angajatorilor nu ar trebui s\u0103 li se permit\u0103 s\u0103 se intereseze sau s\u0103 \u00eencerce \u00een mod proactiv s\u0103 ob\u021bin\u0103 informa\u021bii despre remunera\u021bia actual\u0103 sau istoricul salarial anterior al unui solicitant de loc de munc\u0103.<\/em>\u201d<\/p>\n<h2><strong><em>Obliga\u021bii Similare pentru Angajatorii Mici<\/em><\/strong><\/h2>\n<p>Directiva nu impune neap\u0103rat o povar\u0103 suplimentar\u0103 angajatorilor mici, adic\u0103 celor cu sub 100 sau 50 de angaja\u021bi. Aceasta impune angajatorilor mici doar s\u0103 ofere informa\u021bii pe care, \u00een prezent, le furnizeaz\u0103 dificil sau mai t\u00e2rziu. Aceasta acoper\u0103 at\u00e2t sectorul privat, c\u00e2t \u0219i sectorul public.<\/p>\n<h2><strong><em>Transparen\u021ba Oferit\u0103 Deja<\/em><\/strong><\/h2>\n<p>Chiar \u0219i \u00eenainte de implementarea directivei, ofertele de angajare ar trebui s\u0103 fie transparente \u00een conformitate cu legile actuale.
