Cu toate acestea, simpla men\u021bionare a existen\u021bei regulamentului nu este suficient\u0103. Formalit\u0103\u021bile privind acest document \u00eencep cu \u00eentocmirea sa \u0219i se extind p\u00e2n\u0103 la fiecare situa\u021bie de angajare, c\u00e2nd \u00een prima zi de lucru, fiec\u0103rui nou angajat trebuie s\u0103 i se prezinte regulamentul intern. De asemenea, acelea\u0219i formalit\u0103\u021bi impuse la \u00eentocmire trebuie reluate \u0219i \u00een cazul fiec\u0103rei modific\u0103ri aduse textului regulamentului.<\/p>\n<p>Regulamentul intern reprezint\u0103 documentul specific fiec\u0103rei unit\u0103\u021bi, \u00een care sunt reglementate drepturile \u0219i obliga\u021biile p\u0103r\u021bilor, \u00eens\u0103 acestea nu pot dep\u0103\u0219i limitele impuse de actele normative care reglementeaz\u0103 rela\u021biile de munc\u0103, precum Codul Muncii \u0219i alte acte similare. Acest aspect este str\u00e2ns legat de alte drepturi ale angajatorului \u0219i constituie unul dintre elementele definitorii ale abaterilor disciplinare, \u00een func\u021bie de caz.<\/p>\n<p>Obliga\u021bia angajatorului nu se rezum\u0103 doar la \u00eentocmirea regulamentului intern, ci se extinde \u0219i asupra consult\u0103rii colective a salaria\u021bilor, \u00een cazul \u00een care ace\u0219tia sunt organiza\u021bi sindical sau \u0219i-au ales reprezentan\u021bii. Cu toate c\u0103 consultarea este obligatorie, angajatorul are autoritatea de a decide con\u021binutul regulamentului intern, chiar \u0219i \u00een situa\u021bia \u00een care reprezentan\u021bii sindicali sau lucr\u0103torii au opinii divergente sau dezacord asupra unor reglement\u0103ri din propunerea angajatorului.<\/p>\n<p>Cu toate c\u0103 angajatorul este cel care stabile\u0219te con\u021binutul regulamentului intern, acest fapt nu \u00eenl\u0103tur\u0103 dreptul salaria\u021bilor de a contesta dispozi\u021biile care le \u00eencalc\u0103 drepturile, iar acest drept poate fi exercitat inclusiv individual.<\/p>\n<p>De\u0219i regulamentul intern nu este inclus \u00een etapa inform\u0103rii prealabile la momentul angaj\u0103rii, candida\u021bii sau persoanele care solicit\u0103 angajarea trebuie s\u0103 fie informa\u021bi cu privire la regulamentul intern \u00een prima zi de lucru.<\/p>\n<p>Potrivit Art. 243 din Codul Muncii:<\/p>\n<p>(1) Angajatorul are obliga\u021bia de a aduce la cuno\u0219tin\u021ba fiec\u0103rui salariat prevederile regulamentului intern, \u00een prima zi de lucru, \u0219i de a face dovada \u00eendeplinirii acestei obliga\u021bii.<\/p>\n<p>(2) Aducerea la cuno\u0219tin\u021ba salaria\u021bilor a prevederilor regulamentului intern se poate realiza pe suport h\u00e2rtie sau \u00een format electronic, cu condi\u021bia ca, \u00een acest din urm\u0103 caz, documentul s\u0103 fie accesibil salariatului \u0219i s\u0103 poat\u0103 fi stocat \u0219i printat de c\u0103tre acesta.<\/p>\n<p>(3) Regulamentul intern \u00ee\u0219i produce efectele fa\u021b\u0103 de salariat de la momentul lu\u0103rii la cuno\u0219tin\u021b\u0103 a acestuia.<\/p>\n<p>(4) Regulamentul intern se afi\u0219eaz\u0103 la sediul angajatorului.<\/p>\n<p>Obliga\u021bia angajatorului de a demonstra c\u0103 a adus la cuno\u0219tin\u021ba salaria\u021bilor prevederile regulamentului intern este esen\u021bial\u0103. Aceasta poate fi realizat\u0103 fie prin un \u00eenscris (pe suport h\u00e2rtie), \u00een care salariatul s\u0103 confirme c\u0103 i-a fost comunicat regulamentul intern, fie prin confirmarea recep\u021bion\u0103rii fi\u0219ierului electronic care con\u021bine acest document \u0219i asigurarea integrit\u0103\u021bii acestuia.<\/p>\n<p>At\u00e2t \u00een cazul formatului fizic (suport h\u00e2rtie), c\u00e2t \u0219i \u00een cazul formatului electronic, o copie a regulamentului intern trebuie s\u0103 fie afi\u0219at\u0103 la sediul angajatorului, asigur\u00e2ndu-se astfel c\u0103 orice salariat poate consulta dispozi\u021biile interne \u0219i drepturile specifice care le revin \u00een cadrul unit\u0103\u021bii.<\/p>\n<p>\u00cen situa\u021bia \u00een care au loc modific\u0103ri ulterioare comunic\u0103rii regulamentului intern, angajatorul trebuie s\u0103 respecte acelea\u0219i obliga\u021bii, adic\u0103 s\u0103 urmeze procedura consult\u0103rii colective \u0219i s\u0103 comunice modific\u0103rile c\u0103tre salaria\u021bi. Aceste formalit\u0103\u021bi nu ar trebui tratate cu neglijen\u021b\u0103, deoarece nerespectarea lor poate avea efecte directe \u0219i indirecte pentru angajator.<\/p>\n<p>\u00cen concluzie, comunicarea regulamentului intern c\u0103tre angaja\u021bi \u0219i demonstrarea \u00eendeplinirii acestei obliga\u021bii sunt aspecte deosebit de importante \u00een asigurarea unui climat de munc\u0103 transparent \u0219i conform cu legisla\u021bia \u00een vigoare.
