Aceast\u0103 perioad\u0103 dintre semnarea acordului de \u00eencetare \u0219i momentul efectiv al \u00eencet\u0103rii nu este considerat\u0103 un preaviz, ci un termen pe care ambele p\u0103r\u021bi sunt obligate s\u0103 \u00eel respecte. Chiar dac\u0103 demisia este un act unilateral, adic\u0103 este o decizie luat\u0103 de c\u0103tre salariat f\u0103r\u0103 a necesita aprobarea angajatorului, \u0219i acesta din urm\u0103 are doar rolul de a \u00eenregistra demisia, este important de subliniat c\u0103 revenirea asupra deciziei de demisie nu presupune automat c\u0103 rela\u021bia de munc\u0103 va continua f\u0103r\u0103 a lua \u00een considerare faptul c\u0103 demisia a fost depus\u0103.<\/p>\n<p>Dac\u0103, dup\u0103 depunerea cererii de demisie, angajatul \u00ee\u0219i d\u0103 seama c\u0103 vrea s\u0103 continue s\u0103 lucreze pentru angajatorul s\u0103u sau c\u0103 circumstan\u021bele s-au schimbat \u00een favoarea sa, acesta trebuie s\u0103 ajung\u0103 la un acord com\u00fan cu angajatorul care are dreptul s\u0103 decid\u0103 dac\u0103 accept\u0103 sau nu retragerea cererii tale de demisie.<\/p>\n<p>Prin urmare, o simpl\u0103 cerere depus\u0103 de c\u0103tre un salariat prin care solicit\u0103 retragerea demisiei nu este de ajuns pentru a asigura continuarea rela\u021biei din contractul individual de munc\u0103 (CIM) la \u00eencheierea termenului de preaviz. Este necesar ca angajatorul s\u0103 fie de acord cu aceast\u0103 retragere \u0219i s\u0103 documenteze acest acord \u00een scris sau, \u00een caz contrar, s\u0103 semneze un nou CIM cu salariatul, dup\u0103 expirarea termenului de preaviz.<\/p>\n<p>\u00cen concluzie, dup\u0103 depunere, cererea de demisie poate fi retras\u0103 numai cu acordul angajatorului. \u00cen plus, orice modificare a datei de \u00eencetare a raportului de munc\u0103 trebuie \u00eenregistrat\u0103 \u00een scris.
