{"id":7684,"date":"2023-07-11T16:49:02","date_gmt":"2023-07-11T13:49:02","guid":{"rendered":"https:\/\/www.lugera.ro\/blog\/?p=7684"},"modified":"2023-07-25T20:32:05","modified_gmt":"2023-07-25T17:32:05","slug":"importanta-regulamentului-intern-consultarea-angajatilor-comunicarea-eficienta-si-respectarea-dispozitiilor","status":"publish","type":"post","link":"https:\/\/www.lugera.ro\/blog\/importanta-regulamentului-intern-consultarea-angajatilor-comunicarea-eficienta-si-respectarea-dispozitiilor\/","title":{"rendered":"Importan\u021ba Regulamentului Intern: Consultarea angaja\u021bilor, comunicarea eficient\u0103 \u0219i respectarea dispozi\u021biilor"},"content":{"rendered":"<p style=\"text-align: justify;\">Adesea, angajatorii neglijeaz\u0103 formalit\u0103\u021bile prev\u0103zute de lege pentru \u00eentocmirea \u0219i aducerea la cuno\u0219tin\u021b\u0103 a regulamentului intern, iar conceptul de consultare poate fi \u00een\u021beles gre\u0219it, rezult\u00e2nd \u00eentr-o simpl\u0103 bifare a documentelor.<\/p>\n<p style=\"text-align: justify;\">Codul muncii \u0219i ansamblul normativ asociat ofer\u0103 cadrul general pentru reglementarea rela\u021biilor de munc\u0103, \u00eens\u0103 regulile concrete \u0219i specifice fiec\u0103rei unit\u0103\u021bi, precum \u0219i modalitatea de aplicare a acestora, sunt stabilite prin negociere colectiv\u0103 (pentru contractul colectiv de munc\u0103) \u0219i\/sau prin consultare colectiv\u0103 (pentru regulamentul intern).<\/p>\n<p style=\"text-align: justify;\">\u00cen prezent, negocierea este obligatorie \u00een unit\u0103\u021bile care au peste 10 salaria\u021bi, cu excep\u021bia micro\u00eentreprinderilor \u00een care niciun salariat nu face parte dintr-o organiza\u021bie sindical\u0103 capabil\u0103 s\u0103 solicite negocierea.<\/p>\n<p style=\"text-align: justify;\">Regulamentul intern este obligatoriu pentru to\u021bi angajatorii, indiferent de num\u0103rul salaria\u021bilor, \u0219i, chiar dac\u0103 responsabilitatea \u00eentocmirii acestuia revine angajatorului, consultarea lucr\u0103torilor este obligatorie.<\/p>\n<p style=\"text-align: justify;\">De\u0219i nu se precizeaz\u0103 explicit c\u0103 angajatorul trebuie s\u0103 demonstreze consultarea, este datoria acestuia s\u0103 fac\u0103 dovada c\u0103 a respectat aceast\u0103 etap\u0103 \u0219i a consultat colectiv salaria\u021bii.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/07\/shutterstock_1022439985.jpg\"><img decoding=\"async\" class=\"alignnone wp-image-7686 size-full lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/07\/shutterstock_1022439985.jpg\" alt=\"aducerea la cuno\u0219tin\u021b\u0103 a regulamentului intern\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/07\/shutterstock_1022439985.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/07\/shutterstock_1022439985-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/07\/shutterstock_1022439985-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">Conceptul de consultare este definit \u00een trei acte normative (<a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/77783\" target=\"_blank\" rel=\"noopener\">Legea 467\/2006<\/a>, <a href=\"https:\/\/www.codulmuncii.ro\/homepage.html\" target=\"_blank\" rel=\"noopener\">Codul Muncii<\/a> \u0219i <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/262989\" target=\"_blank\" rel=\"noopener\">Legea 367\/2022<\/a>), suger\u00e2nd un schimb de p\u0103reri \u0219i stabilirea unui dialog \u00eentre angajator \u0219i reprezentan\u021bii angaja\u021bilor.<\/p>\n<p style=\"text-align: justify;\"><strong>Codul muncii<\/strong> stabile\u0219te c\u0103 dispozi\u021biile regulamentului intern sunt opozabile salaria\u021bilor de la momentul cunoa\u0219terii lor, iar regulamentul trebuie comunicat fiec\u0103rui salariat \u00een prima zi de lucru.<\/p>\n<p style=\"text-align: justify;\"><em><span style=\"text-decoration: underline;\"><strong>Comunicarea Regulamentului Intern<\/strong><\/span><\/em> trebuie s\u0103 respecte anumite aspecte, inclusiv faptul c\u0103 angajatorul trebuie s\u0103 probeze c\u0103 a transmis regulamentul intern fiec\u0103rui salariat. Astfel, o simpl\u0103 semnare a unor documente \u00een cadrul unei \u0219edin\u021be nu este suficient\u0103, fiecare lucr\u0103tor trebuie s\u0103 primeasc\u0103 o copie a regulamentului intern.<\/p>\n<p style=\"text-align: justify;\">Articolul 243 alineatul (2) clarific\u0103 faptul c\u0103 regulamentul intern poate fi comunicat pe suport h\u00e2rtie sau \u00een format electronic, \u00een cazul \u00een care documentul poate fi accesat, stocat \u0219i tip\u0103rit de c\u0103tre salariat.<\/p>\n<p style=\"text-align: justify;\">\u00cen cazul telesalaria\u021bilor, varianta \u00een format electronic este de preferat, dar pentru celelalte categorii de salaria\u021bi, aceasta trebuie s\u0103 fie stabilit\u0103 \u00een func\u021bie de circumstan\u021be.<\/p>\n<p style=\"text-align: justify;\">Scopul principal al comunic\u0103rii este de a asigura accesul permanent al salaria\u021bilor la regulamentul intern, fie c\u0103 acesta este comunicat pe suport h\u00e2rtie sau electronic.<\/p>\n<p style=\"text-align: justify;\">Importan\u021ba facilit\u0103rii accesului angajatului la regulamentul intern este subliniat\u0103 \u0219i de articolul 243 alineatul (4), care prevede obliga\u021bia angajatorului de a-l afi\u0219a la sediu, indiferent de modalitatea de comunicare, pe suport h\u00e2rtie sau \u00een format electronic.<\/p>\n<p style=\"text-align: justify;\">Credit foto <a href=\"http:\/\/shutterstock.com\" target=\"_blank\" rel=\"noopener\">shutterstock.com<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Adesea, angajatorii neglijeaz\u0103 formalit\u0103\u021bile prev\u0103zute de lege pentru \u00eentocmirea \u0219i aducerea la cuno\u0219tin\u021b\u0103 a regulamentului intern, iar conceptul de consultare poate fi \u00een\u021beles gre\u0219it, rezult\u00e2nd \u00eentr-o simpl\u0103 bifare a documentelor.
