At\u00e2t \u00een cazul demisiei, c\u00e2t \u0219i \u00een cazul concedierii, angajatorul are op\u021biunea de a renun\u021ba la drepturile sale, cu condi\u021bia s\u0103 pl\u0103teasc\u0103 salariul pe perioada preavizului stabilit \u0219i s\u0103 renun\u021be la presta\u021biile salariatului \u00een aceea\u0219i perioad\u0103.<\/p>\n<h2><strong>Respectarea preavizului \u00een cazul concedierii<\/strong><\/h2>\n<p>Concedierea trebuie \u00eenso\u021bit\u0103 obligatoriu de acordarea preavizului stabilit \u00een cazul concedierii. Dac\u0103 angajatorul nu respect\u0103 preavizul, concedierea poate fi anulat\u0103, iar salariatul \u00ee\u0219i poate reclama drepturile \u00een instan\u021b\u0103.<\/p>\n<h2><strong>Concediu medical \u00een preaviz<\/strong><\/h2>\n<p>Intrarea \u00een concediu medical \u00een perioada de preaviz nu anuleaz\u0103 preavizul. Preavizul va fi suspendat pe perioada concediului medical \u0219i va continua dup\u0103 revenirea la munc\u0103.<\/p>\n<h2><strong>Nerespectarea preavizului implic\u0103 re\u021binerea de bani din salariu<\/strong><\/h2>\n<p>Pentru perioada de preaviz la demisie trebuie s\u0103 existe un document care s\u0103 ateste ultima zi de lucru a salariatului. \u00cen lipsa acestui document, orice absen\u021b\u0103 din timpul preavizului va fi considerat\u0103 nemotivat\u0103 \u015fi poate duce fie la am\u00e2narea efectiv\u0103 a datei de la care va \u00eenceta contractul, fie la mai pu\u0163in bani la ultimul salariu primit. Totu\u015fi, ace\u015fti bani lips\u0103 nu pot reprezenta o re\u0163inere din salariu, acest lucru put\u00e2nd fi f\u0103cut pe alte considerente, ci doar o neplat\u0103 a zilelor nelucrate.<\/p>\n<h2><strong>Beneficiile \u00een perioada preavizului<\/strong><\/h2>\n<p>Pe durata preavizului, angajatul are dreptul la toate beneficiile \u0219i bonusurile pe care le primea anterior. Perioada de preaviz stipulat\u0103 \u00een contractul de munc\u0103 trebuie s\u0103 fie respectat\u0103 de ambele p\u0103r\u021bi.<\/p>\n<h2>Decizia de concediere nu este anulabil\u0103 dac\u0103 aceasta nu men\u021bioneaz\u0103 perioada de preaviz<\/h2>\n<p>Dac\u0103 <strong>decizia de concediere nu men\u021bioneaz\u0103 explicit perioada de preaviz, acest lucru nu o face automat anulabil\u0103<\/strong> at\u00e2ta timp c\u00e2t angajatorul poate s\u0103 demonstreze c\u0103 a acordat \u00een mod efectiv preavizul salariatului.<\/p>\n<p>Preavizul reprezint\u0103 o perioad\u0103 esen\u021bial\u0103 la \u00eencheierea rela\u021biei de munc\u0103 \u0219i trebuie tratat cu aten\u021bie \u0219i respect de ambele p\u0103r\u021bi implicate.
