Aceasta nu necesit\u0103 aprobarea angajatorului, ci doar notificarea acestuia cu privire la decizia angajatului.<\/p>\n<p>Trebuie s\u0103 punct\u0103m \u00eenc\u0103 de la \u00eenceput c\u0103 emisia nu este o cerere. Uneori, exist\u0103 confuzii \u0219i angaja\u021bii pot prezenta documente sub forma unor &#8222;Cereri de Aprobare a Demisiei.&#8221; Acestea sunt gre\u0219ite, deoarece demisia este un act de voin\u021b\u0103 unilateral\u0103. Demisia presupune doar notificarea angajatorului, exprimarea liber\u0103 a voin\u021bei angajatului de a pune cap\u0103t raporturilor de munc\u0103.<\/p>\n<p><strong>Termenul de preaviz este obligatoriu \u00een cazul demisiei,&nbsp;<\/strong>cu exceptia situatiei in care angajatorul renunta la acest termen sau cand angajatorul nu \u00ee\u0219i respect\u0103 obliga\u021biile contractuale.<\/p>\n<p>Spre exemplu, dac\u0103 angajatorul nu \u00ee\u0219i achit\u0103 obliga\u021biile contractuale (salariu, zile libere etc.), angajatul nu este obligat s\u0103 respecte termenul de preaviz.<\/p>\n<p>Trebuie s\u0103 punct\u0103m totodat\u0103 c\u0103 \u201dAbsen\u021ba oric\u0103rei men\u021biuni sau rezerve din partea angajatorului pe cererea de demisie formulat\u0103 de salariat, prin care acesta precizeaz\u0103 ca demisia va opera \u00eencep\u00e2nd cu data cererii, are semnificatia renun\u021b\u0103rii.\u201d<\/p>\n<p><strong>Nerespectarea de c\u0103tre angajat a termenului de preaviz, f\u0103r\u0103 motive \u00eentemeiate, echivaleaz\u0103 cu absentarea nemotivat\u0103 de la locul de munc\u0103. De aici, angajatorul poate porni procedura de cercetare disciplinar\u0103.<\/strong><\/p>\n<h2><strong>Cum se Face Demisia Corect?<\/strong><\/h2>\n<p>Demisia trebuie s\u0103 fie \u00eenregistrat\u0103 \u00een registrul de intrare-ie\u0219ire al angajatorului.
